    3. ORDERS--HENDERSON COUNTY COURT. page 261 April term, 22nd Day, April, 1878 ------------------------------------------------------------------------ Ordered that Esquire W. H. Webster time for holding court from the 3rd Saturday to the 4th Saturday On the motion of B.F. Martin, it is ordered that Thomas S. Knight be Administrator of T.P. Whitman decd. be ruled to execute a new bond as such Administrator on or before the next term of this court. Obadiah Brown & wife Plaintiffs Against Judgement Wm. Pritchett and Others Defendants This cause coming on for trail upon the pleadings and exhibits and it appearing that the parties have been duly summoned. It is adjudged by the court that the plaintiff and defendants own the track of land ineutioned in the petition in the proportion as therein set out viz.': That the plaintiff own (7/10) seven tenths of said land. One tenth in the right of Elizabeth Brown (plaintiff) formerly Elizabeth Taylor as heir, one tenth by purchase from James Taylor, one tenth by purchase from David Taylor, one tenth by purchase from Urie Roberts, one tenth by purchase from Jeff Kennedy (vended of M. Taylor) one tenth by purchase are from Adelai Butts and one tenth by purchase by Judah Taylor, And that the defendants Melzena Pritchett own two tenths of said land, one tenth in her own right as heir of Mary Taylor, decd. and one tenth by purchase from Lucy Taylor. And that Geo. W. Taylor and Mary J. Taylor, infants own one tenth of said land as heirs of their mother Lucinda Johnson, decd. (Formerly Lucinda Taylor) The said land is situated in Henderson County on the water of Highland Creek and bounded as follows towith: Beginning at a hickory near the corner of McClure's field and corner to land sold to Handley and Trigg. And with their line S 30* W 248 poles to thier corner in the original line of Geo. F. Norton and with the same N 60* W 408 to land sold by Moses Baker and with the line of same N 30* E 124 poles to his corner, and with another line of same S 60* E 280 poles to another corner of same and with another line of same N 30* E 124 poles to his corner near a spring in the original line of Norton and with said lines S 60* E 128 poles to the beginning being same sold by Austin P. Cox to Catherine Hamch (?_Hammett_?) It is further ordered that Wm. Tapp, Henry Tapp, Jeff Melton and Eli Tapp and Isaiah Crooks together with A. C. Walker Surveyor be and they are hereby appointed Commisioners herein and are .............. ORDERS--HENDERSON COUNTY COURT. page 262 April term, 22nd Day, April, 1878 ------------------------------------------------------------------------ parties thereto entitled as herein before stated and in making said division they will have due regaurd to quantity and quality and will lay the same off in lot or in lots adjoining each other. And they will lay off to the defendant Melzena Prittchet two tenths of said land in quantity and quality and lay off same in one body or in lots adjoining each other. And they will lay off to infant defendants Geo. W. Johnson and Mary J. Johnson one tenth of said land in quantity and quality, said commisioners two of them together with said surveyor shall meet on said land on the 29th day of April 1878 if fair, and if not fair then the first fair day thereafter and proceed to make sais division and they may ____ and adjoin from day to day or to some other day as suits their convienience until they shall have completed said division and they will report their divison together with a plat showing the lots and the parties to whom the same have been allotted and they will report thier acts done under this order to the next term of this court until which time this cause is continued. This day R. J. Butler and M. D. Denton viewers appointed on the application of Thomas McFarland to view and report a change in the road from the Henderson and Owensboro Road to Deleware appeared and filed their report and it appearing from said report that the proposed change would be advantageous to all parties. It is ordered that said Delaware road changed as to commence on the Henderson and Owensboro road at the line between Barnett and McFarland and running with their line until in intersects said Delaware Road and that it be opened and put in condition for public travel by said McFarland before the old road is discontinued. And then Court adjourned until tomorrow P.H.
