ORDERS--HENDERSON COUNTY COURT. page 291 June Continued term, 28th Day, June, 1878 ------------------------------------------------------------------------ The Court met pursuant to adjournment at the Court house in the City of Henderson Kentucky on the 28th day of June 1878 present P. H. Lockett, Judge Shelby Jordan - one of the subscribing witnesses to the paper _________ to be last Will and Testament of Mary Jane Chandler decd. this day appeared and being examined touching the execution of said instrument testified that it was signed and published by the said Mary Jane Chandler in his presence and in the presence of Jno S. Hosman the other subscribing witness that he signed said instrument of the Testatrix and of the other witness, and that Mrs. Mary Jane Chandler was of sound mind and disposing memory. It is adjudged that the said instrument is the true last WIll and Testament of Mary Jane Chandler decd. and ordered to be recorded as such. Ordered that Coffey and McLaughlin be allowed the sum of fifty dollars payable out of the County S___ of 1878 for putting water pipes and hydrants in the Court House. And then Court was dismissed until tomorrow P.H. Lockett, Judge The Court met pursuant to adjournment at the Court house in the City of Henderson Kentucky on the 29th day of June 1878 present P. H. Lockett, Judge Obadiah Brown and Wife Plaintiff Against Wm. Pritchett & wife and others Defendants This cause coming in further to be heard upon the commisioners Report filed herein May 27th 1878 and it appearing that there has been no exceptions thereto, It is ordered and adjudged that the same be and is now confimed and ordered to be recorded together with the plat of survey accompanying same, and it is further ordered that Geo. W. Smith be and he is hereby appointed Special Conveyance to the several parties in accordance with said reporting viz.: He will convey to Melzena Pritchett two tenths of said land in.......... Johnson and Mary J. Johnson he will convery one tenth as allotted and bounded in said report it being twenty four acres and he will convey to Judah Taylor one tenth twenty five acres laid off and bounded in said report. The contract of purchase by the Plaintiff Brown from Said Judah Taylor having been by mutual concent cancelled. and he will convey to Obidiah Brown and his wife Elizabeth Brown the remaining six tenths as laid off and bounded in said report, being one hundred seven acres and 24 square poles. It is further judged that the parties plaintiffs and defendants pay the cost of this such in proportion to their several interech(?) viz: That O.B. Brown and wife pay six tenths and Wm. Pritchett and Melzina Pritchett pay two tenths and the heirs of Lucinda Johnson and Judah Taylor pay one tenth each and it is further ordered that Sol S Sizemore be allowed Twenty Five Dollars for his services as attorney herein to be taxedand paid as part of the costs herein, and it is adjudged that the parties interested have a lein apon the share of land of each of the parties for the payment of his share of the cost and expenses this division, and it is ordered that the surveyor R. C. Walker be allowed Eight dollars and the commisioners Wm. Tapp, Henry Tapp, Jeff Melton, Josiah Crooks be allowed for two days each the amount allowed by law and J. L. Dorsey Gaurdian Ad Litum herein is allowed Five Dollars, all to be taxed as cost, and this cause is continued And then Court was dismissed until the 1st of July 1878 P.H.
