This Indenture made and entered into this the (blank) day of Sept. 1865 between R. B. Evans as commissioner under a Judgement of the Barren County Court of the first part and E. M. WILSON & wife of W E Wilson of the second part Witnesseth that whereas at the (blank) Term 18(blank) of the Barren County Court in a suit pending therein in which W M Wilson, W E WIlson & T M DICKEY Guard. for Buford PEMBERTON, John T Pemberton & William Pemberton are Plffs against Tho H Pemberton, Chs T Pemberton, Spotswood Pemberton, Sarah Pemberton, Emily BUSH & W A Bush Defts a Judgement was rendered by which it was ordered & adjudged that the lands belonging to the estate of John W Pemberton decd be divided and allotted to the heirs of said decedent & Thos DAVIS, Thos S WALTON & W M WINLOCK were appointed commissioners to execute Said Judgement - and whereas at the ___ Term 18__ of Said Court Said Commissioners filed their Report in open Court showing among other things that they had allotted to E M Wilson late widow of said decedent her dower in and to Said lands Lot No. 1 was allotted to the Said E M Wilson. Said lot described and bounded as follows towit - Beginning at a Stake in WOODS line, D C Walton's corner thence N 85E40 poles to a Stake in Woods line thence N6 1/2 E 161 poles to a post oak thence S85W40 poles to a red oak and post oak D C Waltons line thence S 6 1/2 W160 poles to the Beginning including the dwelling House and the improvements containing 40 acres lying & being in Barren County on the waters of Blue Spring Creek - and whereas further at the ___ term 1865 of said County7 Court a Judgement was rendered confirming the report of said Commissioners & appointing R B Evans a commissioner to convey the lands to the persons entitled thereto as shown by Said report - Now therefore in consideration of the premises & by virtue of the authority vested in me as com. under said Judgement, I do hereby for & on behalf of the children & heirs of said decedent convey the said land as above described to the Said E M WIlson. To have & to hold unto her the Said E M Wilson her heirs & assigns forever, and I agree to warrant & defend the title to Said land to be free from all claims whatever.
