"This Indenture made & entered into this the 12th day of May 1865 between R B EVANS Comr. appointed by the Barren County Court of the first part & Mary E. HARRIS of the Second part - Witnesseth that whereas at the January terms 1865 of said County Court a Petition was filed in Said Court by Jand WELLS & her husband B. C. WELLS, Sally T (or L) KINCHLOE & her husband Seth KINCHLOE, Kitty B. WELLS & her husband B B WELLS, Judy MATTHEWS & her husband James MATTHEWS, John HARRIS, Mary E HARRIS, D HARRIS, Beverly C HARRIS by their Guardian Wm WELLS Jr, heirs of John R HARRIS dec'd & Adaline HARRIS widow of said John R HARRIS. Stating among other things that the said John R Harris died testate in Said county & that at the time of his death he was the owner of certain lands in Said county laying on Skeggs Creek & by said Petition they prayed Said court to appoint commissioners to divide said lands between Said heirs & allot to the widow Adaline Harris her dower in Said lands & at the February term of said court U. WRIGHT, Batley WILKINSON & B G SMITH were appointed Commissioners to make said division & allotment & at the March term 1865 Said commissioners filed their report in court showing the manner in which they had made Said division & by said report they gave & allotted to Said Mary E Harris Lot No 6 which is described therein as containing 36 acres, and bounded as follows to wit: "Beginning at a stake on MARSHALLS line & corner to Beverly L C [sic] thence with the Same S80E48 poles to a poplar bush, thence S12W118 poles to a beech & hickory. Thence with the original line to Beverly L C line to the Beginning." And whereas at the April term 1865 of said Court a Judgment was rendered confirming Said report & appointing R B Evans a commissioner to convey the land so divided & allotted to the persons entitled thereto as shown by said report. Now therefore in consideration of the premises & by virtue of the authority vested in me under Said Judgment I do hereby convey for & on behalf of said heirs & widow of said John R Harris Said Land to Mary E Harris, her heirs & assigns forever. To have & to hold the Same forever & I agree to warrant & defend the title to Said land to be free from all claims whatever. So far as I am empowered or directed by said Judgment to do. In witness whereof I hereunto set my hand & seal the date above written. /s/ R. B. Evans, Comr. {seal}. Enclosed was the following piece of paper: Whereas J R Harris made to me a deed on the 16th August 18672 to their tracts of land in Barren county Kentucky which deed was acknowledged before the clerk of the Barren County Court on said 16th day of August 1862. Which deed has never been recorded. Now I hereby direct the Clerk of said County Court to deliver said deed to said J R Harris, as I do not wish it - recorded August 29th 1864. /s/ Polly (X) Harris (her mark).
