    3. Many times when we find an ancestor's will, there will be a codicil or more than one. The ancestor could have re-written the entire will, but normally, they just made changes to the will's provisions by adding one or more codicils. What could cause the need for a revision to the original will? The spouse had died A child had died A married son or daughter had divorced. A child had disappeared into parts unknown There was a wayward child. He/she was written out of the will. A child had married and had children who needed to be added to the will A child had become disabled and needed a guardian appointed The ancestor had bought more land which needed to be cited in the will. The ancestor had sold land which had been given to a child or spouse. The ancestor's health had become impaired and he/she needed one or more of the children to live on the land and take care of them. Slaves had been bought, sold, died or had more children An heir had moved out of the area and didn't want what was given him. A business possibly co-owned with another had gone out of business. A guardian appointed in the will had died or refused to quality. An executor named had died or refused to quality. I'm sure you can think of many more reasons. When you read your ancestor's will and there is a codicil, try to determine what had happened in this individual's life that caused the need to revise the will. And whereas Edward EVANS has sold two town lots in the town of Glasgow (to be hereinafter described) for the use aforesaid. Now therefore this indenture made and entered into this 24th day of December 1844, between Edward Evans and Nancy Evans his wife of the one part and Robert C. LOGAN as trustee for the said Harriet H Shirley and her children of the other part, Witnesseth, That for and in consideration of the sum of three hundred and fifty dollars in hand paid the receipt whereof is hereby acknowledged by the said Evans & wife, they have this day sold and do by these presents sell and convey unto the said Robert C Logan for the use aforesaid two certain lotts in the town of Glasgow known and designated on the original plan of said town by the No.s (83 & 84) eighty three and eighty four, with all singular the appurtenances thereunto belonging or appertaining the rights, title to which lotts the said Edward Evans agrees and hereby covenants to warrant, and forever defend to the said Logan for the use aforesaid., free from the claim or claims of all and every person whatever. It is moreover the request of said Crump & Helm that the above named trustee have power to dispose of the above named property whenever it shall appear to his satisfaction that the proceeds thereof can be vested in a more advantageous home for the said Harriet H. Shirley & her children, it is therefore understood & provided that the said trustee shall at any and all times have power to sell & convey the title of said two town lotts (if the said Harriet H Shirley shall concur in such sale) and wish the proceeds thereof in another home for said H. H. Shirley & her children she being also consulted in relation to such investment and concurring therein. SMITH - 1869 STELLA SMITH - 1873 ELIJAH H. SMITH can be found in the 1870 census with his wife and children in Hart Co., KY. He is listed as E.H. SMITH and was the assistant marshall of this census. In the 1880 census, only his wife and children remaining at home can be found living in Princeton, Mercer Co., Missouri. ANNIE SMITH appears as widowed. What happened to Elijah? When did he die?
