    1. [KY-CEM] Illegal Moving of Graves?
    2. Michael Smith
    3. Hi everyone, I do not know much about the laws here in Kentucky concerning cemeteries, so here is a question I have. Recently a family member of mine visited a cemetery in Oldham Co. and found that someone had moved two of our relatives' tombstones and presumably the whole graves as well. I would think that this would be illegal. She said that it looked like they had dug everything up due to development. Would this be illegal for whomever did it, whether it be the owner or whomever? Mind you that this is an older, closed cemetery in which I have ancestors there whom d. even before the 1950s. But wouldn't this still be illegal? Thanks for any help and God bless! Best of luck in all future genealogical ventures, Michael Smith [email protected]

    3. Michael I would imagine who moved the graves would have a lot to do with it. If direct descendants moved them would be one matter, if I came and moved them or a developer moved them it would be another matter. May I add, the law does not stop anyone from doing anything, it only gives the right to sue or have the person arrested. It is a good question, does one have to get permission from Kentucky to move a grave - no matter who does it?
