This instrument was filed for record on the 22nd day of Jan. A.D. 1917, at 10 o’clock A.M. J. W. MCGHEE Register of Deeds. This Indenture, Made this 13th day of September A.D. 1916, between Hiram DARROW and Alice DARROW his wife of Mitchell County, in the State of Kansas of the first part, and Martin PERRY of Mitchell County, in the State of Kansas of the second part: Witnesseth, That said parties of the first part, in consideration of the sum of Six Hundred and no/100 DOLLARS, the receipt whereof is hereby acknowledged, do by these presents Grant, Bargain, Sell and Convey unto said party of the second part, her heirs and assigns, all the following-described Real Estate, situated in the County of Mitchell and State of Kansas, to wit: A tract of land commencing at a point on the East line of Section Nine (9) Town Seven (7) South, of Range Seven (7) W. 6 P.M. 366.30 feet north of the south East corner of said Section Nine. Thence West parallel with the south line of said Section Nine, 351 feet, Thence north parallel with East line of said Section nine, 437 feet, to the South limits of the Right of way of the Union Pacific Railroad Thence south easterly direction along the southern limits of said Right of Way to the East line of said section Nine. Thence south on said section line to place of beginning containing Three acres more or less. To Have and to Hold the Same, Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, forever. And said parties of the first part for themselves their heirs, executors or administrators, do hereby covenant, promise and agree, to and with said party of the second part, that at the delivery of these presents they are lawfully seized in their own right, of an absolute and indefeasible estate of inheritance, in fee simple, of and in all and singular the above granted and described premises, with the appurtenances that the same are free, clear, discharged and unencumbered of and from all former and other grants, titles, charges, estates, judgments, taxes, assignments and incumbrances of what nature or kind soever; and that they will WARRANT AND FOREVER DEFEND the same unto said party of the second part, his heirs and assigns, against said parties of the first part, their heirs, and all and every person or persons whomsoever, lawfully claiming or to claim the same. In Witness Whereof, The said parties of the first part have hereunto set their hands the day and year first above written. Hiram DARROW Alice DARROW STATE OF KANSAS, Mitchell COUNTY, ss. BE IT REMEMBERED, That on this 13th day of September A.D. 1916, before me, the undersigned, a Notary Public, in and for the County and State aforesaid, came Hiram DARROW and Alice DARROW his wife who executed the within instrument of writing, and such persons are personally known to me to be the same persons.
