GENERAL WARRANTY. From S. R. CARTER and Wife to Grant NOAH State of Kansas, Mitchell County, ss. This instrument was filed for record on the 2nd day of Oct., A.D. 1907, at 10:40 o’clock A.M. J. W. MCGHEE Register of Deeds. This Indenture, Made this 10” day of Sept., A.D. 1906, between S. R. CARTER and Rose E. CARTER his wife of Mitchell County, in the State of Kansas, of the first part, and Grant NOAH of Mitchell County, in the State of Kansas, of the second part, WITNESSETH, That said parties of the first part, in consideration of the sum of Two Thousand and no/100 DOLLARS, the receipt whereof is hereby acknowledged, do by these presents grant, bargain, sell and convey unto said party of the second part, his heirs and assigns, all the following-described real estate, situated in the County of Mitchell and State of Kansas, to wit: Lots Seven and Eight (7 & 8) in Block Sixty three (63) in Beloit City, Kansas, TO HAVE AND TO HOLD THE SAME, Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging, or in anywise appertaining, forever. And said first parties for themselves and for their heirs, executors or administrators, do hereby covenant, promise and agree, to and with said party of the second part, that at the delivery of these presents they are lawfully seized in their own right, of an absolute and indefeasible estate of inheritance, in fee simple, of and in all and singular the above granted and described premises, with the appurtenances; that the same are free, clear, discharged and unencumbered of and from all former and other grants, titles, charges, estates, judgments, taxes, assignments and incumbrances, of what nature or kind soever; Thirteen Hundred dollars which 2d party assumes and that they will WARRANT AND FOREVER DEFEND the same unto said party of the second part, his heirs and assigns, against said parties of the first part, their heirs, and all and every person or persons whomsoever. Lawfully claiming or to claim the same. IN WITNESS WHEREOF, The said parties of the first part have hereunto set their hands the day and year first above written. S. R. CARTER Rose E. CARTER State of Kansas, Mitchell County, ss. BE IT REMEMBERED, That on this 10 day of Sept, A.D. 1906, before me, the undersigned, a Notary Public in and for the County and State aforesaid, came S. R CARTER and Rose E. CARTER his wife who are personally known to me to be the same persons who executed the within instrument of writing, and such persons duly acknowledged the execution of the same.
