George K. & Minerva HURD to Hiram J. CARTER Filed for Record on the 14” day of February 1891 at 3 o’clock P.M. F. M. APPLEGATE Register of Deeds. This Indenture, Made this 19th day of Sept. A.D. 1889 between George K HURD and Minerva HURD, husband and wife, of Berry County, in the State of Missouri of the first part and Hiram J. CARTER of Mitchell County, in the State of Kansas of the second part: Witnesseth, that said parties of the first part, in consideration of the sum of Two Thousand and Five Hundred DOLLARS, the receipt of which is hereby acknowledged, do by these presents GRANT, BARGAIN, SELL AND CONVEY unto the said party of the second part, his heirs and assigns, all the following-described REAL ESTATE, situate din the County of Mitchell and State of Kansas to wit: The North West quarter of section No. thirty three (33) township no. Eight (8) South range no. seven (7) West Mitchell County, Kansas containing 160 acres more or less. Also selling and conveying one third of all the crop on said land for the year 1889. To Have and to Hold the Same, Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, forever: And said George K. HURD and Minerva HURD for themselves & their heirs, executors or administrators do hereby covenant, promise and agree, to and with said party of the second part, that at the delivery of these presents they are lawfully seized in their own right, of an absolute and indefeasible estate of inheritance, in fee simple, of and in all and singular the above granted and described premises, with the appurtenances; that the same are free, clear, discharged and unencumbered of and from all former and other grants, titles, charges, estates, judgments, taxes, assessments and incumbrances, of what nature or kind soever; except one certain mortgage of $1500 with all accrued interest thereon and all unpaid taxes on such land which said second party assumes and agrees to pay and that they will WARRANT AND FOREVER DEFEND the same unto said party of the second part, his heirs and assigns, against said parties of the first part, their heirs, and all and every person or person! s whomsoever, lawfully claiming or to claim the same. In Witness Whereof, The said parties of the first part have hereunto set their hands, the day and year first above written. George K. HURD Minervi HURD State of Missouri, Barry County, ss: Be it Remembered, That on this 3rd day of October A.D. 1889, before me, the undersigned, a Notary Public in and for the County and State aforesaid, came George K. HURD and Minerva HURD, husband and wife, who are personally known to me to be the same person who executed the within instrument of writing, and such persons duly acknowledged the execution of the same.
