From C. H. GRIFFITH and Wife to Russell DARROW and Wife State of Kansas, Mitchell County, ss. This instrument was filed for record on the 17th day of Nov., A.D. 1906, at 3 o’clock P.M. J. W. MCGHEE Register of Deeds This Indenture, Made this 17 day of November, A.D. 1906, between C. H. GRIFFITH and Myrtle GRIFFITH, husband and wife of Mitchell County, in the State of Kansas, of the first part, and Russell DARROW and Mary E. DARROW husband and wife of Mitchell County, in the State of Kansas, of the second part, WITNESSETH, that said parties of the first part, in consideration of the sum of One Thousand and no DOLLARS, the receipt whereof is hereby acknowledged, do by these presents grant, bargain, sell and convey unto said parties of the second part, their heirs and assigns, all the following-described real estate, situated in the County of Mitchell and State of Kansas, to wit: The North Thirty-one and one half (31 ½) feet of Lot Ten, (10), and all of Lots Eleven and twelve (11 & 12) in Block Six (6), in the Village of Asherville being a part of a Tract described as commencing at a point 354 feet west and 621 feet south of the North East corner of the North west ½ of Section 34 in Township Seven, South of Range 6 West of the Sixth Principal Meridian in Kansas; Thence South 131 ½ feet: thence in a Southeasterly course along the Rail Road limits 172 feet: thence North 193 feet: Thence West 150 feet to the place of beginning TO HAVE AND TO HOLD THE SAME, Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging, or in anywise appertaining, forever. And said C. H. GRIFFITH and Myrtle GRIFFITH for themselves, their heirs, executors or administrators, do hereby covenant, promise and agree, to and with said parties of the second part, that at the delivery of these presents they are lawfully seized in their own right, of an absolute and indefeasible estate of inheritance, in fee simple, of and in all and singular the above granted and described premises, with the appurtenances; that the same are free, clear, discharged and unencumbered of and from all former and other grants, titles, charges, estates, judgments, taxes, assignments and incumbrances, of what nature or kind soever; Except one Mortgage for $300 and the coupon thereon due the 17th of April, 1907, in favor of Harlan ROBERTS, which second parties assume and agree to pay and that they will WARRANT AND FOREVER DEFEND the same unto said parties of the second part, their heirs and assigns, against said parties of the first part, their heirs, and all and every person o! r persons whomsoever, lawfully claiming or to claim the same. BE IT REMEMBERED, That on this 17th day of November, A.D. 1906, before me, the undersigned, a Notary Public in and for the County and State aforesaid, came C. H. GRIFFITH and Myrtle GRIFFITH his wife who are personally known to me to be the same persons who executed the within instrument of writing, and such persons duly acknowledged the execution of the same.
