SHOOK and Wife to E. M. CARTER State of Kansas, Mitchell County, ss. This instrument was filed for record on the 29” day of April A.D. 1905, at 8:10 o’clock A.M. J. W. MCGHEE Register of Deeds. This Indenture, Made this 25th day of February, A.D. 1905, between Jacob M. SHOOK and Mary C. SHOOK, his wife of Mitchell County, in the State of Kansas, of the first part, and E. M. CARTER of Mitchell County, in the State of Kansas of the second part: WITNESSETH, That said parties of the first part, in consideration of the sum of Three hundred & Fifty and no/100 DOLLARS, the receipt whereof is hereby acknowledged, do by these presents, GRANT, BARGAIN, SELL AND CONVEY, unto said party of the second part his heirs and assigns, all the following described Real Estate, situated in the County of Mitchell and State of Kansas, to wit: A tract of land, Commending at a point on the East line of section Eleven (11)—6.6. Fourty four (44) rods south of the south limits of A. & S. R. R. Thence South twenty five and sixty four hundredths 64/100 rods. Thence west eighteen and seventy two hundredths (18 72/100). Thence north twenty five and sixty four hundredths (25 64/100) rods. Thence East Eighteen and seventy two hundredths (18 72/100) rods. To the place of beginning containing three (3) acres. All situated in Section Eleven (11) of town six (6) South of range six (6) west of six (6”) P.M. TO HAVE AND TO HOLD THE SAME, together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, forever: And said Jacob M. SHOOK and Mary C. SHOOK for themselves their heirs, executors or administrators, do hereby covenant, promise and agree to and with said party of the second part, that at the delivery of these presents they are lawfully seized in their own right, of an absolute and indefeasible estate of inheritance, in fee simple, of and in all and singular the above granted and described premises, with the appurtenances; that the same are free, clear, discharged and unencumbered, of and from all former and other grants, titles, charges, estates, judgments, taxes, assessments, and incumbrances, of what nature or kind soever: and that they will WARRANT AND FOREVER DEFEND the same unto said party of the second part his heirs and assigns, against said parties of the first part their heirs, and all and every person or persons whomsoever, lawfully claiming or to claim the same. SHOOK his wife who are personally known to me to be the same persons who executed the within instrument of writing, and such persons duly acknowledged the execution of the same.
