GENERAL WARRANTY From Ellen J. SUMMERS widow to S. R. CARTER State of Kansas, Mitchell County, ss. This instrument was filed for record on the 19” day of Oct., A.D., 1905, at 2:45 o’clock P.M. J. W. MCGHEE Register of Deeds. This Indenture, Made this 16th day of October, A.D. 1905, between Ellen J. SUMMERS a widow of Mitchell County, in the State of Kansas, of the first part, and S. R. CARTER of Mitchell County, in the State of Kansas, of the second part, Witnesseth, That said parties of the first part, in consideration of the sum of Two Thousand ($2000) DOLLARS, the receipt whereof is hereby acknowledged, does by these presents grant, bargain, sell and convey unto said party of the second part, his heirs and assigns, all the following described real estate, situated in the County of Mitchell, and State of Kansas, to wit: Lots Seven and Eight (7 & 8) in Block Sixty Three (63) Beloit. To have and to Hold the Same, Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, forever. And said first party, for herself, her heirs, executors or administrators, does hereby covenant, promise and agree to and with said party of the second part, that at the delivery of these presents she is lawfully seized in her own right, of an absolute and indefeasible estate of inheritance, in fee simple, of and in all and singular the above granted and described premises, with the appurtenances; that the same are free, clear, discharged and unencumbered, of and from all former and other grants, titles, charges, estates, judgments, taxes, assessments, and incumbrances, of what nature or kind soever: and that she will warrant and forever defend the same unto said party of the second part his heirs and assigns, against said parties of the first part her heirs, and all and every person or persons whomsoever, lawfully claiming or to claim the same. In Witness Whereof, The said party of the first part has hereunto set her hand the day and year first above written. Ellen J. SUMMERS State of Kansas, Mitchell County, ss. BE IT REMEMBERED, That on this 16” day of Oct A.D. 1905, before me, the undersigned, a Notary Public in and for the County and State aforesaid, came Ellen J. SUMMERS a widow who is personally known to me to be the same person who executed the within instrument of writing, and such person duly acknowledged the execution of the same.
