From John T. & Olive MCCRACKEN to Charles J. BROWN FILED FOR RECORD the 8” day of August A.D. 1888 at 4 o’clock P.M. J. W. BARTLESON Register of Deeds. This Indenture, Made this 8” day of Aug., A.D. 1888, between John T. MCCRACKEN and Olive MCCRACKEN his wife of Mitchell County, in the State of Kans, of the first part, and Charles J. BROWN of Mitchell County, in the State of Kansas, of the second part, WITNESSETH: That the said parties of the first part, in consideration of the sum of Six Hundred Fifty-five DOLLARS, the receipt of which is hereby acknowledged, do by these presents grant, bargain, sell and convey, unto said party of the second part, his heirs and assigns, all the following-described real estate, situated in the County of Mitchell and State of Kansas, to wit: Lot No. Fifteen (15) Block No. Four (4) Elliotts Addition to Beloit Kansas TO HAVE AND TO HOLD THE SAME, Together with all and singular the tenements, hereditaments, and appurtenances thereunto belonging, or an anywise appertaining, forever: And said John T. MCCRACKEN for himself, heirs, executors, or administrators, does hereby covenant, promise, and agree, to and with said party of the second part, that at the delivery of these presents that he lawfully seized in his own right, of an absolute and indefeasible estate of inheritance, in fee simple, of and in all and singular the above-granted and described premises, with the appurtenances; that the same are free, clear, discharged, and unencumbered of and from all former and other grants, titles, charges, estates, judgments, taxes assessments and incumbrances, of what nature or kind soever; and that he will warrant and forever defend the same unto said party of the second part, his heirs and assigns, against said party of the first part, his heirs, and all and very person or persons whomsoever lawf! ully claiming or to claim the same. IN WITNESS WHEREOF, The said parties of the first part have hereunto set their hand the day and year first above written. John T. MCCRACKEN Olive MCCRACKEN State of Kansas, Mitchell County, ss. BE IT REMEMBERED: That on this 8th day of August, A.D. 1888, before me, the undersigned, a Notary Public in and for the County and State aforesaid, came John T. MCCRACKEN and Olive MCCRACKEN his wife who are personally known to me to be the same person who executed the within instrument of writing, and such person have duly acknowledged the execution of the same.
