Duplin County, NC - Court Records File contributed for use in USGenWeb Archives by Grace Williamson Turner Transcribed and posted by Sloan Spence Mason <[email protected]> PETITION OF ABRAM KORNEGAY OF DUPLIN CO., N.C. Transcribed by Sloan Mason Petition of Abram KORNEGAY of Duplin Co., N.C.-9 Dec. 1841 To His Excellency John M. MOREHEAD, Gov'r. The petition of the undersigned citizens of the County of Duplin, humbly complaining, sheweth unto your Excellency that at the Fall Term of the Superior Court last for this County, Abram KORNEGAY was tried & found guilty of an assault & battery upon Lewis OUTLAW, the jury finding upon the evidence of the Prosecutor only; and that upon the said finding, the Court sentenced the Defendant to an imprisonment for six months, about half of which time has expired. Your Petitioners represents that Abram KORNEGAY has been addicted to intemperance, and when intoxicated is a man of some violence, but where there is now every appearance of reformation on this subject, and his behavior mild and peaceable as it always has been when sober. Your Petitioners further represents that the assault was committed under high party excitement; at a political meeting where this Defendant & Prosecutor were in attendance and differing on the subject of Candidates ---, they both indulged freely with intoxicating liquors till they became drunk, when in a fight between the parties the Defendant used his knife. Your Petitioners further represents that KORNEGAY is a man of very respectable parentage, and (except his intemperance) has sustained a good character through life; he has a large family of children, who are dependant for support upon the exertions of this Defendant, and that his wife at the present moment really needs his attentions and services at home. In consideration of all the premises, your Petitioners pray your Excellency to interpose in behalf of this unfortunate prisoner, and grant him a pardon for the remainder of the imprisonment that he may return to his Family a reformed man when and where he may afford them that protection & attention that a fond parent is wont to administer. Your Petitioners further represent, that they are conscious they represent the voice of the County in making this appeal, and again pray your Excellency for your Clemency in this behalf, and as in duty bound will ever pray. 9th Dec'r. 1841 B. KENNEDY T.S.? WILLIAMS H. SULLIVAN J. G.? MIDDLETON Jacob KENAN Petition for Abram KORNEGAY of the county of Duplin Prayer and Granted His Exclsy. John M. MOREHEAD, Esqr., Raleigh, N.C. Duplin Co., N.C.-29th Nov. 1841 His Excellency John M. MOREHEAD, Esqr. Dear Sir, AT the request of an unfortunate Suffer, I take the liberty to address you in his behalf-At the last term of our Superior court Abram KORNEGAY of this County was tried on an Indictment and found guilty of an assault upon Lewis OUTLAW, Jun'r. And the evidence of the prosecutor (he being the only witness) proved the assault of such a violent character that the Judge presiding sentenced him to an imprisonment for six months. I was in Court during the trial and agree that the Court (from the evidence) was altogether consistent; but considering all the circumstances connected with the transaction, there is something of a mitigating character which I beg leave to call to the attention of your Excellency. First, the Prisoner is the Son of one of our most respectable Citizens, and (except when wrought upon by Spirituous liquors, as he sometimes unfortunately is) he himself is a peaceable good citizen. Second, he is a very poor man with a large family of children dependent upon his labor for their support, and his wife now in a delicate situation requiring his attentions at home. Third, the assault was provoked by the Prosecutor at a politics meeting of the Whigs in May 1840. At this time the Whigs of the county had a public meeting at the County seat, and Sunday resolutions introduced and adopted for the advancement of their cause; the Defendant being one of the body showed some considerable gratification at the prospects, and soon after the meeting adjourned was insulted by the Prosecutor (he being a Loco Foco) when a fight ensued & the Prosecutor bit the Prisoner on one of his Fingers & in jerking his finger from the mouth of the Prosecutor, drew one of his teeth also; for which Prosecutor was heard to say he would have satisfaction. It is believed by many that the Prosecutor pursued the Prisoner for this Satisfaction, & the prisoner used his knife in self defense. I don't pretend that the Prosecutor would perjure himself willingly, but I was present at the meeting where the fight first commenced, and left about an hour before the cut was given; & when I left he Prosecutor was quite drunk; I understand from respectable Gentlemen that he continued to drink till he left the Village and if so, he was not by any means a Competent witness. The Prisoner is a man of intemperate habits (till since his confinement) and when drinking is rather violent, but when sober very peaceable. He regrets his former course, I think really, & so much is he resolved on reformation that he has besought me to write to your Excellency asking a pardon from the imprisonment so long as he refrains from drink. I take the liberty to say Sir, if he could be reformed by your interference much would be done for his family and I think the purposes of justice answered to the full. The history I have given of the Prisoner is of my own knowledge, he having lived near me all his life. >From the whole of the circumstances mentioned if your Excellency will remit the remainder of the imprisonment, I take the responsibility of saying that you would meet the wishes of a large portion of the respectable citizens of the County. I hope I will not be considered presumptuous in making this appeal, I do it from a firm conviction that your clemency in behalf of KORNEGAY will be productive of good; remember he is very willing to be pardoned on the condition he refrains from drink; and if he indulges again to be remanded to prison immediately; & remain the balance of the time. Should you think with me in this matter, please enclose your communication to Isaac B. KELLY, Esqr., Postmaster at Kenansville, N.C. I have the honor to be your Obedient Servant, Jere PEARSALL N.B. At the request of several Gentlemen, I have penned an imperfect petition, which will be signed, & accompany this. J. P. Richard, I am a KORNEGAY descendant of William Kornegay via two of his children: Zilphia Kornegay m. Captain James Outlaw >>>>Nancy Ann Outlaw later generation David Kornegay m. a Grady I believe. and from David's line Frances Ann Kornegay married Blaney Williams who was b. 1828 >>>>>James Cicero Williams Nancy Ann Outlaw and James Cicero Williams m. in 1873 I am trying to establish who Blaney Williams parents were: Some suggest Blaney Williams who was b. 1787 d. 1852. If this is the case there would have been a first wife. Some have suggested that Blaney Williams had a daughter, Caroline and Blaney. My Blaney Williams would have been 11 years old when Blaney Williams ca. 1787 married Mary Jane Draughon. Her will did not mentioned a Blaney Williams, Jr nor did Blaney Williams mention a Blaney Williams Jr. in his will. Hargett Kornegay and Alexander O'Grady were the executors of his will. Blaney Williams (my ancestor) 2nd wife was Mary Catherine KORNEGAY m. 1856 Blaney Williams divorced Frances Ann in Wayne County Court in Spring of 1856. He married Mary Catherine April 10, 1856. I think the DNA is the best way to either confirm or disprove who our KORNEGAYs are. There has also benn a suggestion of the name deriving from KOENIG which translates to mean KING in Germany. Thank you for sharing and if you can help to find who Blaney's parents were I would appreciate it very much. Godwin is in Cumberland County along U.S. Highway 301 - about eight miles south of Dunn, which is in Harnett County. Claud and Laura actually lived about two miles south of Godwin. One of their grandsons still lives in a house on the same site that their house was on, about 100 yards off U.S. 301. The parents of James Claudius Williams (known as Claud) were John Williams (1830-1892) and Caroline Royal Chesnutt (1832-1917), natives of Dismal Township, Sampson County, who moved from that area to the aforementioned property soon in the early 1850s. The property was then owned by John's father, John Carouth Williams (1808-1896) of Dismal Township. An interesting side note that I wonder if the Kornegays are aware of. I already mentioned that my grandfather, Robert Wesley Williams, was a son of Claud and Laura (Kornegay) Williams. Claud and Laura's oldest son, David Marshall Williams (1900-1975), known as Carbine Williams, was one of the designers of the M1 Carbine used by the U.S. Army during World War II. The DNA test might be a good idea. We would need a male Kornegay and a male Gnagi to compare Y-chromosomes. But it would be best to get an idea of what area our Kornegay/Gnagi ancestor came from first. I don't know how common a name Gnagi is, but we can't assume that all of them are related. Thanks for the cordial welcome to the list. I look forward to more communication with all of you. Research by Hank Jones, a fellow of the American Society of Genealogists, has demonstrated that John George Hornigh, who arrived in England in 1709, was NOT the founder of the Kornegay family in North Carolina. He was listed among the 1709 arrivals in England as age 38 with his wife (age not given), two daughters (ages 12 and 10) and two sons (ages 8 and 2). Much has been published stating that this family that came to North Carolina in 1710 and that all of them except the eight year old son (said to be George Kornegay) were massacred by the Tuscarora Indians. Jones's research, however, published in his 1990 book THE PALATINE FAMILIES OF IRELAND has shown that John George Hornigh and his family settled in County Wexford, Ireland, where they became quite prominent. This family's name was most often spelled there as Hornick. Jones is currently working on another three-volume set of books that will include much information about the Palatine and Swiss settlers of eastern North Carolina. The section dealing with North Carolina is being prepared by Lew Rohrbach, another accomplished researcher. They have NOT found the European home of the Kornegay family, but the book, which will be published next year, will include information about them in America and also other German and Swiss families of the New Bern area, some of whose European homes have been identified. I will notify this list when these books are available. Given that we can now rule out John George Hornigh as the founder of the Kornegay family in North Carolina, I think that the most likely origin of the Kornegay surname is the Swiss name “Gnagi.” This possibility was first suggested to me in the late 1980s by the late Dan Fagg of Batesville, Arkansas. It fits well with the earliest spellings of George Kornegay’s name in Craven County records. The documents assigning him to the care of Jacob Miller spell his name as “Knege” and “Kneegee”. In German, the “G” and “K” sounds are much more similar than they are in English, so it is easy to imagine “Gnagi” evolving into “Knege” when English speakers heard the name spoken by German speakers. Later spellings such as “Kenege” and “Connegue” would also have a similar sound. To the best of my knowledge, the “Kornegay” spelling does not appear in any documents until the 1760s, late in the first George’s life. It is worth noting that no “r” in the first syllable of the earlier spellings. It is true that no one named “Gnagi” has been found in the lists of Germans that arrived in England in 1709. But not all of the 1710 immigrants who settled in the New Bern area had passed through England. A large contingent came directly from Switzerland with Baron Christoph DeGraffenried. It is possible that this group included a child named George Gnagi, who would be orphaned within the year and then placed under the guardianship of Jacob Miller. Once Jones and Rohrbach’s new books are available, it will be worthwhile to check the records of the European homes of other New Bern area settlers for the origins of the Kornegay family.
