(1773-1840) Will of Samuel Kinkead In the name of God, amen, I Samuel Kinkead being weak in body and considering the uncertainty of mortal life but of sound mind & memory, blessed be almighty God for the same, do make this my last will & testament in the manner & form as follows. 1st I give and bequeath unto my grandson Robert Kinkead (Robert's son) fifty acres of land off the northeast corner of the tract of land I now reside on bounded by lands of Kelly McLaughlin when he shall have arrived at the age of twenty-one years or the value of said fifty acres to be paid to him at the time as my two sons John and James may choose either to pay him the money or give him the land. 2nd I do also give and bequeath unto my son John Kinkead one hundred & fifty acres of land off the southeast part of the tract I now reside on to include all his improvements where he now resides 3rd I do also give & bequeath unto my son James Kinkead one hundred & fifty acres of land off the northwest part of the tract of land I now live on, joining lands of Martin George & Alexander Craig. 4th It is also my will that my said sons John & James shall have the balance of the tract whatever that may be after the already bequeathed three hundred & fifty acres to be laid off equally between them, the meadow over the road to be in John's part, also the whole to be divided as fairly as possible according to quantity and quality like wise. I give & bequeath to my sons James & John all my personal property consisting of farming utensils, household furniture & stock with the exception of what I shall afterwards leave to my wife Sarah. 5th I give & bequeath to my grandson Samuel (James' son) my young three year old horse. 6th I give & bequeath to my grandson Samuel (John's son) a saddle & bridle. 7th I give & bequeath to my wife Sarah the use of my mansion house with the full privileges of the same together with the kitchen & household furniture, beds & bedding, during her natural life at her decease to have the disposal of as her rightful property her beds, bureaus, kitchen furniture, also such things as she brought with her together with the spring, spring house & garden. I also bequeath her one cow & six sheep to be kept by my sons James & John together with a comfortable maintenance of living to be given her by my said sons, equally. In case of difficulty in relation to what her living should be, it is my will that that be decided by two judicious neighbors, one to be chosen by my sons & the other to be chosen by my wife. She to remain on the premises or in case she does not, to lose all right to the whole. I also allow her the use of a horse when she requires it to go preaching or see a friend. In relation to the instrument or obligation upon John Fowler of Parker Township it is my will that my executor to be afterwards appointed shall take legal proceedings to recover the same with its legal interest. My wife to have as much fruit as is necessary for her own use, my son John to have the one half of the fruit orchard. Lastly, I do hereby appoint my two sons John & James the executors of this my last will & testament. I do hereby revoke all former wills either made by me or known to be made for my by any other person. In testimony hereof I have hereunto set my hand & seal this 23rd day of March 1840.
