The only problem is that there is no crime. The Justice Department is struggling to find a way to charge him with anything. Sharing news is not a crime, otherwise the NY Times would have to be charged again as well for passing the leaks along to the public. The courts acquitted them for publishing the Pentagon papers during the Vietnam war. Not a crime. In the current case, it's also hard to find a crime victim, since no one has ever pointed out anyone who was damaged beyond being embarrassed about what was thought to be confidential communication. There are a lot of other crimes out there, including ones being covered up by official secrecy, but that's another story. As with everyone's ordinary emails, government officials will now have to be more careful about what they say when they think it can be kept secret from the American people.
