This subject is closed -- everyone must realize by now that this is indeed a legitimate VA bill and if they are interested in knowing more then they should go to the VA state website and discover more for themselves. Additionally, there will not be at any time or for any reason any political discussions, opinions or statements. This is a genealogy list for the discussion of Jones genealogy, only. I let the discussion re: VA bill go on longer than I should have because I know it is of genealogical interest to everyone. But at this point it stops, now. Also, please when responding to a long posting delete most if not all of the previous posting. The emails end up being huge especially for the digest listmembers. By no means.. I watched them work their magic in Northern France in the 80's. I am amazed at how much they have recorded. I think.. I am not certain.. That there are personal items that people have contributed to the Family History Archives in Utah. They might be willing to store these documents. I speak for no organization or group. I am just "thinking out loud" as one might say. I fear that the documents will be destroyed and data lost for ever. It is nice to have a copy.. but priceless to a family member to see, feel, and touch the original that was held by an ancestor. I speak from experience here... I urge everyone to email the legislators until they hear from them. I will and do quite often.... Hello list, I received about 40 messages concerning the above bill. I looked at the Va. Senate Amendments dated 2/4/2003. It States: All case files ended prior to Jan. 1, 1913 shall be permanently maintained in hardcopy form, either in the locality served by the circuit court where such files originated or in The Library of Va. in accordance with the provisions of 42.1-83 and 42.1-86. The following records for cases ending on or after Jan. 1, 1913 may be destroyed in thier entirety at the discretion of the clerk of each circuit court after having been retained for 10 years after conclusion. To me it seems that records before Jan. 1, 1913 are safe. So, it seems provisions for records dated after Jan. 1, 1913 are the records to be concerned about. Ed Jones

Jean, You wouldnt happen to be related to a William Joseph PAYTON. He married Lizzie Walstrum on 23 Oct 1905.. Now I always thought he was the son of Joseph A. Peyton/Payton and Katie Regina Ferguson. This is also what I have been told. But I have 2 certificate of births for this couple. One is for Joseph Peyton born 24Apr1897 and one for a Male child Peyton born 09Aug 1902 Now both of these certificates are children # 1 & # 3 and on both Katie is 18 yrs old. Joseph is 29 and the 34 yrs old. Now if William Joseph PAYTON was 24 when he married An 18 yr old Lizzie WALSTRUM. THey actually lived only a few blocks from each other too. Katie and husband lived at 907 Clayton Street in Wilmington, De and Lizze and husband lived at 932 Scott Street, Wilmington, De.Less than 3 blocks away, so was Katie Regina really a cousin, named after William's mother and he still had a mother with the same name. If so, I cant find her yet. Peyton/Payton is frequently spelled by ways. I grew up knowing it as Payton. Hoping you can shed some light on this and maybe have some family history that will connect and these folks or separate them, whatever it should be. By the way the Jones connection to the Paytons is that my Grandmother Mary Payton Jones is the daughter of William Joseph PAYTON and Lizzie WALSTRUM (Lizzie is Elizabeth Ann). Mary PAYTON married Archie James Jones. (another brick wall and Mystery!). Lizzie also married again, Im assuming after William's death to Howard/Halwood DEMMY. Thanks Take care. The Church of Jesus Christ of Latter-day Saints (LDS) is always filming any and all documents it is allowed to. There are volumes of documents and few to do the work. I will send a copy to SLC Gamily History Dept for them to review... Jean and all, Thanks so much for locating the correct URL. I was having some computer problems and finally got it fixed. I deeply appreciate everyone's efforts. On another list I belong to, I was warned by the list owner my posting was improper. I was able to locate my ancestors will from 1759 in Virginia and sent for a copy. It was not free and I gladly paid what they asked. The state did not give me anything and if they no longer want it I will gladly purchase orginal. At least give me the option. Thanks again. Patti
Rhonda, I know what your referring to when you say tons of emails. There has been a situation where a "group" was instructed to send emails to alot of people in a large corporation. The group sent a virus to every person they emailed. Because the original "plee to send" had a virus attached, (on purpose). In this case though........I had heard that this distruction of historical documents was coming. I think this one is real. Deb
If the Bill passes it will give County Clerks in the State of Virginia to destroy all Wills before 1913. These Wills are a very important part of our History and Heritage. We as genealogists should speak up and to let these Government people realize just what they are doing because the County clerks lack Storage space. They could at least donate them to a Genealogy Society so that they may be preserved and also be transcribed onto the internet for the world to have access to them. That is what we are trying to stop from doing. Its fine to microfilm them but to destroy the originals would be a very costly mistake. The State of Virginia by allowing this destruction to happen is destroying a very important historical documents that date back to the 1600s when people first started to arrive in the New World. What I don't understand is why they won't donate them to the historical Society, Library of Virginia, or to other Genealogical Societies. Simply the lack of storage is a very poor excuse for destroyng these documents. Massachusetts has just as much historical papers and they haven't threatened to destroy for lack of space. Microfilming them is not always a cost effective way of retaining these histroical documents. When they are microfilmed people who do this often make mistakes. They don't photograph them properly, they miss pages, and sometimes destroy the whole document in the process. Look at some of the Census records we have. Some of them you can't read from the microfilm, some of them have black splotches on their lens which transfer to the films. Historic Wills that date back 400 yrs are hard to read in the immediate copy. If they are hard to read in their original state microfiming will just make it harder to read. If we the people let these States do these things because they lack space we stand to lose a very important part of our history and heritage. Our ancestors when writing their last testant and will wrote them with the idea of protecting their families and heirs and leaving a piece of history when they were gone. It is just the State of Virginia, but there is the State of Florida who want to do away with their State Library which houses all of their important and historical documents, The state of Washington is another state who wants to do away with their historical documentation. We are the family researchers must ban together and let our government know that these are precious records that should be retained for ever not thrown away because they lack storage. The least they could do is to offer them to the Genealogical Societues or have them transcribed and put online for the world to see. One prime example of retaining these documents is to be able to prove who were the heirs. I was trying to connect my Spencer line and I was missing the name of one son. When I thought I had the rright father I was told that he didn't have a son named John. Well when I found the will in New York he indeed did have a son John which connected my line from the First Spencers to come to the New Wolrd. Without that will I would have been still looking for the connection. So yes we all need to let the Senators, Delegates, Congressman, and our President know that these papers are very important to all of the people of the United States not just that state. We need to make sure they retain these copies. I don't understand how they can lack for storage space nor the money to fund these records when they can vote themselve huge wage increases as they did this past year and then complain they don't have the money to continue restoration or continue to keep these documents available to the World. Is the reason money or privacy? All TX county courthouses now don't allow open records to military separation records. Seems that if you separate from the US military, that was an open record. I don't know if just family can see them. That is now law. I needed a divorce for my paternal gmother. Found that they divorced in 1925. After spending lots of time starting in 1920, I found the date. Then they told me microfilm#. They charge 25c a page to copy, 50c+ for a certified copy. Thanks, I read what the summary was. Appreciate you giving me the directions. Does that mean that as long as the wills are microfilmed then they can be destroyed -- like it says in the last line?
