Greetings to all Listers! As some of you may know I have several pictures of Co. Carlow tombstones at my website (see http://www.nolanfamilies.org/gallery/index.php?cat=16 for Memorials section), predominantly for deceased Nolans. I have now recently received a request from a relative to remove a particular tombstone picture. The question therefore arises as to the legality and practice of posting pictures of tombstones to the Internet. I did a Google search in the hope of finding some guidance as to what the current practice/law might be for Co. Carlow but I could only find someting for Canada and the United States (see text at end of this note). In essence, the guidance offered states that “there is no legal requirement that a family consent” but that one should “pull a photo, if requested”. Of the tombstones photographed, many were weathered and hard to decipher. It would be a shame to limit the dissemination of such information , let alone the memory of those deceased, to only those able to visit the cemetery in person. I would appreciate any comments as regards accepted practice or legal requirements *** in Co. CARLOW *** for photographing tombstones and posting pictures of them to the Internet. Thank You all, Roger http://nolanfamilies.org ************************************************************** Reference: LEGAL OPINION for Canada and the United States ************************************************************** Excerpt from Blog posting at http://www.legalgenealogist.com/blog/2012/10/22/cemetery-photos-permission-required/ Judy G. Russell says: October 22, 2012 at 10:41 am Russ, there’s no legal requirement that a family consent to having its loved one’s tombstone photo placed online. It’s not an invasion of privacy, though people often think it is. However, if the family truly objects, I can’t imagine why you wouldn’t agree to take the image down as a matter of courtesy. You can still supply the image to any family member who wants it while not offending those who are deeply troubled by having such information online. This whole business of having so much information available online is new to us all, and while the law is pretty clear, the protocols and courtesies involved are still developing, and I think we all need to be mindful that many people are truly unhappy with what they perceive as a loss of privacy in this online world and as a discourtesy to living and dead alike. Reply -------- Russ Worthington says: October 22, 2012 at 7:17 pm Judy, Thank you very much. I was hoping that was your answer. I certainly would pull a photo, if requested and I have even sent my photos to family when requested. I have also found some relationship’s in Find-A-Grave that may not be clear in other online repositories. A couple of Obituaries as well, they point to the actual newspaper for that obituary. Hi Michael, I traced the marriage of my great-grandfather, Patrick Reddy to Mary O"Neill or Neill in Carlow Cathedral in 1870/80s. (Don't have cert to hand at moment). He was a baker in Carlow town & died of "baker's lung" about 1889/90. Before taking up the bakery trade, I understand he was a tenant farmer on the Brownes Hill estate & was evicted. Do you know if any Brownes Hill estate records re tenants are available? And where? Or any newspaper or other records of evictions? I searched the Cathedral microfilm baptismal records in the National Library without success. If he was born on the B. Hill estate, what Catholic parish was that at the time? Prob the cathedral parish? I know B. Hill was in the civil parish of Clonmelsh/Clonmelch & part of Chapelstown DED. He was prob born before 1863 or 64 when Civil Registration came in. Any advice/info you can give me how to trace his DOB and which bakery shop he worked in, greatly appreciated. Also his date of death c. late 1880s, as I don't have that. I have DOBs for his children. Hello I have checked St. Mary's records for you. Both the James and Anne Sunderland which show up in the records, don't match age and date of births unfortunately. There is an Anne died aged 16, 26/06/1904 and a James died aged 63, 06/02/1929. Must be another cemetery? I am a member of the Hadden family and am currently researching the Haddens and Banks families in Wexford and Carlow. Both families were in the drapery business from the mid-1800s and were related through marriage. George and Frances Jane (Banks) Hadden started the family drapery business in Wexford in 1848, although I believe they took over a business formerly known as Banks & Fitzhenry. The Hadden drapery business opened a store in Dungarvan in 1906 and in Carlow in 1909. The Banks family also had drapery businesses in Kilkenny and Carlow. Any information, photos or memorabilia, particularly from the drapery perspective, would be very welcome. ------------------------------ To contact the IRL-CARLOW list administrator, send an email to IRL-CARLOW-admin@rootsweb.com. It’s all to do with ‘The Rose of Tralee’ lately and Carlow man Harry Hynes ( whose grandparents owned Hynes's shop at the Shamrock Square ) a former London based business entrepreneur now settled in Tralee with his wife Catherine is hosting a special ‘Gathering’ in The Greyhound Bar on Saturday at 3.00pm. The event is in honour of Grace Kenny, The London Rose of Tralee 2013 and all her London, Crawley and Carlow supporters are invited. The Rahanna Marching Band down from Carlow will also be there. I attach a piece from Kerry’s Eye newspaperGrace was born and bred in Crawley near Gatwick Airport in West Sussex. Her late father Martin was born on the Dublin Rd in Tullow and emigrated with his parents and 7 other brothers and sisters to the UK in the early 60's. She grew up in Crawley to appreciate all things Irish and is a great Irish dancer and was part of the Celtic Coleens dance troupe that got to the semi finals of Britain's got talent a few years ago. Crawley's Celtic and Irish Cultural Society nominated and sponsored her to take part in the London Rose selection night and she won that. She got through also in the regional qualifiers in Portlaoise a few months back and now is one of the final 32 we'll see with Daithi O'Sé on RTE on Monday and Tuesday night. She was back in Carlow last weekend to catch up on her heritage and there are some great pictures of her in this weeks Carlow Nationalist and Carlow People newspaper. A song 'Journey Back Home' by Paul Stanworth a singer songwriter from Bradford but based in Crawley wrote the song following her success in London.
