    3. Thank you very much for this, Brian.  The Lummaxes in Canada are indeed recorded as Protestant, but I think at that time with the way Catholics were treated it was not unheard of to have people 'change' religion, and it's interesting that the same  Christian names are coming up ie John and Thomas and Mary.  My ancestor called his children John, Mary Ann and Elizabeth, (his wife was called variously Maria and Ann) and there is a Thomas, Johns and Ann among the Canadian Lummaxes.  I don't think the different spelling is important as on the Canadian shipping list the name is spelt as Lummocks.  I shall try again to see if I can get access to the Fenagh Protestant church records...   Regards,   Hilary From: "[email protected]" <[email protected]> To: [email protected] Sent: Monday, 20 August 2012, 8:00 Subject: IRL-CARLOW Digest, Vol 7, Issue 382 When replying to a message please don't forget to delete all messages not related to your message & change the subject box. Tom Reed New Castle, DE USA --------------------------------------- Original E-mail >From : Mary [[email protected]] Date : 08/16/2012 06:02 AM To : [email protected] Subject : [IRL-CARLOW] seeking help Hello, Your e-mail address has been given to me by Turtle Bunbury - he thinks you may be able to help me . In doing my family history I have established that my great grandmother came from Rathvilly Co. Carlow. I have this information from the 1901 census. Her maiden name was Catherine Byrne and she became the wife of my great grandfather, Joseph Dunne. He was a school teacher in Aughnahila and died in 1876 at the age of 47. In 1901 census she was a widow, a retired teacher, living with her unmarried daughter Annie in Aughnahily, Kilcolmanbane, Co. Laois. Catherine died in 1905, in Aughnahila but again, cemetery records are not good but I presume she is buried in the Heath with Joseph. Joseph and Catherine had 6 (or 7 ) children namely: 1853 - Annie born Rathvilly Co. Wicklow(?) - as per 1901 census. 1856 - Mary born Portlaoise Co. Laois 1858 - John born Portlaoise 1861 - Joseph born Portlaoise 1864 - Michael born Portlaoise (my grandfather) 1866 - Thomas born Portlaoise 1870 - Gregory born Portlaoise In my search in the National Library archives of Rathvilly I also found a Catherine born 1853 but I have been unable to establish if Annie and Catherine were twins or if that child was Catherine Anne (known as Annie). Annie lived to old age, with her brother Joseph and family in Kildare town. I have found a Catherine Byrne born 1825 in Rathvilly to Gregory Byrne and Catherine Hanrick. I cannot prove that these are Catherine's parents but with the unusual name Gregory I am taking a leap of faith assuming they are the correct family and that I have the right Catherine Byrne. My problem is this: I cannot find any marriage certificate for Joseph Dunne and Catherine Byrne. As their first child was born in Rathvilly (but I have noted the different counties on the 1901 census) it would appear natural that they were living there and perhaps married there. Then again I wonder did they meet there as teachers but I also have no idea where Joseph came from. We also assumed the Dunnes were from Laois but I have done a lot of research into the Laois archives, with no success in finding a Joseph born c 1830. Would he have been from Rathvilly? As there are no Carlow records on-line I have been unable to research this. Turtle suggested I give you all the details I have and that you may be able to help me with a marriage certificate for Joseph and Catherine. That would confirm her father's name and his father's name for me - then perhaps I would have more success in tracing Joseph's line - if you cannot help with a birth/baptismal certificate. I would appreciate any help you can give me and I would be quite happy to travel to Rathvilly/Carlow or wherever the records are available to be accessed. I find trying to read the films in the National Library very difficult. There are so many stories relating to Carlow. www.bureauofmilitaryhistory.ie Try cross checking name places, family names and incidents. Thousands of statements are now available to read. Statements are across the board, from pro treaty to anti treaty, 1913 through World War One, 1916, War of Independence, and the Civil War. Well worth checking out.

    1. [IRL-CARLOW] Carlow Court 1846.
    2. Friend of Carlow
    3. Transcribed by Selina Lawlor. Pat Purcell Papers. Carlow Sentinel. Report of case tried at Petty Sessions in Carlow Courthouse, October 1846, before Mr Duckett, Resident Magistrate. A DELICATE INVESTIGATION. Betty Murphy, a woman far advanced in years, summoned Bridget Bigley for the committal of a serious assault on Friday last, by which she suffered serious injury. Betty Murphy stated that the assault was entirely unprovoked, Bridget Bigley having unexpectedly attacked her in the public streets. Addressing the Court, Mrs Bigley (a comely looking woman) - Your worships I suppose I will be heard. I found that woman in the house with my husband, and I trashed her (laughter). - She is a terrible character. Mr Burgess stated - In this case - a serious one (laughter) - I am engaged by the defendant, who claims that she is the aggrieved party. Mrs Begley - "I'll tell your worships the case. Betty Murphy has taken up with my husband. I watched her, and I saw her taking my place in the bed with him (roars of laughter). Betty Murphy was cross-examined by Mr Burgess. I am not a married woman now; I was married, but my husband is dead. Mr Burgess was about to proceed to put other questions, when the Judge stated that the witness need not answer if she thought proper. Mrs Bigley - Is there no justice for married women (laughter). There's a woman who has deluded no less, your worship (addressing the Judge), than six men (great laughter). It's the truth, and the bishop and clergy can vouch for it; for her conduct has been brought under their notice. Is that woman to take my place, and to delude my husband? (laughter). Mr Duckett - It is a very delicate question (laughter). Mr Burgess - Well, I will put an end to the discussion by calling on the husband; then you will perceive whether Mrs Bigley was the aggrieved party. True, she committed the assault, but she got great provocation (laughter). Mrs Bigley - "True for you, I did; but that woman (pointing to Betty Murphy) must be taught a lesson" (great laughter). Richard Bigley was then called, and, as the subject of the dispute, it is necessary to observe, that he was anything but a personification of an ADONIS; his appearance in the witness box to settle the dispute between the ladies excited great laughter. On being sworn, he was examined by Mr Burgess. Mr Burgess - Now, as an honest man, I ask you, on your oath, so far as regards Betty Murphy, had your wife any cause to be jealous of you? The witness hesitated. Mr Burgess-Tell the truth, man. Witness - Well, if I must, I will. I think she had (roars of laughter). Mr Duckett - I think the case is of too delicate a nature to inquire further (laughter). The Bench dismissed the case. Mrs Bigley - I thank your worship for your proper decision (laughter). Betty Murphy, on retiring from the court, was followed by a crowd, principally of women, and hooted through the town, and but for the constabulary she would be roughly handled by the fair sex, who took a deep interest in the injuries inflicted by Mrs Bigley.
