    2. Thomas BYRNES, son of Dennis and the late Anna McNAMARA BYRNES and husband of Hannah McHUGH BYRNES, died at his home, 479 Prospect place. He was born in Tulla, County Clare, Ireland and had been a resident of Brooklyn for twenty-five years. He was a parishioner of the Church of St. Teresa, Classon avenue and Sterling place, where requiem mass will be celebrated at 8:30 A.M. Saturday. He is survived in addition to his father and his widow by one son Thomas BYRNES; three brothers, Timothy and Dennis, both of Ireland, and John, of Brooklyn, and three sisters, Margaret CLUNE, Mary BYRNES and Anna KEATEN. He was employed by the Metropolitan Life Insurance Company for twenty years. Interment will be at Holy Cross Cemetery under direction of John J. FLOOD, 254 Hoyt street.

    3. Hi dayne, In the 1920 Census for the State of New York, there are 3 Augustus Burns listed. The first is 58 and living in Albany with a sister Mary who is 70. He is a white male , born in New York, working as a chef in a hospital. They live on Hudson Ave. The second is a black male,40, born in the British West Indies, living in Manhattan.     3. Would someone who has access to Ancestry.com check for an Augustus BURNS. I have him as a member of the James BURNS/Sara BURNS household in the 1880 Census in NYC about 20 years old. Looking for him either earlier in 1870 as a member of that household or later, possibly married and the HOH. When I ran the name Augustus BURNS in Ancestry it said there were 22 of them in the Census records. In 1920 he would have been about 60 years old. Thank you dayne

    3. Greetings All. I have just been advised that Dr. Ivan Fellegi's appearance before the Senate Committee reviewing Senator Lorna Milne's Bill S-12 has once again been postponed. I am advised that the postponement is a result of further behind-the-scenes activities that may soon (hopefully) result in some announcements regarding public access of Post 1901 Census Records. I have no idea yet what such announcements may contain but the fact that some activity is still happening is encouraging. Postponment of the appearance of Dr. Fellegi, and return of the Bill to the Senate is supposed to be short-term -- perhaps one week. At the request of lawyers working for the Information Commissioner, yesterday I shipped more than 36 pounds of documentation to them. This documentation pertains to my research on access to Post 1901 Census Records. The lawyers are working on a complaint by Professor Bill Waiser because of the denial of Statistics Canada on his Access to Information Request for access to the 1906 Census of the Western Provinces of Canada. Things seem to be happening on a number of different fronts. We will keep you advised on anything that we might learn. What we are seeking, and what we expect to obtain, is access to Post 1901 Census records on the same basis that we currently have for those records up to and including 1901. Happy Hunting. Gordon A. September 1857 transcriptions of the Irish-American have been uploaded to the list website. This includes news, marriages and deaths from Ireland, news and some deaths from New York City, news of Irish/Irish-Americans from around the US and the Information Wanted column. Also uploaded is information pertaining to the Fenian Brotherhood - a brief overview of the group and record information. You can find this on the Newspapers & Other Records page.     2. County of Arrival Records - Naturalization Records Pt. 5 If your ancestor naturalized after 1906, then your search will be easier. In 1906, the federal government stepped in to handle all naturalizations. All naturalizations after this date were processed by the supreme court of the county. Where do you find these records? More than likely, these records are still in the possession of the supreme court. You will need to contact the clerk of the court to request a search. Remember, the clerk of the supreme court is also the clerk of the county court! If your ancestor naturalized prior to 1906, then you have your pick of which court he naturalized in! Immigrants were more likely to naturalize in their local county court. You will need to contact the clerk of the court to request a search. Don't discount the city and federal courts though! How to determine which court before you start making phone calls? The National Archives, LDS and other repositories have a microfilmed index to naturalizations in various NY courts: Index to Naturalization Petitions Filed in Federal, State, and Local Courts in New York, New York, including New York, Kings, Queens, and Richmond Counties, 1792-1906 NARA film group: M1674 NOTE: This index is actually a soundex. You will need the soundex code for your ancestor's surname in order to search.     2. County of Arrival Records - Naturalization Records Pt. 4 Ok - you've searched all the federal and state censuses (if applicable). They have given you a time frame for your ancestor's immigration. You've checked the naturalization laws that pertained to that specific time period. You think you're ready to search all the records. Now what? It's a good idea to have a list of all addresses where your ancestor lived for the time frame for naturalization. Why? Unless you're researching an unusual name, you're going to have a few 'hits'. Considering the sheer number of Irish immigrants into New York City and the boroughs, how many Patrick Kelly's or John Murphy's were there? A lot! Since the petitioner had to give his address, this will help you weed out the wrong hits. So you have a list of addresses for your time frame and occupations gleaned from the censuses, you're ready to go. Now, to determine what court he could have naturalized in! Prior to 1906, an immigrant could naturalize in any court that handled naturalizations. There were quite a few! Here is a general breakdown of the different courts -- and the level they were at -- that processed naturalizations in the New York City area: 1674-1784 Mayor's Court: This was a New York City court that handled all civil matters. 1691-1847 Court of Common Pleas: Located in each city and county, they handled all civil matters. This court was replaced by the county court. In New York City, Common Pleas was abolished in 1895 and replaced by the supreme court. 1691-present Supreme Court: A county level court with jurisdiction over all matters, including naturalizations. The clerk of the county court is also the clerk of the supreme court. 1821-present Circuit Courts: A county level court that handles all civil matters. 1823-1847 Court of Chancery: A state level court that had jurisdiction over all civil matters, including naturalizations. 1847-present County Courts: County level courts for major trials.     3. Greetings All. I have, within the past five minutes, received a fax from the clerk of the Senate Standing Committee on Social Affairs, Science and Technology. This is the committee that is reviewing Senator Lorna Milne's Bill S-12 -- An Act to amend the Statistics Act and the National Archives of Canada Act (census records). The substance of the fax is that the delayed appearance of Dr. Ivan Fellegi, Chief Statistician of Canada, will take place on Wednesday 5 June 2002. The Committee is due to return the Bill to the Senate no later than 6 June 2002. We will look forward to seeing what Dr. Fellegi has to say. The book lists the 3,401 men who have received the US' highest honor - the Congressional Medal of Honor. Many recipients were immigrants and Ireland leads the pack with 258!     2. Country of Arrival Records - Naturalization Records Pt. 3 We talked about the naturalization process and the different federal laws. What about the women, children and veterans? Didn't the same laws apply to them? Actually, these three groups were exceptions to the naturalization laws. Women: From 1790-1922, alien women received 'derivative citizenship.' That means, if her husband naturalized or was native-born, his citizenship was then conferred to her. However, a woman who was a US citizen (naturalized or native-born), could lose her citizenship if she married an alien! Wives are rarely mentioned in naturalization records prior to 1906. Could a woman naturalize on her own? When the Act of March 26, 1790, was repealed in 1795, there was no legal impediment to a woman naturalizing. She was not legally prohibited from doing so. Since women didn't have the right to vote until 1920, they simply weren't encouraged to naturalize, and many courts simply didn't honor her right to become a citizen. The history of women and naturalization is confusing. After 1804, the law focused on the plight of married women. Back then, a woman's nationality was determined by her husband. It was more common in the 1800s for a widow or spinster to naturalize, since it was believed they were more likely to need the protection of the law. Naturalization would allow them to hold property and appear as a 'person' in a court of law. If a woman obtained her citizenship through her husband's naturalization, she was *not* issued a separate certificate. To prove her citizenship, she would have to show her husband's naturalization certificate in conjunction with her marriage license. Many judges were simply unfamiliar with the naturalization laws and would grant citizenship to whomever filed for it -- this included criminals -- even if they didn't fulfill the residency requirements. This explains how some single women were able to naturalize. However, you are more likely to find a Declaration of Intent for a female ancestor and then discover her Petition had been denied. What if the husband filed his Declaration of Intent, but died prior to filing his Petition? By law, the husband's citizenship would then be granted to the widow and any minor children. In 1922, the Married Women's Act (or Cable Act) stated that a woman's nationality could *not* be determined by her husband. It also allowed women to naturalize on their own, regardless of marital status. Children: From 1790-1940, children under the age of 21 were granted derivative citizenship through their fathers. From 1824-1906, minor aliens who lived in the US for 5 years prior to their 23rd birthday, could file both the Declaration of Intent and Petition for Citizenship at the same time. Veterans: A major exception to the naturalization process occurred with Civil War veterans. Following an 1862 law, all honorably discharged Army veterans (of any war) could file their Petition for Citizenship after 1 year's residency in the US. A Declaration of Intent was not deemed necessary. In 1894, this law was expanded to include honorably discharged veterans of the Navy and Marine Corps who had served for 5 years. On May 9, 1918, this law was then expanded to include all aliens serving in World War I. They simply had to file their Petition. The Declaration and US residency requirement was not deemed necessary.
