    3. I too have an interest in Fenians. The brothers John, Thomas and Patrick McCarthy were raised between 1849 and 1866, in Oldham England, which is a suburb of Manchester, and then emigrated to New York and/or NH in the late 1860s. They had been born in Ballindine, County Mayo. In the obituary for Thomas who was killed in a RR crossing accident in 1907 when he was 70 yrs of age, mention was made of his connection with the Fenians, and I quote: "[Thomas McCarthy] was employed in Oldham when the Fenian uprising occurred in Ireland [in 1866-67]. Being a member of the Irish Revolutionary Society, better known as the Fenian Brotherhood, Mr. McCarthy left Oldham and went to Dublin, Ireland, to take charge of a company of 200 men. During this uprising he became a close personal friend of O'Donovan Rosa, who he has since entertained in his home in this city [Nashua, NH.]" Thomas and Margaret Bates McCarthy's daughter, Mary Theresa, was born in Dublin during this period. By 1868, the family appeared in City Directory for Nashua NH. In America, Thomas was very active in the John Boyle O'Reilly literary society and also was a member of the AOH. Thomas McCarthy's brother John is my great grandfather. John and his bride, Ellen Mullin, emigrated to NY in 1863-64. Although John does not appear to have been a Fenian, he had Democratic leanings and perhaps a revolutionary spirit. His only son, my maternal grandfather, born in 1870 in Brooklyn, NY, was named Patrick Henry McCarthy. Family lore had it that the McCarthy Brothers were somehow involved in "police work." I suspect they were not policeman, as my mother surmised, but were the quarry. Any one heard of these names in connection with the Fenian uprising in Ireland? I only know of one newspaper account in Cork which mentions a Thomas McCarthy who was arrested for carrying a pistol. Sheila MacAvoy Block

Two known children are Edward COSTELLO and William COSTELLO b. 1830s, who later emigrated to New York City after 1853. Margaret HIGGINS may have been the sister of Mathew HIGGINS, who married Mary COSTELLO of Claremorris, County Mayo. Mary COSTELLO was the sister of James COSTELLO and Charles COSTELLO, above. Charles COSTELLO's father, his brother, and his nephew Thomas A. COSTELLO owned William Costello and Sons, a large tobacco company founded in 1820 in Galway ..... located in late 1800s at 10 High St. and located early 1900s on Victoria St. in Galway. I do not know if Charles COSTELLO was associated with this company. Charles COSTELLO and Mary HIGGINS both died sometime between 1838-1848.     3. Greetings All. I spent the afternoon the other day in the library of Simon Fraser University going through Orders in Council and Statutes of Canada from 1871 on. I was looking to check out and verify something that I have had in the back of my mind for some time. In trying to justify their stand in refusing access to Post 1901 Census records, one of the major points that StatCan has made is that the difference between the 1906 and later Censuses, and those conducted earlier is that the 1906 Census and Statistics Act gave Instructions to Enumerators, and the clause therein relating to "Secrecy", the "Force of Law". They claim that while Instructions before 1906 had similar clauses relating to confidentiality of information given, those Instructions did not have the "Force of Law". They state this is the reason records up to 1901 are accessible while those after are not. To paraphrase, "They know not of what they speak!". I did not check every book of Orders in Council but every book that I did check had a cover page that stated that Orders in Council, Proclamations and Regulations, and/or Orders of the Governor General in Council have the "Force of Law". In addition, the Orders in Council for 1891 include a paragraph stating, in part; "[Note. -- The Orders in Council, having the force of law passed since Confederation, are now being revised and consolidated. ............]" A Proclamation included in the 1891 Orders in Council directing the taking of the 1891 Census included the following statement: "That the details of information and forms to be used should be as indicated by Schedules thereto appended, and by the instructions and blank forms issued by the Minister of Agriculture for the working thereof. Vide Canada Gazette, Vol. XX!V, p. 1198" A similar Proclamation for 1901 stated: "That the details of information and forms to be used shall be as indicated by the schedules following and by the instructions and blank forms issued by Our Minister of Agriculture for the working thereof. The schedules and forms are published in the Canada Gazette Vide Canada Gazette, vol. xxxiv., p. 1318" For 1906: ".......... the country was divided into census districts, forms and instructions were approved and directions were ordered to be observed, as set forth in full detail in the Canada Gazette of May 21st, 1906. Vide Canada Gazette, vol. xxxix., extra issue dated May 21st, 1906." And for 1911: "9. That the details of information and forms to be used shall be as indicated by the schedules following and by the instructions and blank forms issued by our said Minister of Agriculture for the working thereof. The Schedules and forms are published in the supplements to Canada Gazette, No. 2, July 9, 1910, and No. 5, July 30, 1910." "What is the point of all this?" you might ask. I am not a lawyer, but to me the point should be simple. It seems to me that if Orders in Council have "the force of law", and it is easily proved that they do, then any documents -- such as Instructions to Enumerators -- referred to by those Orders in Council, will have that same "force of law". The clause in the 1906 Census and Statistics Act giving the Instructions to Enumerators the "force of law" was not necessary because the Orders in Council referring to the "instructions and blank forms", having themselves the "force of law", already gave the Instructions that force. If I am correct in this then Dr. Fellegi and Statistics Canada are incorrect in their position that Instructions to Officers and Enumerators of Census prior to 1906 do not have the "force of law". As I have pointed out many times in the past, StatCan is very quick to state that the "Secrecy" clause in the Instructions to Enumerators has the "Force of Law". They willingly ignore other clauses in those same Instructions that state very clearly that records of Census "will have value as a record for historical use", that it "is intended to be a permanent record" and it will be "stored in the Archives of the Dominion". If one clause of those Instructions have the "force of law", then so do all other clauses in those same Instructions. Statistics Canada cannot pick and choose which clauses of the Instructions that they want to have the "force of law". I will be going to the Vancouver Public Library this morning to see what else I can find. I will keep you informed on anything pertinent to our efforts to regain the public access to Historic Census records that we are currently denied by StatCan. Happy Hunting. Gordon A. Now that I have established the DOB for James Hayden (1st child) I feel more confident about finding (a) the marriage record for Edward HAYDEN and Mary HOWE and (b) the birth certs for their 3 daughters. JAMES HAYDEN (1st child) Certificate #175565 of Manhattan dated 1/16/1876 for James Hayden. Address: 317 W. 41st Street, Manhattan. Father Edward "P". Hayden born in Dublin Ireland, 30 (or 31) yrs old. Mother: Mary Howe born in Clarnagh Ireland, 30 yrs old. It is their first child. ** LOOKUP REQUESTS ** Marriage of Edward HAYDEN and Mary HOWE: Probably in 1875 given that first child born January 1876.     3. People are reluctant to give any information to strangers over the phone. We're lucky they don't say "I'm busy" and hang up, as I do to those infernal solicitors who ask how I'm going! When I call people who are possible family, I try to tell more about me and ask nothing about them in the first phone call ..... just give my info and ask if they think they may have a connection of any kind ..... give them my phone number and email address ...... and then follow up with a note referring to the phone call that has my full name and home address written clearly on the envelope ..... I feel that I need to earn trust before people will share, because I know I would expect that of anyone calling me (especially a man!) ..... and so I let them know who and where I am and they can look me over a bit before they open up. But I always make certain they can reach me several ways if they decide they are willing. Once I got a huge envelope with a copy of the whole family tree (from a sister of the person I had called), years and years of her hard work, after a cross-country phone call and a follow-up note! Pedigree chart, family groups sheets, name index, the whole works! So don't give up!     2. Organizations  --  Clan na Gael  Part 6  "Clan na Gael or the Fenian Brotherhood?" Clan na Gael and the Fenian Brotherhood (US branch).  Deeds committed by one are attributed to the other.  The two organizations coexisted for some time.  But there were some differences. Clan na Gael was the largest organization dedicated to Irish freedom.  It was founded and operated in the United States.  They were an open society.  Their mission and deeds were published regularly in Irish-American newspapers.  They were adept at fundraising and operated closely with high-level compatriots in Ireland.  Clan na Gael operated under one charismatic head - John Devoy.  It was the death of Devoy and the realization of an Irish Free State that led to the end of the organization. The Fenian Brotherhood was founded in Ireland and brought to the US.  They were a secret society.  They were somewhat disorganized and not as successful in their actions, i.e., the invasion of Canada, even when they had the backing of the US government.  The Fenians had several different leaders, none very distinguishable.  The organization suffered from years of infighting due to lack of direction.  Many members would 'jump ship' to Clan na Gael.  When the Easter Rebellion came about, the Fenian Brotherhood was on its last legs. Many people were members of both organizations.  Maybe your ancestor started with the Fenians and left to join Clan na Gael.  Or maybe he was loyal to both.  They were two unique organizations with one shared vision.
