Mr. Jacob Woolverton, receiver for the South Bend Soap company, submitted a report by his attorney, Hon. Andrew Anderson, showing that after all debts are paid there is a surplus of assets valued at S2,000. The disposition of this property will depend on the result of the suit for an accounting. In the case of the City of South Bend vs. The South Bend Street Railway company and the South Bend and Mishawaka Street Railway company to recover about $16,000 on account of assessments for street improvements, the defendants have, by their attorneys Hon. Andrew Anderson and Mr. A. L. Brick, filed an answer to the plaintiff's complaint, denying all the allegations therein or that defendants owe the plaintiff anything. The answer further sets forth that the city has assessed the defendant for street improvements and is suing for the same in its complaint, the defendant alleges plaintiff by such assessment acted ultra vires and had no power so to do, and for that reason defendant is not liable for anything to plantiff.
