    3. If the statue says the records are open then the local government agency has no legal right to deny you access to them. Since you are having troubling accessing the records I would contact the Public Access Counselor about the situation. The whole purpose of the office is to provide information and help regarding access to government records and meetings. Their website can be found at http://www.in.gov/pac/ They can provide informal responses to questions. Also there is a formal complaint process.
