Transcribed by Viki Lovell May 2002 Records of Wills, 1816-1923 Volumes A & B Posey County, Indiana Copy of Original made by Indiana Historical Society 1974 LDS Microfilm Number#1428908 Posey County Indiana Will Record A & B, 9th July 1816-4 November 1852 Book A page 14-Will of Joseph French I Joseph French citizen of Posey County Indiana Territory-Revoking all then make this my last Will and Testament in the first place I wish as much of my personal property to be disposed of as will pay all my last debts then I Will the one half of the balance of my personal or moveable property to my beloved wife Rachel French to dispose of at her pleasure the other half and all the balance of my estate including my part of the Lands & Tennaments which my brother Samuel French & myself bought of William Roberson I gave and bequeath to my son John French only reserving so much of the plantation as will by being put into a state of cultivation produce Rachel French my wife a plentiful support during her life time as widowhood, also the use of previledge of the Hughed log house or cabin which she now lives in also the use and previledge of gitting timber of the above named land for building and replacing the houses and fences of her part of the above named plantation and other ____ to be hers during her life time or widowhood then and after that period of time to be and belong to John French my son. Posey County, Indiana-Will Record "1" 1852-1875 LDS Microfilm Number#1428908 Alexander, William page 321 & 322 Stallings, Shadrack page 173 & 174 Stallings, Bery page 192 Stallings, Mahala page 140 Page 140-Will of Mahale Stallings In the name of the benevolent Father of all I Mahale Stallings of the county of Posey and state of Indiana being of lawful age and sound mind do make and publish this my last Will and testament for and in consideration of the Great Love and affection I have for my beloved Husband Hearbert Stallings, I give and devise to him my said husband in fee simple the farm on which we now reside situated in the above named county and state known and described as being the South West quarter of the South East quarter of section thirty three (33) township Four (4) South Range Thirteen (13) West containing Forty acres more or less. I give to my daughter Sintha Bailey one dollar, I give to my two grand children Thomas Stallings and Kisiah Barrett one dollar each further give to my son Berry Stallings one dollar he having had his portion give to him heretofore, I give to my three grand children ____ Enoch Larkin and Nancy Jane Butler one one seventh (1/7) part of my personal and real estate that I may have at my decease, I further bequeathe to my three sons Willis, James and John Stallings one seventh (1/7) each of my personal and real estate as aforesaid. I bequeathe to my 3 daughters ___ Jane Anderson, Nancy Stallings one seventh each of my personal and real estate as aforesaid. I give to my daughter Mary Hancock one seventh of my personal and real estate aforesaid. I do hereby constitute my son Willis Stallings and my son in law Isaac Anderson my executors of this my last will and testament the witnesses whereof I hereunto subscribed my name this 9 day of March A.D. 1864 His Shadrack X Stallings Mark Signed sealed and delivered by the above named Shadrack Stallings as his last will and testament in the presence of us who have subscribed our names in the presence of each other. Stallings State of Indiana Posey County Be it Remembered that on this 9th day of April 1864 before the undersigned Clerk of the County of Common Pleas of Posey County in the state of Indiana William Williams an of the subscribing witness to the written and forgoing instruments of writing purporting on its face to be the last will and testament of Shadrack Stallings personally appeared at my office and bring by me duly person according to law when his oath says that the written and foregoing instrument of writing purporting as aforesaid was o the 9th day of March 1864 signed by the said testator Shadrack Stallings by making his mark thereto as his last will and testament in the presence of the affiants William Williams and Nancy E. Stallings and by the testator published and declared as his last will and testament that the same was at the same time at the request of the testator and his presence attested and Page-174 Subscribed by the said affiant. William Williams and Nancy E. Stallings in the presence of each other as subscribing witness thereto that the said testator was at the time of making said last will and testament of full age to de__ his property that is to say more than twenty one years of age and was of sound mind and memory and not under any coverin or restraints & whatever and further says not. Edson clerk of the Common Pleas of Posey county certify that the writtin and foregoing last will and testament of Shadrack Stallings Dec'd has been duly admitted to probate that its execution has this day been proven by William Williams above proof togetheir with said last will and testament has been duly recorded on page 173 of the Record of Wills in my office.
