I understand that the law we are discussing about disturbing the ground within 100 feet of a cemetery came into effect July 1, 2000. Prior to that time, was there any prohibition that prevented a person from building within, say, 20 feet of a cemetery? I'm interested in knowing if a county could legally sell a cemetery on which no taxes had been paid since the former owners had bequeathed the land to a cemetery association. The cemetery association had become inactive, in that no meetings have been held in many years; however funds have been paid continually from the cemetery association account for mowing.
