We have a handful of friendly legislators who can have it drafted by the Legislative Services Agency in no time. It's the remaining three months of trying to push it through the session that takes it's toll.... It now all depends on what happens in this November's election. With next year being a budget drafting year, that will take priority over everything, and depending on who is governor and who controls the house, that will decide how smoothly the whole system works for the next two years. The INPCRP has several members that work hard every year on new cemetery legislation, and have been successful with some laws. It is difficult to get legislators and hearing committes to listen to proposals concerning abandoned cemeteries, my hat's off to them for what they have accomplished so far. We need more people like you to write some legislators to convince that we are not a minority and laws need to be changed! Ernie

For the Indiana folks: I'd like a quick comment on my observations from reading the Indiana codes on cemeteries: I find nothing that gives anyone the "right" to access a cemetery on private land. I find nothing that says you have to protect a private cemetery, e.g., fence it to keep the cows out. I did see some code about protecting a "public" cemetery but my reading of the code is a public cemetery is one that has been deeded to a public arm, like the township. A cemetery that is on private land and is still owned by the landowner is not, by my reading, "public" and does not have to be protected. I bet you find Holderman. If/when you do, subscribe to the Brethren list and ask for information, such as an obit. The surnames you listed showed a bunch of Brethren names, and the Brethren list might help you with others. Brethren from the Miami Co OH area migrated as a group to Elkhart and St Joe counties, maybe nearby others. Perhaps he was buried just over the county line, depending on where he lived.     3. Hello All: What makes me so irked is that if this was a Native American cemetery they couldn't touch it. I'm not prejudiced, but I don't see the difference. We had an incidence here in Tipton County where they were doing some bridge repair and called the local county historian out to see if there was any difficulty in doing the ground work because of there might be some Native American burials.     3. Thanks Theresa for your kindness. Our vice-president, who is also a county councilman, has talked to the county planning commissioner and took a copy of the law to him. He was aware of the new law, and made the comment that it would be difficult for him to move the cemetery (due to the law) and expensive. The cemetery president has contacted the county commissioner that supports us; and I have talked with Jeannie and gave her a heads up as to what may happen. We are planning on attending the planning commission meetings. We will also be sending a letter to the developer explaining the importance of the cemeteries and copies of the laws. Believe me, we are going to do everything that we can to save this cemetery. This developer won't be happy until he has every square inch of Hancock County developed. When county commissioners voted no for a new subdivision due to drainage issues, he threatened a lawsuit - just because he wasn't getting his way. What a nice guy.
