In August 1868, Daniel Butcher filed for a divorce from his wife, Julia A. Butcher. They were reportedly married on March 28, 1867. Julia reportedly abandoned Daniel in June 1867 without any just cause. Both Daniel and Julia had three children from prior marriages. A short time after the marriage, Julia gave birth to another child, fully developed, soon after the marriage, and Daniel believed that she was pregnant by another man prior to the marriage. Julia cross filed for divorce noting that Daniel was often in an ill humor and failed to support her. She asked for custody of the child, Martin Luther, who was during her marriage to Daniel, and reasonable alimony to support him.
