Article of agreement made this third day of April A.D.1855 by and between Ozias Wright of the county of LaGrange and State of Indiana of the first part and Newton Eno of the county and state above named of the second part,Witnessth that the said Ozias Wright or his assigns agree to make to the said Newton Eno or his assigns a good and sufficient warranty deed to the North half of the Southeast quarter of section thirty three excepting one acre and seventyfive thousandths of an acre out of the southeast corner thereof.Also that part of the west half of the south half of the southeast quarter of section thirty three lying adjoining to the north of Andrew Pontius Mill Pond and race.Also the north half of the east half of the southwest quarter of section thirty three excepting two acres out of the southeast corner all in township thirty six,north of range ten east and containing to the original survey one hundred and twenty eight acres of land.Upon the following conditions to-wit: That the said Newton Eno or his assigns shall pay to the said Ozias Wright or his assigns the sum of four thousand dollars lawful money of the United States in manner and at the times herein specified,that is to say five hundred dollars in cash in hand the receipt whereof is hereby acknowledged.Also on the first day of October next the sum of five hundred dollars with interest from date upon the payment of the above sum and interest the said Ozias Wright or his assigns agree to make and deliver the deed named above.Provided the said Newton Eno or his assigns shall make and deliver to said Ozias Wright or his assigns a mortgage upon the above premises containing a power of law for the security of payment of Two Thousand dollars and interest from date in the following manner and terms that is the first day of October 1856 the sum of Six hundred and sixty six and two thirds dollars and interest and on the first day of October 1857 the like sum of six hundred and sixty six and two thirds dollars and interest and on the first day of October 1858 the like sum of six hundred and sixty six and two thirds dollars and interest. It is also agreed that the party of the second part shall have the wheat on said premises and all of the priveleges pertaining thereto.
