It is believed that she could be the daughter of either be Garland Ingram or Tarpley Ingram of Pittsylvania Co, VA. But NO proof can be found.     3. Dear List: What follows is more information on the descendents of Thomas AVERA, Sr, 1761, and Richard INGRAM, 1780, of Johnston Co NC. My motivation for posting this information to the various Roots-Lists is to give researchers some of the necessary information they need to sort out their own ancestors if they descend from either or both of these men and to receive additional information from other researchers and descendents. Complicating matters are a number of mistakes and errors that have been passed on to new researchers of these two men and their descendents. I suspect that these mistakes and errors partially resulted from the following three situations: (1) The twenty years that separate the death of Thomas AVERA, Sr. from, his friend and contemporary, Richard INGRAM and the difficulty this caused in accepting that three of their children married each other; (2) The many early descendents of these two men who have names that echo each other to say nothing of others in Johnston Co NC who had the same names but who were not direct descendents or, perhaps, not even related; and, (3) The likelihood that earlier researchers did not adequately study related Court Minutes, Deeds, and Estate Files in both Johnston and Cumberland counties, NC, before drawing up pedigree charts based on easily accessible Wills. However, this particular Post results directly from a query that an AVERA descendent sent that was based on the belief that Thomas AVERA, Jr.’s son, William AVERA, married Elizabeth INGRAM, the daughter of Richard INGRAM, 1780. Of course, this would have been impossible, but the errors and difficulties multiply from there. There is more to the query than this issue alone, but it will take a second Post to address some of the other parts to this query. Therefore, in a later Post, I will address the confusion around who the parents were of the AVERA who married Bryant RHODES and went to Greene Co GA and which William AVERA (AVERY) died in Greene Co GA about 1825. Of course, any help solving this puzzle will be appreciated. In the meantime, I hope that the following will be of help. It is impossible for Richard INGRAM'S daughter, Elizabeth INGRAM AVERA, to have married the William AVERA who was the son of Thomas AVERA, Jr. Richard ’s daughter, Elizabeth, married a William AVERA before 5 Dec 1780. The proof of this is that Richard’s daughter is named Elizabeth AVERA in his 5 Dec 1780 Will. William, the son of Thomas AVERA, Jr. was still a young boy in 1780. In fact, he was still a minor in Aug 1789—almost nine years after Richard INGRAM’S Will was signed naming his daughter Elizabeth AVERA. “Johnston County Court Minutes: 1787-1792, Book IV,” Transcribed and Reproduced by Wenette Parks Haun, shows that during the August 1789 Term of Court: Alexander AVERA, Esq. of Cumberland County was appointed guardian to William, Mary, Thomas, Zilpha, and Kedar AVERA orphans of Thomas AVERA, Jr, deceased. Then almost seven years after that, during the May 1796 Term of Court, Zilpha AVERA, orphan of Thomas AVERA, Jr, deceased, who would have had to have been at least 14 by then, asked the Court to appoint Zadock STALLING as her guardian. (See Haun, 1793-1797, Book V.) This means that Zilpha AVERA was born before May 1782 but after May 1775. (You will note later in this Post that Richard INGRAM had grandchildren of a very similar age.) Note how three of Thomas AVERA Jr’s children echo the names of Thomas AVERA, Sr’s children. These are, of course, the minor children of Thomas AVERA, Jr. and, in part account for the confusion in AVERA pedigree charts that are not based on complete research. In addition to the five children who were assigned a guardian, Thomas AVERA, Jr. named four other children in his 1787 Will. Two daughters, Edith and Ann, had already married men with the surname of STALLING, and the other two not treated by the Court as minors were Barsheba and Winifred. I believe that the William AVERA who married Richard INGRAM'S daughter, Elizabeth, is the son of Thomas AVERA Sr, 1761. As I stated in the annotations to Thomas AVERA, Sr’s Will, I believe that three children of Richard INGRAM married three children of Thomas AVERA, Sr. John INGRAM married Mary AVERA. William AVERA married Elizabeth INGRAM, and Samuel AVERA married Zilpha INGRAM about 10 Feb 1779. The only one of these AVERA-INGRAM marriages that has been absolutely proven is Samuel AVERA to Zilpha INGRAM, but BUSSEY researchers have long accepted that Mary AVERA married John INGRAM and there is much circumstantial evidence that William AVERA, the son of Thomas AVERA, Sr, married Elizabeth INGRAM. Some of the children of John INGRAM and Mary AVERA were grown when John’s father, Richard, died between 5 Dec 1780 and Feb 1781 when the Will was probated. However, as numerous Court Records show, two of their children, John and Thomas INGRAM were minors at the time. A Family Bible in the BUSSEY Family has January 17, 1771, as the date of birth for Thomas INGRAM, and this would make him about 10 years old when his grandfather died and about the same when his father died. John INGRAM was alive when Richard died, but his own Estate was inventoried in Nov 1781, just a few months after Richard’s death. During the August 1794 Term of Court, “John INGRAM, orphan of John INGRAM deceased, being of proper age came into Court and chose for his guardian Thomas Ingram….” (See Haun, 1793-1797, Book V, p. 41.) The math works for Thomas being 23 by the August 1794 Term of Court, and John would have had to have been at least 14. This would put John’s birth year at no later than 1780, but it was probably a few years earlier than this. I think that this change in guardianship was likely in preparation for John to accompany Thomas on their move to GA to join their double Uncle and Aunt, Samuel and Zilpha INGRAM AVERA, and their other double Uncles, Isaac and Arthur AVERA. Thomas and John INGRAM arrived in Lincoln Co GA in time for Thomas to marry Rebecca BUSSEY, daughter of Hezekiah BUSSEY and his wife Amy FLEMMING, on July 28, 1799. John INGRAM later married Rebecca’s sister, Nancy BUSSEY, about 1809. A number of AVERA researchers are interested in Samuel and Zilpha INGRAM AVERA, and so I add that, based on my own research, I believe that Samuel AVERA was in Wilkes Co GA by 1787. My reasoning is as follows: There is a notation in the Johnston Co Minutes for the August 1787 Term of Court that suggests that Samuel AVERA was already in GA by then. This notation had to do with Johnston Co NC taxes owed for the Year 1786. There is an entry in these Minutes that was later marked through by different ink than the original. The entry read: “Samuel AVERA has removed out of this State and has no property in this County but Land.” (See Haun, 1787-1792, p.13. Note that I have verified this by examining the original Court Minutes housed in the NC Archives, and it was during this examination that I noted the differences in ink. Nevertheless, I really do not understand the meaning of the entry except that it suggests that Samuel AVERA had already gone to GA by Aug 1787. This is consistent with another entry in Johnston Co Deed Book W-1, pp 88-89 that states that Samuel AVERA had given William AVERA of Cumberland Co his power of attorney on 15 Nov 1786. I believe that these two records taken together constitute proof that Samuel AVERA was in GA by 1787. Please let me know if you can help add to or correct any of the foregoing.     3. Dear List: I hope that the following transcription and brief annotations of Thomas AVERA, Sr’s 1761 Will proves helpful to INGRAM researchers. Three sons of his were in the Wilkes Co area of GA before 1797. In addition, two INGRAM grandsons of his were also there along with their Aunt Zilpha INGRAM who had married their Uncle Samuel AVERA. [Note: If you want a formatted copy of this E-mail, I will E-mail it to you as an attached Word for Windows file or as a Text file.] Most of these Averas and Ingrams settled in the area of Wilkes Co that became Lincoln Co GA and, from there, they moved on to other GA counties and to other States. Both INGRAM grandsons married BUSSEY sisters and settled in Putnam Co GA, and Thomas AVERA, Sr.’s grandson, Ingram AVERA, seems to have gone with a son, daughter, son-in-law--Stephen Harold OVERSTREET, and other early settlers of GA to TX before 1844 [not yet proven]. The list goes on and on. Thomas AVERA, Sr. and Wife, Judith, and his friend Richard INGRAM, Testator of 1781, and Wife, Annie, all of Johnston Co NC, are the earliest ancestors of this prolific line of pioneers that I have reliably identified and researched. As time permits, I shall post my transcription and brief annotations of Richard INGRAM’S 1781 Will. Thomas died young and Richard died old, but they had many children of a similar age that resulted in three INGRAM-AVERA marriages and a multitude of descendents. Introduction to the Will of Thomas AVERA, Sr., Testator of 1761, Johnston County, North Carolina The following transcription is of the entire original Will of Thomas AVERA, Sr., Testator of 1761, housed in the NC Archives (CR 056.801.1, Johnston Co Wills: 1760-1922, Folder: Thomas Avera, 1761). It was probated during the April 1762 session of the Johnston County Court. Elizabeth E. Ross published an abstract of the original in “Will Abstracts: 1746-1870, Vol. I & II, Revised Edition, 1991.” Because this abstract is widely available, differences between it and the original are noted in the transcription. A clerk made an official copy of the original. A microfilm of this copy can be found on pages 755-56 of “Johnston County Record of Wills, Vol. I, 1760-1859,” housed in the NC Archives (C 056.8001). This copy differs in some particulars both from the abstract by Ross and from the original. Differences between the copy and the original are also noted in the transcription. The original Will is considered to be authoritative whenever it differs from either the abstract or the copy. The original is written on one side of a 12 inches by 15 inches sheet of unruled paper. The writing stretches across the 12-inch length from edge to edge making it difficult to follow. The penmanship is legible, and there are only a few places where the words can not be read with certainty. However, for ease of reading, punctuation and paragraph breaks were added and spelling was corrected or modernized. The transcription that follows has any editorial comments enclosed in [brackets]. The Will: In The Name of God, Amen. The 12th day of February 1761 I, Thomas AVEREA, Senior, late of Johnston County in the province of North Carolina, planter, being weak in body but in perfect mind and memory, thank to God for the same. Calling to mind the mortality of my body and that it is appointed for all men once to die. [Both the copy and the abstract spell the surname “Avera” and not “Averea” as in the original.] I do make and ordain this my last Will and Testament and, first of all, I give my Soul into the hands of Almighty God that gave it me nothing doubting at the General Resurrection to receive it again by the mighty power of God and my body to the earth to be buried in a decent Christian manner at the discretion of my Executors, and, as for what worldly Estate it has been pleasing God to bless me with, I dispose of in the following manner and form. Imprimis: I leave and bequeath to my beloved Wife, Judith AVEREA, her third of half the tract of land I now dwell on with all the improvements during her life and one Negro girl named Judith and one feather bed with a green rug and pair of sheets and two cows and calves and one horse bridle and saddle and fifty pounds current money of the aforesaid province to be levied out of my Estate. [The abstract says that this land is on Marks Creek, but neither the copy nor the original mentions Marks Creek. The copy seems to say “a green ring” and not a “green rug,” though neither is entirely legible.] I leave and bequeath to my Son, Alexander AVEREA, one hundred acres of land where he now dwells, to him and his heirs forever. I leave and bequeath to my beloved Son, Thomas AVEREA, Junior, one piece of land where he now dwells containing about ninety acres, to him and his heirs forever. I leave and bequeath to my beloved Son, John AVEREA, one half of the tract of land I now dwell on, the part up the river, to him and his heirs forever. I leave and bequeath to my beloved Sons, William and Moses AVEREA, one track of land on South Side of Neuse River containing two hundred twenty-five acres to be equally divided between them, to them, their heirs and assigns forever. I leave and bequeath to my beloved Son, Isaac AVEREA, one half of the land I now dwell on, with the plantation, to him and his heirs forever. In witness hereof I have signed, sealed and delivered My Hand and Seal Thomas (X) AVERA His Mark In the presence of us Witness: William AVERA William JONES Senior [On the back of the Will is written: “Thomas AVEREA Will, at page 58, in Book A, 1761.” NOTE: The children are not named in this Will in the order of their ages. This Will has also proven to be misleading in other ways and requires reference to numerous other Johnston and Cumberland Co documents found in the NC Archives, Raleigh, NC, and in the Avery Vertical File at the Johnston Co Genealogy Library, Smithfield, NC. For example, five (5) of the sons named in this Will became Minor Orphans at the time of Thomas AVERA, Sr.'s death and the sixth minor son, Arthur, was still unborn when the Will was signed. William, the son, was a boy at the time and is not the William AVERA who witnessed the Will. The son, William, eventually moved to Cumberland Co, NC, and sold his inheritance to his brother Moses and was given power of attorney to act on behalf of his brother, Samuel. But most important is the fact that the son, William AVERA, was not the William AVERA, Testator of 1795, Johnston Co NC who married Rachel. It is proven that Samuel AVERA married (10 Feb 1779) Zilpha INGRAM, daughter of Richard INGRAM, Testator of 1781, and later moved to Wilkes/Lincoln Co GA, as did his younger brothers, Isaac and Arthur. It is also likely that Samuel's brother, William, married Zilpha's sister, Elizabeth INGRAM, and that Samuel and William's older sister, Mary Avera, married Zilpha and Elizabeth’s brother, John INGRAM.
