They used to be taken care of by the Township Trustee, >> The Department of Natural Resourses-DNR Has authority over recording the locations, and mapping Cemeteries, but under IC Law the trustees are required to Clean all cemeteries in operation before Feb. 1939 without funds, and restore, reseed. remove all noxious weeds, level graves, and repair fences, or replace them and repair broken or crooked stones. They, nor the DNR have the authority to prevent the sale or movement unless they are on the historic register. And I'm not sure about that. All that is needed is a Circuit Court order signed by the Circuit Judge in the county in which the cemetery is located. If anyone finds out different, please let me know. It's certainly not anyone I have contacted. According to what I have found is, if you can influence the Judge you stand a chance, otherwise if someone wants to buy the property you can't stop them. Then if they want to move it, the Circuit court Judge signs the order, the Local Health officer, and the State Health Department sign off on the movement and the land will be developed, or used for whatever. Also the only thing mentioned in the current Law is, it is presumed that reasonable care is, or was used in the movement. End of report!! There is no Governing body that is present at the movement of a cemetery, nor does the person doing the movement have a responsibility to notify anyone where the remains have been removed to. You have to find out for yourself. Again this is from experience, I''ve been thru all of this in Floyd Co. Jack Briles jb502000@aol.com
