    1. [INDIANA] Re: [INPCRP] Waldheim - Toleston Cem
    2. I just want to thank everyone who has responded about the cemetery. I am going to make a lot of phone calls tomorrow (to whoever is open by the time I get home from work) and try to find out why it's being sold, who the last owner was etc. The church pastor last year said they owned it...but they havent been mentioned in any of the articles that brag about the Trustee cleaning up the cemetery, but the articles also didnt mention the For Sale sign on the property either of course. I dont have relatives there, my main interest is in what a shame it is for something like the sale of a cemetery to just anybody, and that they can do anything with it. Whatever happened to the phrase "eternal resting place"? It seems more like "rest here til someone wants to build a car lot or an office building, or until the town govt doesnt feel theyre making enough tax money from that little piece of land" Anyway, thank you all. If I can find an email address for anyone important at the township trustees office I will be sending a lot of these emails (with your names removed for privacy) to them to enlighten them a bit of the laws that govern cemeteries. 2. Jack, Thanks for the additional info. I also found the Indiana State Historical Society has grants. Don't know how they work. I wonder if there is or was an owner of this cemetery in question, and if it is being sold for taxes? I wish we had more info. Thanks again. Jan

    2. In a message dated 4/14/01 7:08:08 PM US Eastern Standard Time, JANETSQUAW@aol.com writes: << Indiana Cemeteries are now overseen by the Department of Natural Resources. They used to be taken care of by the Township Trustee, >> The Department of Natural Resourses-DNR Has authority over recording the locations, and mapping Cemeteries, but under IC Law the trustees are required to Clean all cemeteries in operation before Feb. 1939 without funds, and restore, reseed. remove all noxious weeds, level graves, and repair fences, or replace them and repair broken or crooked stones. They, nor the DNR have the authority to prevent the sale or movement unless they are on the historic register. And I'm not sure about that. All that is needed is a Circuit Court order signed by the Circuit Judge in the county in which the cemetery is located. If anyone finds out different, please let me know. It's certainly not anyone I have contacted. According to what I have found is, if you can influence the Judge you stand a chance, otherwise if someone wants to buy the property you can't stop them. Then if they want to move it, the Circuit court Judge signs the order, the Local Health officer, and the State Health Department sign off on the movement and the land will be developed, or used for whatever. Also the only thing mentioned in the current Law is, it is presumed that reasonable care is, or was used in the movement. End of report!! There is no Governing body that is present at the movement of a cemetery, nor does the person doing the movement have a responsibility to notify anyone where the remains have been removed to. You have to find out for yourself. Again this is from experience, I''ve been thru all of this in Floyd Co. Jack Briles jb502000@aol.com

    1. Re: [INDIANA] INFORMATION ON RESPONSIBILTY OF CEMETERIES
    2. Indiana Cemeteries are now overseen by the Department of Natural Resources. They used to be taken care of by the Township Trustee, which was not usually done. All Indiana cemeteries known are supposed to be put on a geographic map and given a name if they don't have one. All of this is explained in the URL listed below. http://www.in.gov/dnr/dnr-addr.htm Scroll down to Division of Historic Preservation and Archaeology. Click on that.

    1. [INDIANA] Indiana Cemetary For Sale
    2. Diana Owen
    3. I forwarded the Cemetary for Sale email listing to Marsha Chapman who is the Vice-President of the Brookdale Cemetary in Brookdale/No. Stockholm NY area. As you can see, she had some definite opinions on the sale of a piece of history... Here are her comments: Diana First and for most, just the thought of this makes my blood boil. What can be done legally I don't know. Secondly, don't those fools know they are destroying vital history!!! What happens here in New York State is a cemetery is declared abandoned after 14 years I believe then the town that it is located in usually hired a person to mow and trim at least 4 times a year, of course, some never get taken care of, like the one where my great great grandparents are buried, if might get mowed once a year. At least Here in the TOWN OF STOCKHOLM. I was deputy town clerk for 5 years and that is what the town board did here. There are 3 or 4 abandoned cemeteries. Abandoned is when there is no Cemetery Association to care for it and there have been no burials for the set amount of time. Here in New York also the Department of State has jurisdiction over the cemeteries, they control the going on i.e.: how the moneys paid for lots are to be use, i.e. X number of the dollars go for perpetual care. In other words can not be used for anything, the interest moneys is what is actually use. There is a portion of these dollars that go into a general maintenance fund, i.e.: moneys used for just what the fund says Maintenance, mowing and up keep. We here for Brookdale have work bees and ask the inactive cemetery families to make donations if possible for any large projects, i.e. - replacing fences, maintaining fences, removing hedges, etc. What I mean when I say inactive families are the ones who have loved ones buried here but don't take an active roll in meetings and in put of how the cemetery is run. So, may I suggest, if this is a cemetery that you know of anyone with family or just want to get involved to see to it nothing happens. See if Indiana has a Department of State and if they are involved with governing cemeteries. I can't wait to show my husband this dilemma, when he gets home later. And then I could really open a can of worms at our next cemetery meeting. We have all elderly members that attend our meeting. The younger people like my husband and I don't get involved with "Such Matters". Thanks for this eye opener. Marsha

    3. Is there anyone here who knows about putting a cemetery on a national register. If you can do that, and it doesn't take much. They can't sell it and they can't move it. Does anyone here belong to Indiana Historical Society. I'd contact them right away. Check with the city and see who is responsible to clean it up. Try and bypass that company that is trying to sell it. There is a cemetery in IL , that the cows graze in now. but the cemetery has been cleaned, and belongs to the Genealogy and Historical Soc now. ----- Original Message ----- From: <AnoleLady@aol.com> To: <INDIANA-L@rootsweb.com> Sent: Friday, April 13, 2001 8:15 PM Subject: [INDIANA] For Sale: Waldheim CEMETERY ? > Drove past the Tolleston and Waldheim cemeteries today (20th & Grant st., > Gary IN), as I usually do each work day, and decided to drive around to the > back section where the Waldheim cemetery is (didnt even know it was there due > to the overgrowth before) and noticed that there is now a for sale sign less > than 10 feet from a headstone. 2. I still need to find out for sure what the deal is....tho the sign is clearly on the cemetery land as it's right near stones and there's only about 30 feets between the street and the fence that the rest of the cemetery is in. The For Sale sign listed this number to inquire about buying it, so they would probably know: Lake County Surplus Properties ; 219-662-0079 ; Refer to: 25-43-0016-0027" Or the Twp Trustee, since they've been telling the media about how theyre cleaning up the Tolleston section (they dont mention the for sale sign in front of Waldheim) Dozier T. Allen, Calumet Twp Trustee (219) 886-5200 31 E 5th ave, Gary, IN 46402 Or the church that last year told me they owned the cemetery. St. John Lutheran Church (219) 944-0654 If anyone finds out anything before I do (I'll be at work monday morning and cant call) please let me know. Kathy

    3. I will second that letter if we had an address. It is my understanding (I may be wrong) but if they sell cemetery land someone must move the graves. We had a church sell up by us and they (the families) had to move all the graves...I don't know what happened to the people with no family or if the families could not afford to move them. We are American Indians and that is something that you just don't do!!! let me know what I can do. Thanks Darlene JPM6966@aol.com wrote: > > This is absolutely appalling!! I know they dont have the funding to take care of it, but they could at least give input to the Govt people taking over. <A HREF="http://khuish.tripod.com/seeger.jpg"> </A> Here's some photos I took this afternoon...but keep in mind I only had available a $20 camera, one-hour developing, and took a picture of the picture with a webcam attached to my computer. If you've ever been near the cemetery you can tell what a difference they made cleaning it up...but now I think we might know WHY they suddenly cleaned it. 1. [INDIANA] For Sale: Waldheim CEMETERY ?
    2. Drove past the Tolleston and Waldheim cemeteries today (20th & Grant st., Gary IN), as I usually do each work day, and decided to drive around to the back section where the Waldheim cemetery is (didnt even know it was there due to the overgrowth before) and noticed that there is now a for sale sign less than 10 feet from a headstone. The name on the stone, which is knocked over, is Mulligan. The sign says "For Sale ; Lake County Surplus Properties ; 219-662-0079 ; Refer to: 25-43-0016-0027" How can the Lake County Govt offer a cemetery for sale to the general public?? The cemetery is the only thing occupying that block, so it is that which is for sale. I know it is in bad shape and has been neglected for years with no one to care for it, and I assume they want the tax money from the 2 full city block land. But what about the people buried there? Supposedly an astronauts family is there (Otto Borman), and most of the first settlers/pioneers of village of Tolleston (now a section of Gary IN), and founders of the St John Lutheran Church. There are many families buried together here, and many many children as most of the graves are before 1920. Many of the families had stone walls (about 8 inches high) erected around their groups, or burials as shown in the picture below which looks like 2 adults and one small child length graves. <A HREF="http://khuish.tripod.com/famplot.jpg"> http://khuish.tripod.com/famplot.jpg</A> Is there anything that can be done? It seems like it would be covered under either the county or township laws regarding abandoned cemeteries. <A HREF="http://www.ai.org/legislative/ic/code/title23/ar14/ch68.html"> Indiana Code 23-14-68</A> -TWP <A HREF="http://www.ai.org/legislative/ic/code/title23/ar14/ch67.html"> Indiana Code 23-14-67</A> -County Kathy Huish CC Lake County IN GenWeb http://www.rootsweb.com/~inlake/
