Contrary to "the fear of LOSING property"-- the Dawes Roll was the method used to assigned individual title to the land to the legal tribal members. Until then, title to the land was vested solely to the tribe. The resident/citizens of the tribe could use as much of their tribal land as they needed, and this is where the inequity started! Some of the non-Indians who came into the Nation and married Indian women AND some of the more aggressive mixed-bloods started claiming hundreds upon hundreds of acres - FAR more than they needed. The non-Indians would then import their non-Indian relatives from other states, "rent" land to them for $5. per year. They were creating their own little dynasties in Indian Territory! Soon there was no useable farmland left for the Indians. The Dawes roll ended that! The land was evaluated and graded, then each legal citizen was enrolled and allotted an EQUAL value/amount of land, according to the grade. If it was bottom land, then they would get less land. If it was rocky hill country, then they were given more acreage. The average allotment in the Cherokee Nation was 120 acres for each citizen- man, woman and child. If your family was legal resident/citizens, living on their own "improvements" to the land and were otherwise eligible, CHOOSING not to enroll would mean that the houses that they had built and the land that they had improved would be reassigned to an Indian family, and they would lose all rights to it. I think as you research further you will find that there were other reasons why they were not on the Dawes Roll. Regards Jerri Chasteen ~~~

I would be willing to share whatever information I have. I am searching for information on Jeanetta Gee and William Herstine/Hurston. I am totally at a standstill on the Herstine family. I know there are many spellings for it and I am using this one. Jeanetta and William Herstine had a daughter born about 1898-1900. I am searching for: Vincent - Kentucky Tennessee, Missouri, Oklahoma, Arkansas Sullivan - Mississippi, Arkansas Mahurin - Missouri, Oklahoma, Arkansas Burns - Tennessee, Oklahoma, Colorado My grandmother, Anna Jane Mahurin Burns said that she and her daughters would have starved to death after her husband left for Colorado if it had not been for the Indians that took them in and fed them. She earned her only income by cleaning the school. She and the two girls eventually came to Arkansas. Her husband's name was Oscar Woodrow Burns from Tennessee who supposedly worked for the railroad, developed TB and went to Colorado for his health where he died. Would anyone know where info. can be found on a family said to be HORNS who left Alabama at time of the removal leaving at least one son behind who was connected to the PATTERSON & or KNiGHTEN families in Morgan or Blount Co. Alabama? There are desc in this area who are interested in finding connections to their Ok families. Also what might be meant by a "book of dreams" which is said to have been in the possession of one desc. here in Al.? Thanks for help in the past Sue in Al.

Barbara ~~ Barbara- The persons you listed are not shown on the "Cherokee By Blood" Dawes Roll of 1902. I would check the 1900 census of Indian Territory to see exactly who and what they were. That was a specific question asked in 1900 and 1910: "Is there any person of Native American blood residing in this household?- What tribe/degree of Indian blood? What tribe (each parent) and degree of Indian blood?", plus MUCH more vital genealogical information as to where they and their parents were born, month/year of birth, how many times married, how many years married to this spouse, how many children born to this mother (caution: not necessarily children of THIS husband). This census IS NOT on Internet, but can be ordered on microfilm through your own public or LDS library. The census has an index- called a "Soundex" (indexed by the sound of name) in order to find out exactly where they were residing, so that you can order the correct roll of microfilm. Regards jc

    3. Kim, Have you checked the 1900 U.S. census of Indian Territory? That would be the first place to look.     2. Hi Helen: I don't have the information you are seeking, however, the coincidence is that I'm reading a book that you would find most fascinating. I got the book from the public library, "Cherokee Cavaliers" written by Edward Everett Dale and Gaston Litton. This book is made up of the letters written by the Ridge-Watie-Boudinot family and cover about 40 years starting in 1832 and ending in 1872. Many of the people you have mentioned in your inquiry have either written the letter or are mentioned in the letters. How wonderful for you to be able to read about their lives.
