Dear Nanda Kumar, I am an outsider (although I am an attorney in the United States), but I find it very difficult to imagine that anything, including court action, is going to restore the former rights or position of the ruling families. The collapse of the princes' political support, the accession of the states to India (or Pakistan), and finally the abolition of the Privy Purse in 1971, all seem to me quite irrevocable. I am assuming that when Mrs. Gandhi abrogated the agreement with the princes and abolished their rights and payments previously agreed to, and their constitutional protections, that the matter was litigated at the time and decided adversely to the princes. Am I right about that? It would be interesting to know if that question has been decided by an Indian appellate court, and to read the court's decision if a citation to it can be found. Mrs. Gandhi was astute enough to build up public opinion against old royals and ensured that abolition of privy purses ( and associated privileges ) was not challengable in the courts of India. This stems from the fact that as per democracy, the legislature can pass laws which may be contrary to normal principles of justice. The courts can only intrepret the laws which have been duly promulgated. The above aboltion was challenged in the Internation Court of Justice at the Hague, where the royalty was represented by Dr. Nagendra Singh, a scion of former royal family from Rajasthan but nothing came out of that too.
