EVIDENCE ALL INN Frank Coryell's Fate Will Soon Be Decided By a Jury of His Peers In the case of the State vs. Frank Coryell, trial of which is in progress at Columbus, the entire time was occupied yesterday in hearing the evidence [of] Coryell [who] was placed on the witness stand to testify on his own behalf. On cross examination he said: First met Mrs. Banks [the] 15th to 20th of May, stopped to get a drink and met her, talked a while, and when I left she invited me back. This was our first meeting and led to what followed. I went often and generally spent every Sunday night there. I was courting her. We talked about getting married but was not engaged. We both thought she could get a divorce. When I left Monday night, before [the] shooting, I promised to go back Friday night, and I did. Live three miles from Langdons. Walked to Dudleytown, eight miles, that day, got pint of whisky, left at two o'clock and walked home; got supper, got gun, then started for Banks. Spall drank half the whisky. Here witness took gun and showed how the shooting occurred. I first held the door in a playful manner as she pulled it, and when it opened I slipped and fell. Up to this time I had not seen Mrs. Banks and did not know where she was standing. Gun in my hand when discharged, just as I fell. She said twice I did it purposely, but I told her I did not. She asked me to get her some water, and no one but me got her any water. I playfully slapped her once; this is the only threat I ever made of her. I was going to work till Monday or Tuesday, then try to kill her some squirrels. Was going to stay a week. Have brother at home, not married now. Redirect-Once at Mrs. Banks and one night in June, she had a revolver and shot it four or five times then gave it to me to fix as it would not revolve, and just as I took it, it went off and shot the ceiling. Defense rested at 3:45 and state began its rebuttal. Henry Wagner-Met Louis Richardson Sunday after shooting at Farmington, and he said Coryell had said to him in substance, though not in these exact words, that he would kill Mrs. Banks. I have nothing against Coryell. Here the announcement was made by both sides that the case was closed at four o'clock. Judge Hord then adjourned court to meet at nine o'clock this morning, giving the entire day over to the lawyers for argument. Prosecutors Honan and Shea will speak for the state and Kochenour and Lewis for the defense. The jury will get the case sometimes this afternoon.
