    2. Descendants of Adam Swigart Generation No. 1 1. ADAM1 SWIGART1,1,2. He married ELIZABETH. Notes for ADAM SWIGART: I have found in my families history a story of how our Swigart/Schwigart/Swikard came to America. I want to give thanks to Ellabell Swigart Eker for helping our family in 1983 gather alot of history on the Swigarts. I had what my grandparents had which was also alot and then got with a couple of other lines of our Swigart family. I am still receiving history from the different lines of our cousins. I will later place them in here. But for now here is some of the wonderful history passed down to my family. It is said that Adam Swigart served in the American Revolution the earliest written record so far shows that he was in the United States in 1790. It is believed that he came from Stuttgart, Germany and finally settled in Frederick County, Maryland. The following information came from wills written by Adam Schwigart Sr. and Adam Schwigart Jr. census takers later changed it to Swigart. The sons were George ( which is mine), Adam Jr. , Christopher and John. The daughters were Mary ( unmarried in 1832), a daughter Catherine who married John Shuce, and three other daughters that are not listed by their first names but they were married to Jacob Haines, Henry Haines, and Andrew Powder. Adam Sr. also made bequests to his sister, Margaret Cook, and a granddaughter Sarah, daughter of Adam Jr. who had already died. Adam Jr. also mentions his Aunt margaret Swigart, so she married sometime between 1823 and 1832. There are various spelllings for the name Swigart as in the wills and census records. Those taking the census probably used the phonetic system of spelling. Or just didn't know how to spell the names. LAST WILL AND TESTAMENT OF ADAM SCHWIGART: In the name of God Amen, I Adam Schwigart of Frederick County and State of Maryland being weak in body but of sound and disposing mind, memory and understanding, calling to mind the certainty of death & the uncertainty of the time thereuf and being desireous to settle my wordly affairs, before it shall please God to call me hence by death: I therefore make and publish this my last will and testament, in manner and form following: First and principally, I commit my soul into the hands of Almight God, and my body to the earth, to be decently buried and after my debts and furneal charges are paid. I devise and bequeath as follows: Whereas I have already given my dear wife Elizabeth, three hundred dollars, in lie of her thirdd of my Estate which money she now has in her possesion and is to hold the same at my death, in lieu of her third of my Estate, I therefore give and bequeath unto my wife Elizabeth, one Feather Bed and bestead, with all the bedding and coverlets, she had when I married her, also one chest and Bureau ( that I got of my son George) one spinning wheels, the cotton spinnign wheels, her red cow, Buffaloe Calf, all the flax and ------ and the thread and new linens, that may be on hand, at the time of my death, side saddle and her choice of one half the carpets, the one half of entire cloths and twells, all the hat of mine in the barns, the garden vegetable ----- ----- hogs, four new and two old ------- -----bag the samll fruit -- and dryed apples, four common chairs, one quilt and a white woolen blanket, and in addition to three hundred dollars already given her as above mentioned, in lieu of her hrirs of my Estate after my death, I also give and beqqueath unto her the sum of one hundred and thirty dollars, and no more, which last mentioined sum of hone hundred and thrity dollars, for her complying with this will, to be paid her in two payments of sixty five dollars each the first payment to be made in twelve months and the second in three years after my personal estate is settled --- without interest, also all articles identified as beloning to her when I married her. I give and bequeath to my sister Margaret Cook, the sum of sixty dollars, in manner and form following ---- one fourth part of said sum of money to be paid my sister Margaret Cook in twelve months after my death, should she be then living, and the residue in three equal annual payments with out interest, anfter the first payment is made, provided my sister is living at the end of any one year when such payments shall become due, but in case of her death, all the money that would be coming to her, after her death, to revert back to my Este and to this I do hereby authorise and enpower my Excoutor herin after named to retain the said sum of money in his hands, without interest to make payments to my sister Margaret Cook, should she continue to live, and case of her death vefore the payments become due, that part remaining that should have been coming to her to be paid in equal proportions, to those of my heirs after named to receive shares of my Estate all the remaining parts of my personal Estate, I direct my Executor ( herein after named) to sell at a public sale, as soon as conveinant after my death, and the Page 2 of the Will continued: proceeds of such sale, with my Estate to be divided amongest my heirs as herin after directed, equally to those herin after named to receive the same, shares and share alike with the several charges made against these include said shares. Whereas my son in law, John Shuce, who married my daughter Catherine, hath highly offended and disobliged me and by his imprudient & offensive conduct, in life rendered himself unsorthy to be taken notice of as a son in law. I do therefore hereby declare, that the sum of the three hundred and fifty dollars, (including my daughter Catherines outfit at their marriage.) , which I have given him shall go in full satisfaction of all right , title, interest, claim and demand, what soever, which he may or -------- -------- may pretend to have a claim of ---all of my real or personal Estate. And whereas I have already advanced and paid for and to my son George Schwigart, one thousand, one hundred and eighty dollars, and he my son George having otherwise put. (me to much trouble as his-) and whereas my son Christropher Schwigart (deceased) has received of me before his death, the sum of onethousand one hundred dollars: I do hereby declare the said sums of money, paid to and for my sons, George and Christopher as above mentioned, a full and fair-and share are in full satisfaction of all right, title, interest, claim and demand whatsoever, that they or their heirs, or either of their heirs, tohterwise could have had--manner to my Estate, and it being my wish and intention, that myheirs (except my son George Schwigart, the heirs of my son Christopher Swigart, deceased , and my son in law John Shuce)should have an equal share of my Estate, I therefore charge them in this my last will and Testament with the several sums of money and articles advanced to each, which several sum including their outfits, are to be deducted from their several shares upon a sidtribution of my estate. I give and bequeath unto my son John Swigart on share of my Estate $328 advanced him, included in said shares, and also all my earing apparel whatsoever. I give and bequeath unto my grand daughter, Sarah Schwigart ( daughter of my son Adam deceased) one share of my Este, Two hundred and forty or fifty) dollars advanced to my son Adam, included in said share, To my son in law, Andrew Powder on share of Estate $ 125 advanced to him to be included in said share. To my son in law Jacob Haines, one share of my Estate, $150 advanced him, to be included in said share. To my son in law Henry Haines, one share of my Estate $130 advanced him in said share. To my daughter Mary Schwigart on share of my Estate, $140 advanced to my daughter,Mary, when she left home, including in said share. I give and bequeath---- with the use & for the personal benefit the interest on one share of my Estate, to my daughter, Catherine ( who married John Shuce $355 dollars advanced- shares to be included in said share and to prevent the John Shuce from the use of the interest arising from the share of my Estate-. I hereby constitute and appoint my son in law Henry Haines, to take and receive the said share coming to my daughter Catherine Shuce and keep the same as trustee for my daughter Catherine, in money, or in any manner which may most tend to her comfort, annually during her life time; and after her death the said share to go to children in equal proportions upon their being or arriving at age, to receive th3e same in it being my full intentions, that my son in law John Shuce do not receive any part of the share, the interest of whcih I have directed to be paid to my daughter Cathereine Shuce, for her own person, -and benefit. Lastly I do hereby nominate, constitute and appoint my son in law Henry haines, sole executor of this my last will and testaments, authorizing him and deploring him my said Executor to settle up my Estate, wherher real or personal as I could do now or during my lifetime, revoking and annulling all former Wills, by me heretofore made, and ratifying and confirming this and none other to be my last will and testament. In testimoney whereof I have herewith set my hand and affixed my seal this 2nd day of October, in the year of 1828. Maryland Frederick County to wit: On the 23rd day of January 1832, came James Atlee and George Earhart, two of the subscribing witness to the forgoing last will and testament of Adam Schweigart, decesed, and made oath on the Holy Evangely of Almighty God , that they did see the Testator, therein named, sign and seal this will that they heard him publish, pronounce and declare the same to be his last will and testament that at the time of his so doing, he was the best of their apprehensions, of a sound and disposing mind, memory and understanding, that they respectively subscribed their names as witness thereto, at the request of testator, and in his presence, and theat they did also see Thomas E. Hambeton, the other subscribing witness, subscriber his name as a witness thereto , at the request of the testator, and in his presence and all in the presence of each other. Test. G. M.
