Second - I give, devise and bequeath unto my daughter Mary Strake Five (5) Dollars, unto my my son Bernard Ubben, Five (5) Dollars, unto my daughter Catharine Kemper, Five (5) Dollars, unto my daughter Helena (large blank spot), Five (5) Dollars, and unto my stepson Joseph Scheer, Five (5) Dollars, and all the rest of my Estate, real personal and mixed of whatsoever description and whereso situate, whether heretofore or hereafter acquired which I shall have or be entitled to at the time of my decease, and which shall remain after the payment of all my just debts, of the expense of my funeral and of the above legacies, I give devise, and bequest to my beloved wife Anna Maria Ubben, during her natural life, and that at her death, all the property aforesaid, to be bequeathed, or so much thereof as may remain unexpense to be equally divided between my daughter Mary Strake, son Bernard Ubben, my daughter Catherine Kemper, my daughter Helena (large blank spot), and my stepson Jose! ph Scheer and their heirs and assigns forever. I hereby revoke and annul all wills and codicils heretofore by me made, and appoint my son Bernard Ubben, the executor of this my last will and testament. In witness whereof, I have hereunto set my hand seal the eighteenth day of February in the year of our Lord One Thousand Eight Hundred and Ninety Eight. Gerhard Ubben (his mark) The above instrument, consisting of one sheet, was now subscribed by Gerhard Ubben, the Testator, in the presence of each of us, and was at the same time declared by him to be his last will and testament and we, at his request, sign our names hereto in his presence as attesting witnesses. Frank Funke of Breese, IL Theo Bruegge of Breese IL Filed Oct. 23, 1899 Petition for Probate of will filed Jan. 13, 1902 Albert Strake in the matter of the last will and testament of Gerhard Ubben deceased for probate of will and letters testamentary. To the Hon. Joseph Hauke, Judge of the County Court of Clinton County in the State of Illinois. The petition of the undersigned Albert Strake respectfully represents that Gerhard Ubben who was at the time of his death a resident of the county of Clinton, State of Illinois, departed this life at Breese in Clinton County, State of Illinois on or about the 20th day of October A.D. 1899, leaving a last will and testament, duly signed, published and attested, as believed by your petitioner, and which by him is herewith presented to your Honor for Probate. That said Will is subscribed by Frank Funke and Theo Bruegge as witnesses tot he execution thereof. The said Testors in his said last will nominated and appointed Bernard Ubben executor thereof. And this petition further show that the said Gerhard Ubben died seized and possessed of Real Estate, ! valued at about six hundred dollars. That said deceased left surviving him no widow but the following persons as his only heirs at law legatees; and their respective places of residence so far as known are as follows: Bernard Ubben 12th & Wright Streets, St. Louis, Missouri Catherine (Katy) Kemper, St. Louis, Missouri Helena (Lena) Schuller, Oakland, California Mary Strake, Breese, Clinton Co., Illinois Joseph Scheer 2755 Magnslia Avenue, St. Louis, Missouri That your Petitioner is the grantee of all of said heirs and legatees except said Mary Strake as to the Real Estate of which the said Gerhard Ubben died seized and is desired of having the will probated.
