Davenport Democrat Davenport, Scott, Iowa July 16, 1870 THE NELSON TRIAL Agreeable to the instructions of Coroner Thomson, Marshal Kaufman proceeded to file and information yesterday afternoon before Justice Peters, in accordance with the verdict returned by the Coroner's Jury. The preliminary examination was set for 10 o'clock this morning but by mutual consent of the attorneys, the case was adjourned until 9 o'clock Monday morning at which time it will be tried by Justice Peters; probably at the court House, as his court room will not be large enough. Messrs. Martin & Murphy appear for Nelson and J.B. Leake on the part of the State. The victim of the tragedy, William Donovan, was buried yesterday afternoon under the direction of Mr. Boies, undertaker. The memoranda found upon his person, and portions of his clothing were retained by Coroner Tomson in the hope that they may serve as guides to the dead man's identity. There seems to be a considerable discussion as to whether William Nelson, charged with killing Donovan would be entitled to bail if the magistrate should, on preliminary examination, bind him to answer at the District Court for killing. Without expressing any opinion upon the merits of this case, as to whether murder in first or second degree, or manslaughter, we may state the law in reference to bail, as settled by the statutes of Iowa is as follows: Soc. 4962, Rev. of 1808, provides that "all defendants are bailable, both before and after conviction, by sufficient surety, except for capital offenses, where the proof is evident and the presumption great." Now, unless the offense committed by Nelson was murder in the first degree, it is not a capital offense; and in order to constitute the killing, murder in the first degree it must have been a willful, deliberate, and premeditated killing. If upon examination, the proof should not be evident and the presumption great that the killing was murder in the first degree,-if the evidence should make it appear the killing would probably only me murder in the second degree, or manslaughter, then the defendant would clearly be entitled to bail. The following testimony was elicited at the examination of witnesses during the inquest yesterday: Gus Schnitger sworn-...[part missing] ;when I saw him he was lying on the floor; he was alive at that time but did not speak; I was sitting at the corner by the First National Bank; heard the report of a pistol and saw two men run into Nelson's saloon; I then went up to the saloon and found this as previously described; I saw a bullet hole in his right breast; I inquired who did it and Mr. Nelson stepped up and said he did it and asked me to arrest him, which I did by virtue of the authority of my office as Sheriff of Scott county. Green sworn- I saw the person whose body lies here, yesterday between four and five o'clock; he was lying on the floor of the saloon of Mr. Nelson, near the door; Dr. Watt, and old lady, Major Schnitger, Mr. Dittoe and a lady with a red shawl were the persons present, the person who laid on the floor said "arrest that man;" he died I think in about ten minutes after he was shot; I had seen the same person in Nelson's saloon about an hour previous; he was then standing by the counter making considerable noise; he was talking with some other gentlemen; I did not pay much attention to his remarks but recollect him saying that there was some "truly fighting men there" the man he was talking with was a stranger; I did not see him drink at the bar, I think that he was under the influence of liquor at that time. Signed. J.W. Green. W.T. Dittoe, sworn- At the time of the report of the pistol, I was standing with Schnitger and Green at the corner near the First National Bank. We all went up to the saloon together when the shot was fired. I know nothing more than has been stated. Signed. W.T. Dittoe. C.W. Watt, sworn-I was in Mr. Nelson's saloon yesterday afternoon between four and five o'clock; when I first went into the saloon Mr. Porter, of Joliet, Ill., went in with me. Mr. Nelson made an apology to Mr. Porter that he had such a character there that he could not get along with him; he said that it was not usual to have such characters in his place; We passed through the saloon into the back room; when I went into the saloon there were several in there but they soon went out. The man whose body lies here was in the saloon with his coat in his hand and talking quite loud, but was not directing his conversation to any one in particular; he was intoxicated; I passed through the saloon into the back room and seated myself before the door and could see into the saloon; the man threw his coat down; Mr. Nelson picked it up and handed it to him and told him he must go out. He then put him out. The man then came back and swore that he would have a drink; Nelson put him out again; the man then came back like a mad man; he went for Mr. Nelson and struck at him 3 or 4 times. At this time, Mrs. Nelson, the mother of Mr. Nelson came in; the man was still fighting Nelson; the old lady ran up to the man and told him to "desist and not strike her son;" at that moment the man snatched my cane from my hand and made a lick at the old lady. Mr. Nelson grabbed hold of the cane. The man took the cane away from Nelson, and raised it again at the old lady; I said to him, "Oh don't-don't." Nelson had then left the man; he passed me in a hurry, and immediately I heard the shot, and see the man fall; the man was very angry because Nelson had put him out and would not give him any drink; I think at the time the shot was fired that he had his arm raised to strike; after he was shot he said, "You have done it. I am a dead man." I think there was no one else in the saloon at the time except Mr. Nelson and his mother, myself and the deceased. I did not see Nelson do anything but in self defense; I have known Mr. Nelson about two years; have never known of his having any trouble in his saloon previous to this time. Signed. C.L. Watt Dr. W.F. Peck sworn-I am a physician and surgeon. I have examined the body of the deceased. There was an orifice just above and to the left of the right nipple. Dr. Maxwell and myself made a post mortem examination. We traced the orifice through the upper portion of the second and the lower portion of the first lobe of the right lung. It also pierced the large blood vessel which carries the blood from the heart to the lower extremities. The ball passed into the bone of the spinal column. We found this ball (showing small leaden ball about 1/4 inch in diameter to the jury) in the spinal canal in the body of the eleventh vertebrum. He died from hemorrhage and the shock produced by the laceration of the above named tissues. The injuries were such that he could not live but a few minutes. The right side of the chest was full of blood in quantity of about three quarts. Signed. W.F. Peck Dr. A.S. Maxwell, sworn- I am physician and surgeon. I assisted in the post mortem of the deceased: I have heard the testimony of Dr. Peck. The injuries were such that his arm must have been raised at the time of receiving the shot. I agree with Dr. Peck in his statement of the post mortem appearance and that the injuries were the cause of his death. Signed. A.S. Maxwell. C.L. Watt (at his own request) recalled.- I wish to make a statement as to who was in the room at the time the shooting took place. A man came running in after the deceased came in the last time; I do not know the man's name; he is a hack driver. Signed. C.L. Watt Phillip Racquet sworn- As I was coming up Main street yesterday, about 5 P.M., I saw a man being pushed out of Nelson's saloon; the man got up and went in; after I had passed about twenty feet, I heard some one hallooing in the saloon-(sounded like a woman's voice), I then went back and looked in at the door; I heard the shot and then the man fell down; I then went in and saw the man lying on the floor. Signed. Philip Racquet. L.A. Pearce sworn- I was in Mr. Nelson's saloon yesterday afternoon about 5 o'clock. The first I saw of any trouble, I was coming though the alley opposite the saloon; I heard a noise in Nelson's saloon; I saw Nelson put a man out of his saloon and into the street; the man said, "You s-- of a b----, I will get the better of you yet." this was said to Nelson; the man went into the saloon again; I tied my horses; after I had and while I was going to the saloon, Nelson put the man out again; I then followed the man in; after the man got in he said, "you s-- of a b----, are you going to give me a drink? Nelson told him, "You have a plenty; I want you to go out," and then went towards him; the man struck at Nelson three or four times; while they were scuffling Nelson's mother came into the saloon and cried out for them to stop. The man then snatched a cane from Mr. Watt, who was standing by and struck the old lady. After he struck at Nelson's mother Nelson caught hold of the cane and got it away from him. The man soon went for Nelson again and took the cane away from and struck at him again; then Nelson ran behind the bar and drew out a drawer and took out a pistol and shot the man as he was in the act of striking his mother. The man fell as he shot, and died within five minutes; the deceased seemed to be very desperate; after the man fell I asked him what his name was and he said "William Donovan;" I asked he where he was from and he made no reply; Mr. Nelson came to me after the man was shot and said, " I have shot him; am sorry; go and enter a complaint and have me arrested, and bring some doctors. The Daily Gazette Davenport, Iowa Thursday Morning September 18, 1862 The Girls at Work.-The following note explains itself, and shows how much the juveniles can do when they try: Princeton, Scott Co., Iowa Mr. Eldridge, P. M., Davenport: Sir: We send one small box of lint and bandages gotten up by four small girls of this town. Their names are as follows: Mary M. Crouse, Mary J. Zimmerman, Fidelia E. Blackman, Rosa Warner. Mrs. Jane Warner, of Princeton, also sent two boxes of lint and bandages very nicely prepared for use. These were at once forwarded, with other supplies, to Mrs. Wittenmyer, at Corinth, Miss. Organize the Militia.-The Legislature at its extra session, as is known, passed an improved militia bill, but its provisions are not generally understood. The entire militia of the State are required to organize and drill themselves immediately, and the distinction between the active and reserve militia force is abolished. The Governor is authorized to issue a proclamation requiring the militia to assemble for drill at certain times. A failure to attend at such times, will be punished by a fine of one dollar. The Governor may authorize the formation of the militia into regiments, brigades and divisions, whenever he deems it necessary. It is thought the Governor will issue a proclamation in accordance with his bill, requiring a meeting for drill once in two weeks. Hon. James T. Lanes, of this city, is the author of the bill, which the Legislature didn't think they could improve on, and so passed it just as he introduced it, without a single alteration of any kind. Now that we! have the law, let us go to work and get up our companies right off. No time ought to be lost. Arrival of Prisoners.-The western train, last evening, brought in a number of persons arrested in the vicinity of Des Moines, on charges of disloyalty. They were in charge of Deputy U. S. Marshal Bowers. Their names are: C. C. Mann, John Galinger, James Naylor, John Beele, W. Evans, Jas. Evans, Vol. Gideon, Jack Porter, Joseph Gideon, ___ Knight, and Squire McCartey. They are said to comprise President, Vice President, Secretary and members of the K. G. C. Seven of them are from Madison county, three from Clark and one from Polk. The prisoners were escorted to Camp McClellan. The Exempts.-Commissioner Thompson and Dr. Baker have about finished up the exemption business. Looking over the list of those who have applied for exemption, we have been very much alarmed for the health of the community at the sight of some of the names which appear on the list-names of men who have always been supposed to enjoy their brags of how much they could endure, and talked patronizingly to weaker bodies. Now, when those men are too feeble for military duty, what must be the condition of the general health of the county? No wonder the doctors are all making money. Maines and Clarence Cahill have filed an answer in which defendants deny each and every allegation of plaintiff and claim that plaintiff's wife and son were guilty of contributory negligence. It is a case in which two vehicles collided. In the suit to recover property conveyed on verbal statement that defendant would keep her as long as she lives, entitled Susan J. Glaspell vs. Charles S. Glaspell, the defendant files a motion for a more specific statement. A motion for security for costs has been filed by the defendants in H.P. Reiering vs. Dr. D.D. Palmer. This is the case in which Reiring, who was a student with Dr. Palmer, claimed to have been falsely imprisoned on a warrant sworn out by Dr. Palmer as a means to intimidate him and stop him from securing $300 paid as tuition. In the divorce case of Mary S. Ritzer vs. H. A. Ritzer, the defendant denies allegation in petition of plaintiff in an answer filed today. An answer has been filed in the case of Eugene Murray vs. David and Henry Thomas a case in which plaintiff seeks damages for great bodily injury. The answer alleges that any force used by defendants was in self defense. In the guardianship of Michael Heffron, asked for by Mr. P. Bout, the defendant asks for a more specific statement. FOLLET'S STATION IS OPENED Today was a big day for the people near Folletts between Princeton and Camanche. It was the occasion of the formal opening of the new station at that place. The new depot is situated five miles from Princeton and is a neat structure sutiable for the conditions of the business that will be found there by the D.R.I. and & N.W. road. The opening is being celebrated by the people for miles around who have assembled to listen to the address which was made this afternoon by L.F. Berry, the general passenger agent. Besides Mr. Berry Auditor Roach and Engineer Finley are present at the opening of the station. Several thousand people are at Follets today.     2. SIXTEENTH ALWAYS ON DUTY The Sixteenth Regiment Iowa Infantry Volunteers left Davenport March 20, 1862, was engaged in the battle of Shiloh, April 6th and 7th, meeting with heavy loss; took part in the siege of Corinth, camped at Corinth from its evacuation till July 28th; marched to Bolivar, Tennessee; made a reconnoissance to Summerville, August 23d, returning to Bolivar on the 26th; left September 11th for Corinth, and thence was sent out to reconnoiter the position and forces of the enemy at Iuka, September 17, returning to Brownsville; were ordered to Jacinto, Mississippi, where they joined Rosecrans' command.  The regiment again marched on Iuka, was engaged in the battle of Iuka, September 19, 1862.  The regiment again arrived at Corinth October 2d; was engaged in the two days' battle of Corinth, October 3d and 4th, and pursuit of the enemy to Ripley; returned to Corinth on the 11th; was in camp till November 2d; marched to Grand Junction, camped till November 28th; marched to Holly Springs, passing through the town; arrived in front of the enemy's fortified position on the Tallahatchie river on the 29th.  The enemy was forced from its position November 30th.  The regiment crossed the river December 2d and went into camp; was engaged in guarding and building the railroad bridge across the river; marched to the south of Oxford, Mississippi, on the 19th; returned to Holly Springs on the 21st; in camp till December 29th.  Marched to Memphis, embarked on transports for Young's Point; arrived on the 24th and remained till the 29th; moved to Lake Providence, Louisiana, where the regiment remained till April 21st.  Returning to Milliken's Bend, marched by way of Richmond, Louisiana, to Grand Gulf, thence to Vicksburg; was engaged in the operations against the latter place May 22d.  The regiment was in the expedition to Mechanicsburg under General Blair; returned to Vicksburg, June 1st; engaged in the siege until the 23d; marched to Black river; guarded the crossing till the fall of Vicksburg; had a sharp engagement with the enemy July 4, 1863; part of the regiment having crossed the river and driven the enemy from his position on the opposite bank.  July 12th was ordered to reinforce General Sherman at Jackson and bring up an ammunition train. Jo. Johnson having evacuated Jackson, the army returned to Vicksburg July 28th; camped near Vicksburg till the 6th of August.  The regiment was engaged in the march to Monroe, Louisiana.  Returning to Vicksburg, remained in camp till the third day of February, 1864, when they started on the Meridian campaign.  After a march across the entire state of Mississippi, returned to Vicksburg March 4, 1864; left Vicksburg March 17th on veteran furlough.  The regiment again started from Davenport, Iowa, May 3d; arrived at Clifton, Tennessee, about the middle of May; marched to Huntsville, Alabama, arriving at the latter place May 22d; marched to Decatur, Alabama; thence across the mountains to Rome, Georgia, where they arrived on the 5th day of June.  Starting agian the next morning, joined the main army under Sherman, near Acworth, on the 10th; arrived in front of Kenesaw mountain on the 11th; had a sharp engagement with the enemy June 15th; the regiment was engaged in the attack on Kenesaw mountain June 27th, meeting with heavy loss.  The regiment was under the enemy's fire from June 14th to July 2d; moved from left to right of the line, meeting the army again July 4th; had another sharp engagement, driving the enemy.  On the 5th the Sixteenth again had the advance, driving the enemy from his fortified position and across Nick-a-jack creek; were under fire of the enemy until the 16th day of July, when the rebels were compelled to cross the Chattahoochee; the regiment was then marched to Rossville, where it crossed the Chattahoochee river and pushed on for Atlanta; was engaged in the battles of July 20th and 21st, meeting with heavy losses in killed and wounded and receiving General McPherson's special compliments.  July 22d, when Hood made his famous charge that opened the battle of Atlanta, the Sixteenth Iowa, flanked in the right by the Eleventh, on the left by the Fifteenth, with the Thirteenth Iowa in the rear, all forming "the old Iowa brigade," was at the main point when the charge was made.  The Sixteenth captured more of the enemy than it had men in its ranks, but was eventually surrounded and captured in turn and taken to Andersonville.  But in a short time, being exchanged, they rejoined the army under Sherman.  The regiment was increased by recruits and started from Atlanta, November 15th; marched to Savannah, before which place it arrived December 10th; after much hard marching, skirmishing, etc., drove the enemy behind their fortifications. At Savannah this regiment was the first to seize the Savannah & Charleston railroad, and under directions of Brigadier-General Belknap commenced destroying the same; was engaged in the siege till the evacuation of the city; marched to the suburbs of the city and went into camp on the 21st, where it remained getting ready for the next campaign.  After a review of the entire army by General Sherman, the Sixteenth was put in motion January 6, 1865, for Beaufort, South Carolina; marched against Pocataligo January 15th, the Seventeenth corps (to which the Sixteenth belonged) driving the enemy out of his strongly fortified position; remained here at Pocataligo until the 28th, when the new campaign commenced. Marching to Rivers bridge, on the Salkahatchie, met the enemy strongly fortified.  At this point the Salkahatchie forms an almost impenetrable swamp about two miles wide, which was waded by the Fourth division, Seventeenth army corps, on the 3d of February, 1865; drove the enemy from their position; continued the march, driving the enemy before them, capturing every place which they attempted to hold, and after encountering many hardships, privations and dangers, arrived at Goldsboro on the 22d of March, 1865.  Remaining at Goldsboro, North Carolina, until the 10th of April, the regiment was again on the march in search of the enemy.  Pushing forward the command entered Raleigh on the 16th; camped till the 2d of May. The war being brought to a close, the command marched for Washington, where it took part in the grand review, may 24th; left Washington June 7th and arrived at Louisville June 12th. During the period embraced herein, the regiment suffered severly in killed, died of wounds received, or of disease contracted in the line of duty.  It may truly be said of the Sixteenth, it was always at the front, oftener, perhaps, under order than it wanted to be, but never in battle or march did it fail in the performance of its whole duty.
