Jagger of Stamford in ye County of Fairfield and Colony of Connecticut, I upon consideration of ye Administration of ye estate of my deceased father distributing; and further upon my own free agreement. . . fully and absolutely make over . . . for ever unto my Brother-in-Law Benjamin Hayt Jr., of Stamford and his sons for ever certain parcells of land ye contents as followeth, viz a certain homlott scituate in Stamford, lying neere ye north side of ye town, Containing one acre and half, bet more or less, bounded by John Ambler north, and by Ben Hait south, butting to ye highway or street east and west: as also one fift part of ten acres of Land Laid out neer [?], so called, and also one fift part of thirty seven acres of Land Laid out, upon ye Dead plains so called, and also one fifth part of ye land commonly called sequest? land, and also one fifthe part of all ye lands unlaid out belonging to ye estate:. . . I ye sd Jeremy have and do by those peresents, fully and absolutely make over, unto ye sd Benjamin Hayt, with all Rights and privileges and appurtenances, of or belonging to sd Lands, quietly to possess and enjoy ye same in a full and free manner, Given under my hand this 18th of April in ye fourth year of her majesties reign Anno Dom 1705 sign'd so also and delivered in presence of Elisha Holly Joseph Harris Jeremy Jagger The above bill of sale is acknowledged by ye granter--ye date as above Before me David Waterbury, Justice of the Peace folio 424 Document 1 Abraham Hoits sale from John Arnold Received to [?] April 19th, 1770 and Recorded by Samuel Jarvis Town Clerk Book H page 277 Know All Men by these Presents that I John Arnold of Stamford in the County of Fairfield and Colony of Connecticut in New England for the Consideration of Sixteen Pounds Five Shillings New York Money Rec'd to my full Satisfaction of Abraham Hoit of Stamford [above ?] give grant Bargain Sell and Confirm unto the Said Abraham Hoit and to his Heirs and Assigns for Ever a Certain Tract or Parcel of Land Situate Lying and being in Stamford above [?] in the North Field Containing one Acre and a Half and Twenty Rods and is thus Bounded Easterly by a High way Northerly by Nehemiah Bates [Junior?] Land West by the Mill River and South by the Above said John Arnold's Land to have and to hold the Above granted and Bargained Premises with all the Privaledges and Appurtenances to the Same belonging Unto him the Said Abraham Hoit his Heirs and Assigns for Ever to his and their own Proper Use and behoof and Also I the Said John Arnold for my self my Heirs Executors and Aministrators Do Cov! enant with the Said Abraham Hoit his Heir and Assigns that at and Untill the Ensealing of these Presents I am well [feifed?] of the Premises as a good indefeasable Estate in fee simple and have a good right to Bargain and sell the same in Manner and form as is Above Said and that the Land is free and clear of all Incumbrances Whatsoever and Furthermore I the said John Arnold Do by these Presents bind my self and my heirs for ever to warrant and defend the above bargained and granted premises to him the said Abraham Hoit his heirs and assings against all Claims and Demands Whatsoever in witness whereof I have hereunto set my hand and seal this 19th day of April in the year 1770. Sign'd Seal'd and Delivered in Presence of John Arnold Abraham Davenport Silas Davenport Colony of Connecticut as in Stamford on the day of the date above personally appeared John Arnold Signer and Sealer of the above written Instrument and acknowledged the same to be his free act and deed Before me Abraham Davenport Assistant Document 2 Abraham Hoit and Nathan Middlebrooks agreement Rec'd November 28th, 1761 And Entered In Book G folio 28 ? me Samuel Jarvis Town Clerk This agreement made in Stamford in Fairfield County and Connecticut Colony in New England this twenty fifth day of November anno Domini-one thousand seven hundred and sixty one by and betweeen Abraham Hoit of Stamford aforesaid on the one part and Nathan Middlebrook of Stamford aforesaid on the other part witnesseth that whereas the said partys have each of them a tract of land in Stamford aforesaid near to the said Hoits dwelling house on the east side of the highway which goeth up by said dwelling house said Hoits said tract of land being bounded northerly partly by said Middlebrooks his land and said Middlebrook's his said tract of land being boudned southerly by said Hoits said land and the line dividing said tracts is conserderably crooked and the said partys have supposed it would be for their mutual advantage to alter said line in some parts of it and accordingly have some years past verbally agreed to erect a fence in such a manner as to include a small quantity of s! aid Middlebrook's said tract of land within said Hoits enclosure and a small quantity of said Hoits said tract of land with said Middlebrooks enclosure and said fence hath been erected according to said agreement and the said partys are desirous to confrm the place where said fence now stands to be the dividing line between said tracts of land-- be it known therefore to all whom it my concern that the said Abraham Hoit for himself his heirs etc for and in consideration of the following release of said small piece of said Middlebrooks said tract which lyeth south of said line of fence doth Re[?], Release and forever quit claim unto the said Nathan Middlebrook in his full and peacable posession and ? in and to his heirs and assigns forever all his right title and interst in that part of his said tract which lyeth north of said fence and the said Nathan Middlebrook for himself his heirs ? for and in consideration of the above release from said Hoit doth Remise? Release and fore! ver quit claim unto said Nathan Middlebrooks in his full and peacable possession and ? to his heirs and assigns forever quit claim unto the said Abraham Hoit in his full and peacable posesion and ? to his heirs and assigns forever all such right estate title and interest as the said Middlebrooks had hath or ought to have to that part of said tract which lyeth south of said line of fence as it is now erected and the said partys do hereby ratify and confirm said line of fence as it is now erected in the following manner with respect to the maintenance of said dividing line of fence ? that the said Abraham Hoit his heirs and assigns shall have and maintain the one half at the west end and that the said Nathan Middlebrook his heirs and assigns shall have and maintain the one half at the East end hereof put their hands and seals on the day of the date first above mentioned signed sealed and delivered in presence of Gabriel Smith Hannah Brush (Brufh) Abraham Hoit Nathan Middlebrook Fairfield County In Stamford on November 28th A.D. 1761 personally appeared messrs Abraham Hoit and Nathan Middlebrook signers and sealers of the above written instrument and acknowledged the same to be their free act and deed before me Abraham Davenport Justice of the Peace Document 3 The 20th Dec. 1688 Copy Witness these presents that I Hannah Finch administrator to my husband Joseph Webb dec'd his estate and Daniel Westcott overseer of the aforesaid estate the townsmen having demanded of us a supply of a sufficient man to manage the mill which was in our hands for a supply of the town according to covenant or else a resignation of the said mill into the hands of the townsmen for the use of the town we having seriously considered the matter and used our utmost endeavour to fulfill the covenant finding our selves utterly incapasitated to peform the conditions of the covenant we do therefore by these presents absolutely resign the said mill with all the appurtenances thereto belonging unto the aforesaid townsmen for the use of the town to have and to hold and to improve for their best advantage and in consideration of the abovesaid resignation of the mill the town have paid unto the estate of Joseph Webb dec'd the sum of twenty pounds it is to be u! nderstood that the mill and the mill dam is resigned up to the townsmen for the use of the town as witness our hands and seals this 19th of Dec. in the year of our Lord 1688. Witness Jonas Seely Signed and Sealed their Red Wax Joseph Bishop Daniel Wescott Hannah The mark H Finch The above is a true copy of record exam'd by Samuel Jarvis Town Clerk Document 4 Received Stamford February 24th 1792 of Silas Hoit and Thaddeus Hoit of Stamford forty shillings lawful money in full for my right in a tract of land set out to my deceased mother Prudence Woolsey late of Norwalk deceased being part of the real estate of Daniel Bates deceased which belonged to her as heir to said deceased Bates--Sarah X her mark Maden Samuel Mather Gilbert Wolsey I David Bates of Stamford do hereby engage that the said Silas and Thaddeus shall never be molested by the said Sarah Maden or her husband William Maden or their heirs in the quiet [?] and posession of the above described land engage to pay all damages that shall be sustained by the said Silas and Thaddeus if they should be disturbed in the enjoyment of said right of land by said Sarah and William or their heirs or assigns.
