The question of beer selling in rooming houses was again brought up in police court this morning. The case was against Mrs. Lillian HORTON of 1508 Walnut street. She was arrested Thursday night. A patrolman said that he had bought beer in the place. In police court this morning Mrs. HORTON said that she had first gone to Captain FLAHIVE at No. 4 police station for permission to sell beer. He told her that she would have to go to higher authority. She said that she then went to John HAYES, chief of police. He told her, she said, that, according to a recent order issued by the board of police commissioners, she could be allowed to get beer for patrons as an accommodation by sending to a saloon for it, but that she would not be allowed to sell it. According to her own testimony in court this morning, Mrs. HORTON had collected fifty cents a bottle for the beer, thus making a profit of thirty cents, as she paid only twenty cents at the saloon for it. She said that she charged this amount for service. Judge KYLE fined the woman $25. "It is not a question of where you get the beer," he said, "whether from the saloon or from the brewery. It's the selling that counts.
