    3. James Henry was the son of Henry Henry and Mary. The family lived in the triangle of land between War Branch and Muddy Creek, in the part of Augusta Co. that became Rockingham Co. VA. He married Elizabeth Green 1 Mar 1803 in Rockingham Co. VA. The bondsman was his brother John Henry. The minister was Benjamin Erwin. The following shows the sale of James Henry's land to his brother Samuel Henry of Harrisonburg, Rockingham Co. VA. The sale was in in 1814. Where did James and Elizabeth Green Henry go after they sold this land, or did they stay in Rockingham? If they moved, the area around Scioto, Ross Co., OH would be a possibility, as is East TN. This Indenture made the Fifteenth day of February 1814 by and Between James Henry and Elizabeth his wife of the County of Rockingham and state of Virginia of the one part and Samuel Henry of the same county and as aforesaid of the other part witnesseth that the said James Henry and Elizabeth his wife for and in consideration of the sum of one thousand six dollars to them in hand paid by him the sd Samuel Henry the receipt whereof the (the repeated word) said James Henry and Elizabeth his wife doth hereby acknowledge acquit and discharge him the sd Samuel Henry. They the said James Henry and Elizabeth his wife hath granted bargained sold aliened and confirmed and in these presents doth grant bargain sell alien release and confirm unto the said Samuel Henry his heirs and assingees forever all their rights interests in and title to a tract to tracts of land whereof Henry Henry died siezed containing by Estimation three hundred and seventy nine acres or the same more or less w! hich said lands are bounded as follows to wit the first tract containing eighty acres which was conveyed unto him the said Henry Henry by William Chestnut by deed or lease and release Dated the thirteenth and fifteenth day of February 1763 and was recorded in the County Court of Augusta. Beginning at two pines corner to David Callehan Land on Greens old line and thence with Callahan's line North forty four degrees ____ poles to a white oak and thence north thirty five degrees East one hundred and twenty pXXX (poles) line of Wood ('s) land and with the same south forty ____ degrees eighty poles to a pine on the old patent line___with the same south thirty five degrees west one huxxx (hundred) and twenty poles to the Beginning. The other tract __ containing two hundred ninety nine acres bet(ween) ___ courses with bounds (courses being War Branch and Muddy Creek, I think) sixty three acres more which ___ sixty three acres was parted with by him the said Henry Henry before his! Death beca___ (?) in the title of in and to the said three hundred an d ___ two acres of Land by a deed of Bargain and Sail (sale) Date X (Dated) (the) 19th day of August 1777 from Thomas Oneal and now xx (recorded) in the County court of Augusta beginning at a white oak in Woolwood's line thence south Twenty Degrees East one hundred and twenty poles to three pines Thex (Then) ___ fifteen degrees west two hundred and thirty poles near the creek ___ north seventy five degrees west one hundred and twenty eight poles to three ____ Thence north fifty degrees one hundred and forty two poles tx (to) ___ hickory saplins near Woods and Greens line. Thence north ___ ty degrees East three hundred and forty-two poles to ___ (the) beginning together with all the interest that he the saxx (same) James Henry hath as a Legatee in the last will and txxament (testament) of his father Henry Henry Deceased and as rexxx (recorded) in the Court of Rockingham Dated the 20th Day of xxber 1798 all of which the said three hundred and Sxxx nine acres or whatever is co! ntained within the aforesaid ___ is and distances by the same more or less excepting one ____ what was before excepted by the same more or less belonging to and InterXXXX---- the said tracts of land with their and every of their appurtenances unto the same Samuel Henry and his heirs and asxxx (assignees) forever to the sole use and behoof of him the said Samuel Henry and his heirs or assignees forever and the said ____ (James) Henry and Elizabeth his wife and their heirs all and (Sirxxx?) the Premises heretofore granted shall and will foxxxx (forever) to time and at all times hereto warrant and ____ defend our rights to and Interests ______ aforesaid with the appurtenances unto him the said Samuel Henry and his heirs and assignees forever against the just claim of any person or persons whatsoever. None are major errors. These records were burned in a wagon during the Civil War, but later people could take them to the courthouse to record them again. As Samuel Henry was a merchant on the court house square and lived to a ripe old age, he took in the deeds that partained to his transactions/lands. Also the deeds of his brother John Henry who went to Jefferson Co. TN were taken in and recorded again. These are in books called Burnt Record Books in Rockingham Co. VA, and the Court House staff are very good about letting people view them, copy them, etc.
