    3. Dear All, I have read in several places that back during the nineteenth Century (and, of course, prior to), a lot of births weren't officially recorded. If the births weren't recorded, then the mother could name the child anything she wished. Additionally, often, a child would take the name of the family with whom the child was living if the child's birth family was, for whatever reason, out of the child's life. D. L. Hatcher, Esq. 2. I am a lawyer in Texas. Are you asking about the status of the law in 1857? You would need to research the state statutes from where he was born. It is not true at this time, at least in Texas, that a child has to carry his mother's name if the parents are not married. This also leaves no doubt in my mind that Jane Eichelberger was the dau of Casper E/Mary Hatcher. Jane was bn c1834 so not 14 yrs old, but 18, at birth of 1st kid. I also believe Casper Louis had to be Jane's kid and that she died in childbirth. The only problem here is that the date of her death and his birth date are a tad "off." But I also can't prove Casper's real date. I also know that the months Jan and Jun can often be a problem for transcribers. While I have not a bit of proof, I really do think that dau, Lydia, was the mother of Harry M and Fred Marshall Hatcher, supposedly "sons" of Abel and Phoebe and that Lydia died before 1880. Just for giggles, I checked the Logan census and found a Wm Marshall of the right age as a prisoner in the LoganCo Sheriff's jail. Nel

Do you know why Maude was raised by James and Mary M? Since she was illegitimate, what happened to her mother? Did she die? Was Maude born in LoganCo? Nel, I don't know, I didn't find her birth. I never checked Sandusky. Sandusky is not in Sandusky county, it is in Erie county today. I don't know where it was in 1872. James Duncan HATCHER was her father and Mary Malinda (DUNCAN) HATCHER was her aunt. ________ DUNCAN may not have known she was pregnant until she got back home. Maybe her brother,  Anderson brought the baby to Logan county. By 1872 Zachariah's family was probably scattered all over. Also, unless we find more children for Zak, Maude's mother would have been at least 39 years old at birth. Excerpted from Memoirs of the Miami Valley, Vol. III, Page 328 : James Duncan HATCHER was born in Perry Twp.,Logan,Ohio and here reared and educated. He grew to manhood around East Liberty, Perry Twp., Logan county, Ohio and Mount Tabor, and as a young man taught school for one term. Also, he learned the trade of cabinet maker, at which he worked for some years at Rushsylvania. Farming, however, was the principal occupation of his life, and after leaving Rushsylvania with his family he purchased a property in Hardin county, on which he carried on operations for eight years. Returning to Logan county, he resumed operations in Perry Twp. , January 11, 1874, on a small rented property, which continued to be his home eight years. He then bought a small property, in addition to which he rented other land, and carried on his operations as an agriculturist on these tracts until his death in 1899, his widow surviving him three years. They were the parents of five children, of whom three survive: John A., Libbie and James Orlando. James Duncan and Malinda (DUNCAN) HATCHER were listed with his father's family in the 1858 Salem township, Champaign county, Ohio Census, as a carpenter. According to Freda Lucille HATCHER, his great-granddaughter, and family tradition, he was the father of at least two illegitimate children. One of which was with his sister-in-law, ________ DUNCAN. They had a  daughter, Maude, on 2 Jan., 1872 when James Duncan HATCHER was almost 50 years old. Maude was raised by her father and aunt, Mary Malinda (DUNCAN) HATCHER. He had another child named Lydia or Margaret whose mother was possibly Lydia or Margaret MOWRY? or LOWERY. She was unsure. Lucille also vaguely remembered talk of another child with a different mother - details unknown. Excerpt of letter from Roger Paul HATCHER, PhD., relating stories told to him by his father Paul HATCHER (nee Robert Paul HATCHER): "One of his favorite stories had to do with Maud INSKIP [Maud E. (HATCHER) INSKEEP - JPH] , the illegitimate daughter of James Duncan HATCHER. Dad said that James was a rather vain man who worked as a cabinet maker and  at times, as a teacher in town (East Liberty?). He fancied himself as a ladies' man and always kept himself looking sharp. Dad said that he had James' silver combs among his possessions. He always laughed that James carried these combs around to keep himself looking good for the girls." James Duncan HATCHER died of bowel cancer. ------------------------------ Message: 4 Date: Wed, 2 Dec 2009 17:59:01 -0700 From: "nelhatch" <[email protected]> Subject: Re: [HATCHER] The Hatchers and Duncans - a question To: <[email protected]> Message-ID: <[email protected]> Content-Type: text/plain;    charset="iso-8859-1" HATCHER website: http://hatcherfamilyassn.com HALL DNA project: http://homepages.rootsweb.com/~nhatcher/hall/HDNAtest.htm "One of the tragedies of life is the murder of a beautiful theory by a brutal gang of facts" - La Rochefoucauld Paul, That's kind of an ah-hah moment. Anderson [maybe] brought the baby to LoganCo? But why does that necessarily mean Maude was James' kid? Her mother may well have been one of Anderson's sisters but maybe this sister died in childbirth and Maud's father couldn't raise her for one reason or other. Is that possible? Right now I know that sister Margaret was still alive in 1880. I'm considering her as a possibility. But I'm having trouble finding sister Elizabeth after the 1850 census - don't know if she's dead or alive in 1872. I could be wrong but I'm almost guessing Maude was not an infant if Anderson brought her to Logan. Somehow I don't see this guy changing diapers mile after mile. And that's another thought. Anderson was born c1810. Now I have to wonder why this 65-70 yr old man got stuck with the job.....hmmmm! So now I'm really wondering....was she really James' dau? Or perhaps that was assumed because she was listed as a dau in the 1880 census? Hmmm, hmmm, hmmm! Things to consider.........! But no, there are no other children for Zach. The sale of those 1/7 parcels by the kids after Zach died tells us how many living kids he had. And we've got them all accounted for. She knew Maud very well for many years and Maude knew who her father was, but I don't think Lucille knew Maude's mother, if Maude even knew her mother. She may have died in childbirth. She was pretty old to be having children. Who knows, the mother might even have been married. Anything can turn up when one stirs the pot. Most of the Duncans settled in Kentucky, but not this branch. ----- Original Message ----- From: "nelhatch" <[email protected]> To: <[email protected]> Sent: Wednesday, December 02, 2009 8:42 PM Subject: Re: [HATCHER] The Hatchers and Duncans - a question > > HATCHER website: http://hatcherfamilyassn.com > HALL DNA project: > http://homepages.rootsweb.com/~nhatcher/hall/HDNAtest.htm > "One of the tragedies of life is the murder of a beautiful theory by a > brutal gang of facts" - La Rochefoucauld > > OK - I think there are too many possibilities here to ever come up with a > solid answer.....so I think I'll toss this one in the closet with the > other skeletons :-) > > Thanks, Paul!! > > Nel > > ------------------------------- > To unsubscribe from the list, please send an email to > [email protected] with the word 'unsubscribe' without the > quotes in the subject and the body of the message > ------------------------------ Message: 8 Date: Wed, 2 Dec 2009 18:56:18 -0700 From: "nelhatch" <[email protected]> Subject: Re: [HATCHER] The Hatchers and Duncans - a question To: <[email protected]> Message-ID: <[email protected]> Content-Type: text/plain;    charset="iso-8859-1" HATCHER website: http://hatcherfamilyassn.com HALL DNA project: http://homepages.rootsweb.com/~nhatcher/hall/HDNAtest.htm "One of the tragedies of life is the murder of a beautiful theory by a brutal gang of facts" - La Rochefoucauld When I get to OH on Findagrave, I'll take a look for them.
