State of GA, Franklin County 28 July 1842/5 Sep 1842 In the name of God Amen I Benjamin Harrison of the County and State aforesaid being sick and weak of Body but of sound mind and disposing memory, And Knowing that it is appointed for all men once to die, do make & ordain the following my last will and Testament, that is to say first of all I accomend my Soul to God who gave it, and my body to the earth from which it came to be buried in a decent Christian Burial at the discretion of my Executors and friends ~ Item 1st I give and bequeath to my dearly beloved wife Elizabeth during her natural life, one hundred dollars a year to be paid to her by my Executors, also three negroes to wit Burrell, Clarissa and Louisa - Also three beds & furniture one mule and carry all, all of which is to be disposed of at her death as herein provided for except the beds & furniture which is to be at her own disposal - Item 2nd I give and bequeath unto my granddaughter Avaline Burton daughter of John H Burton four negroes to wit, Milly & her three children Caroline; Ben and Jack, the said negroes to go into the possession of John Morris & his wife to be held by them untill the said Avaline becomes of age or marries, the said John & his wife to board cloath & educate the said Avaline for the use of the said negroes as above stated and I would prefer the said Avaline should live with the said John & his wife until she arrives at age or marries. Item 3 I give and bequeath unto the children of my son Terrell L. Harrison all that part of the tract of land whereon I now live that lies on the south side of the River, except what I have heretofore given off to John H Burton. Also one negro girl named Phillis. Also one bed & stead of furniture, & one desk and Bureau, & one clay bunk mare, and her colt & one sorrel filly two year old. Item 4 I give and bequeath unto my son-in-law Larkin Harrison one negro woman named Mima, And to the children of my daughter Frances Harrison I give & bequeath two negroes to wit Ann & Oliver, I also give to Nany Harrison daughter of the said Francis Harrison one negro child named Manda. Item 5 I give and bequeath to my son in law Talmon Harbor one negro woman named Anna, and one tract of land containing three hundred acres more or less as conveyed to me by ______ Fowler adjoining Wm H. Chumbley on the waters of nails Creek - Item 6 I give and bequeath unto my son in law John Morris one negro boy named Solomon Item 7 I give and bequeath unto my grandson Benjamin H. Burton one negro boy named Bob. Item 8 I give and bequeath to the two sons of my deceased daughter Elvira Caldwell four hundred dollars to be placed in the hands of John Morris to be paid to them when they arrive at age or sooner if he thinks it will be prudent to do so, And to the infant daughter of the said Elvira I give and bequeath one negro girl named Jane & in case the said child should die in her minority the girl Jane is to be the property of my daughter Polly Morris. Item 9 I give and bequeath to my niece Harriett Harrison all the title & interest I have in & to two hundred acres of land more or less on the waters of Lightwood Log Creek as conveyed to me by John C Payson Item 10 It is my that the balance of my estate both real & personal (including the portion given to my wife in reversion, which is not to be sold untill after her death) (after paying the foregoing legacies and all Just debts.) to be sold in such manner and at such times and plans as my Executors may think best and the proceeds to be equally divided between the following children to wit John B Harrison John Morris David Dumass Evaline Burton and Elizabeth Cawthorn. It is my will that the said Elizabeth Cawthorn have out of the above twelve hundred dollars in addition to her distributive share Item 11 It is my will that if my son in law Terrell L Harrison should within two years from this time relieve himself from the Judgements that are now against him, that the property given to his children in the third section of this will shall belong to & be the property of the said Terrell L. instead of his children as provided in said section- Item 12 I give to the children of my son Terrell L. Harrison in the one section part of my present crop And Lastly, I do hereby constitute and appoint my son John B Harrison & my son in law John Morris & David Dumass Executors to this my last will and Testament, hereby revoking all former wills by me made hereby notifying & em____ This my last will & Testament.
