Will of John Kains, dated 6 January 1767 John Kains of the County of Culpeper and Parish of Bromfield To my grandson John Harriss that part of my land that lies on the east side of Comical Run altogether with the houses and plantations whereon I now live. To Joseph Harris and his wife that part of my land that lies on the west side containing 150 acres together with the houses and plantations whereon he now lives. I do constitute and appoint my friends Hermon Spilman and John Stincyfer Junr. to be executors. John Kains Wit: Hermon (X) Spilman, John Stinesyfer, John Henry Stinesyfer This day came Hermon Spilman, John Henry Stinesyfer, Anne mary Huffman and made oath that John Kains, dec., did about an hour before his death in his perfect sences at his own dwelling house give all his estate he was then possessed of, not given by will in writing, to John Harris, except one bed and cap box to Barbary Harris, the said Barbary to have her choice, and a small box to Eve Harris. John Thomas also declared on oath that sometime before his death or sickness he heard the decd. John Kains declare to the same purpose. Certified under my hand 24 January 1767. W. Brown The proof being offered to me within three daies after the death of the said Kains. W. Brown 19 March 1767. Proved by the oath of Hermon Spilman, John Henry Stinesyfer and John Stinesyfer Junr. Also a nuncupative will was proved by the oath of the said Herman Spilman, John Henry Stinesyfer and Ann Mary Huffman. Herman Spilman and John Stinesyfer Junr. the executors in the former will mentioned refused to take the burthen of the execution thereof.
