This was written in Kathryn Higgins "Harris Papers", Vol. 2, p. 161-162 WILL OF SHERROD HARRIS II (1797-1869) of MARSHALL COUNTY, MISSISSIPPI I, Sherrod Harris of the County of Marshall and State of Mississippi, being of sound mind do make and publish this my last will and testament, and first I give and bequeath to my beloved wife Rebecca Harris the following described land with all appurtenances thereto belonging during her natural life (to wit) beginning at the half mile stake in the north boundary line of section 36 in Township 1, Range 4 West, thence running south one hundred poles, thence north one hundred and twenty poles, thence west three hundred and twenty poles to the half mile stake on the north boundary line of section 35, T1, Range 4 West thence East three hundred twenty poles to the beginning, being two hundred and forty acres. And at the death of my beloved wife Rebecca Harris the title to and in the above described land shall be vested in my youngest son, J. B. Harris (Julius) his heirs and assigns forever. It is my wish and desire that the said beloved son J. B,. Harris shall live with hi mother Rebecca Harris in join use of the said described land but according to the pleasure and direction of my said wife Rebecca Harris, the balance of my landed estate I give and bequeath unto my five children (to wit) I.N. Harris (Isaac Norwood) John S(herrod) Harris, M(adison) W(illiam) Harris, Caledonia Harris and Mary R(ebecca) Harris, equal shares and interest, but the above children shall pay unto the following named sons and daughters the sums herein specified (as follows) unto the heirs of T(ilman) J(efferson) Harris dec'd twenty-five dollars only as he has already received his full share if my estate, to D(aniel) S(eaborn) Harris seven hundred dollars, to my daughter Permelia K Townsend twenty-five dollars as she has also received a full share of my estate, to Lucy M(iriam) Greenway seven hundred dollars for her sole use and to the heirs of her body and unto S(imon) M(ebane) Harris seven hundred dollars: All the above named sums to the different legatees may be paid and discharged either in land or money except the two small sums which shall be paid in money: should any of my children be indebted to me at the time of my death it is my will that they shall pay only the principal without any interest, as to my stock of horses, mules, cattle, hogs, and all other stock, together with the faming interests, wagons, buggies, carriage, all the household and kitchen furniture and all other means of my estate not otherwise herein mentioned and expressly distribute it is my will that it shall remain in the possession and use of my beloved Rebecca Harris until she thinks proper to give off to the younger children such things as she can spare from time to time as they may need so as to make their share equal to those that have already been furnished the necessary articles of household furniture and fixtures and that is remaining at her death equally divided among my children and in case there arise a dissatisfaction or disagreement about the distribution of division of my estate, it is my will that there be no law suit but that the legatees select five or seven men of discreet judgment as referees and they have this last will and testament before them for their examination they shall make a decision and their decision shall be final and lasting,it is my wish and will that my son, J. B. Harris act as executor to this my last will and testament. In testimony whereof I Sherrod Harris the testator have to this my last will and testament written on one sheet of paper set my hand and seal the 1st day of July 1866, signed, sealed and delivered in the presents of Benjamin Powell Thomas Joyner J. R. Norfleet Sherrod Harris (seal) W.E.Edwards Codicil to the above will: 1. a house in Collierville, Tennessee, to Rebecca Harris 2. a lot in Fayette County, Tennessee to daughter L. M. Greenway, wife of W. W.Greenway, when they have paid off the debt. 3. land in Shelby County, Tennessee, to Xalissa Harris wife of my son , John S. Harris, when paid off.
