    3. The petition by Jost Hite and others is found on p. 253 of the Executive Journals, Council of Virginia, 21 October 1731. The land description given for Jost Hite and others does not match that given for Holtzclaw, Fishback and others. The description would place the lands adjacent. Jost Hite's land *may* be the same as that of the Van Meters. It is useful to note that Holtzclaw, Fishback and others petitioned 10 June 1731 and Jost Hite and others petitioned 21 October 1731, thus making it highly unlikely that the two tracts were the same since Holtzclaw, Fishback and group would not have yet had two years to settle the land by October of the same year. Another reference would be a small booklet written by Klaus Wust, Henry "Hank" Z. Jones, Jr and Ralph Connor titled German Origins of Jost Hite. Additional information regarding Jost Hite may be found in the lawsuit Hite et al. vs Fairfax heard in the General Court of Chancery at Williamsburg. The legal battles ended in 1786, 25 years after the death of Hite and 4 years after the death of Thomas Lord Fairfax. The decision was in Hite's favor. Suzanne Collins Matson
