    1. [GERMANNA] Desperately Seeking Mary
    2. David McCarley
    3. I am seeking direction concerning one of my German ancestors for whom I am presently at a dead end. I am in possession of a copy of a letter dated 1907 which suggests that my ancestor, Moses Tapp, married "Mary Bach, a German girl." Here is my dilemma: The alleged Mary Bach (if that was indeed her name) married said Tapp in Culpeper County circa 1784 based on the ages of their oldest children in later census records. This would place Mary's birth circa 1755/1765. I have contacted Dan Back, who is presently updating the book, A Back Family History, and he advises that out of the more than 40,000 descendants of the immigrant BACK/BACH family that settled in northern Virginia (the part which eventually became Culpeper County), there is not a single Mary Back/Bach of the right age to have been my Mary. One or two of Hermann Back's sons apparently had daughters named Mary, but they were not born until circa 1777, much too early to have been my Mary. So, I have the research of Dan Back and his colleagues ostensibly precludes a Back/Bach connection. To further complicate matters, the name Back/Bach does not appear to be closely associated with the Tapp in Culpeper County land records. In fact, those records appear to place the Back family quite a distance away from the Tapp family. These dead ends leave me with no alternative but to seek fresh ideas to possibly help identify my alleged Mary Bach. Consider the following speculation: There are land records which connect Frederick FISHBACK to the Tapp family. (In fact, he appears to have had a daughter named Mary of the right age to have married Moses Tapp.) The UTTERBACK family is also found living on an adjacent plat to my Tapp ancestors. There are no doubt other families of German origin residing in Culpeper County at the time with last names ending in "back," "boch" or "bach." Were there any of these families known to have shortened their names to Back or Bach? I have read where some immigrants intentionally changed their names for a variety of reasons. I have even considered the possibility that one or more of the Bach males could have fathered an illegitimate daughter whose name does not appear in the Back family register? One other possibility, I suppose, is that Mary Bach could have been the young widow of a Bach male rather than a Bach by birth. However, I presume Dan Back would have advised of that possibility in his response to my inquiry if. I know I am grasping for straws here, but such is my plight at this point. I would appreciate any ideas the list can provide that might help me refine, add to or eliminate the above possibilities. At this point, anything is possible. David

    3. I received a request for the deed last evening that somehow found its way into my junk mail folder and has now disappeared. (I can't remember who it was from.) If you have requested a copy & have not yet received it, please let me know & I'll send it out ASAP. Thanks, Jan -----Original Message----- From: germanna_colonies-bounces@rootsweb.com [mailto:germanna_colonies-bounces@rootsweb.com] On Behalf Of Jan Hensley Sent: Tuesday, August 26, 2008 7:31 AM To: germanna_colonies@rootsweb.com Subject: [GERMANNA] Hebron Parsonage While searching at the Madison County Courthouse for the property of one of my ancestors, I discovered that his property abutted that of the Hebron Parsonage. One of the old plats referenced a chancery suit, Fray vs. Lutheran Church 1869.05. That chancery suit contains the original 1733 deed of William Carpenter of St. Marks Parish of Spotsylvania to Michael Cook & Michael Smith "Wardons" & trustees of the German Church with, of course, original signatures. The law suit was filed as a partition suit to allow the church to sell a portion of the parsonage land and was filed by Ephriam D. Fray, a "member of the religious congregation known as the Hebron Evangelical Lutheran Church." Thought the list would enjoy reading two extracts from the bill of complaint: ". . . . that all the original deeds of the church were at one time in the hands of Moses Weaver, a trustee, who died at a great age a few years ago." ". . . Your orator further shews that the said Parsonage Tract has been used by the Church, for time whereof the memory of man runs not to the contrary, as a residence for their minister who has usually combined the business of farming with his clerical duties and taken such products as he could raise on the farm as part of his compensation as minister; that whether the clergy as a class are unfitted by their sacred calling for tilling the soil, whether the worthy ministers of this church have happened to be inferior farmers, or whatever may have been the cause, the land has been steadily damaged under their tillage, although of good original quality it is now disfigured with galls and gullies also with old field pines, briars and other noxious growth; the fencing is in bad condition; the building and improvements are old and sadly in want of repairs; and the whole place is in such a condition that nothing short of the constant personal care of a practical farmer - interested as proprietor in its permanent improvement can suffice to restore it to its original state or to render its cultivation at all remunerative. Your orator further shews that it is incompatible with the spiritual interest of the Church that their pastor should be thus subjected to the drudgery of cultivating a farm in order to maintain himself and family, for in this way most of his time is appropriated to secular pursuits, he has no time for pastoral visitation and no fit opportunity for study or for the proper religious instruction of his flock; that such is the practical working of the system that although he congregation is large and the location in other respects very desirable it is now found impossible to secure the services of a minister of an effective and acceptable character unless the old plan of putting the minister to work on the farm be broken up; that they are now deprived of the services of any minister by these very difficulties, but ministers of high order of merit express their willingness to take charge of the Church, if provided with a mere Parsonage elsewhere, and thus allowed to devote all their time and attention to their clerical functions . . . . " Those who would like a copy of the 1733 deed, let me know. FYI: I shot it with a 12.1 megapixel camera so the images are quite large. 2. Mary Ann Shoemaker
    3. Have been checking out several of the web sites given as sources for SniderSnyders etc.. I have several questions/problems with these. lst Martha Stigler who is given as the wife of Michael Snider/Snyder son of John etc..2nd colony etc.. She is not my ancestor but her father is given as Samuel Stigler of Culpeper Co. VA. Samuel Stigler is my ancestor. Samuel Stigler with 400 ac near Piney Mt. in Culpeper is lst found in Nelson Co., VA ( now KY ) in the tithables list in 1787. He died there in 1800 with a will that list his children. Mary/Martha did not marry a Snider she m a Rawson. In the full account of the will he names James Brown his exec. The reading of the entire will Samuel states "my son-in-law" James Brown. James Brown m Sally Stigler dau of Samuel. He was the son of Thomas Brown , will Culpeper Co. VA 1786: "wills Culpeper Co. VA will book C, p 220/221/222; 29 Oct 1786/ probate 15 Jan 1786 (have copy of actual will and these are the dates.. the transcriber meant to give 1787 as the probate date?) Thomas in the above will states: "To my son James Brown: 2 young Negroes, *Ruben that he has already in possession* of & Harry" The tithables lists of Nelson Co. VA (KY) give Rubin as the black listed as a tith of James Brown. James Brown is found on 1785 tithable list with a black male and black female. In 1786 he has two tithes.. he and "*Rubin *(Negro) " James Brown, Samuel Stigler, John Snider/Snyder all are living in the western part of Nelson Co., VA (KY) by 1787 according to the tithable lists. (All three, my ancestors) Samuel Stigler in his will written 22 March 1800 Nelson Co., KY, p 393 "To wife Sarah her lawful part. To son Benjamin, the plantation where I live. To daughter Gilly land in Hardin Co, feather bed and furniture. To dau Mary Rawson L5. Rest of estate to be divided a share to each. To: Sally Brown, Patty Snyder, Charlotte Eldridge, Nancy Dorsey,. Benjamin Stigler, and the children of my daughter Lane Furman. "Abstracts of Wills 1785-1820 Book 1 A-D, Nelson Co., KY. p 18" (I have a full copy of the original will) As to whether the John Snyder listed with these two men is the John Snyder who named three sons in his will, Adam, Michael and Adam. I cannot definitely prove. but.... John Snyder appears on the tithable lists in 1786 again living in the same area as Samuel Stigler and James Brown. His brother Adam Snyder settled in Jefferson Co. KY which is just north of Nelson. Back to Samuel Stigler. He married 3 times. 1st to Sarah 2nd to Ann Wortham @ 1774 3rd Sarah Martin 1787 Nelson Co. VA (KY) First wife Sarah is listed in the King George Co., VA ct record where Samuel and wife Sarah are selling his 63 ac in King George Co. that his father gave him. Deed Book 1, p 522-523 " Indenture lst day of Feb 1764 between James Stigler an Martha his wife of King George Co., of one part and Samuel Stigler eldest son of said James Stiglar and Martha. ... for natural love and affection have granted Samuel Stigler on plantation and 60 ac of land being the upper part which James Stiglar holds, ad joying Joseph Harrison, Robt Pect and Capt Joseph Strother... gift of deed 5 April 1764" By Sarah he had the following: Mary , Sally, Patty, Charlotte, and Jane Married 2nd Ann Wortham and had: Nancy, Benjamin and Gilly Ann Wortham had been married before to Samuel Wortham and had 4 children the last two were Charles and Lucy. "Abstracts of Wills 1785-1820" , p 12 (Nelson Co. Will Bk one, p 156) "The accounts of Samuel Stiglor, in maintence of Lucy Wortham and Charles Wortham orphans of Saml. Wortham from 1774-1784." Married 3rd to Sarah Martin 1787 Nelson Co., KY. No children Maybe this will clear up a few records. Mary Ann Shoemaker

    1. [GERMANNA] The Yager Family, in Rockingham County, Virginia!

    3. The Yager Family, in Rockingham County, Virginia! Barbara Elizabeth Yager Barbara Elizabeth Yager, was born on the, 25th of May, in 1881, in the town of Elkton, in Rockingham County, Virginia. Her parents were, William L. Yager, and Sarah 'Columbia' Price Yager. Her father was born, about 1852, also in the town of Elkton, and her mother was born, about 1856, in Fredericksville, in Albermarle County, Virginia. Both of her parents, are buried in the Elk Run Cemetery, in Rockingham County, Virginia. Her father having die in 1896, and her mother in 1911. Lizzie, as Barbara Elizabeth, prefer to called, by family, as well as friends. Was the oldish, of three Yager girls. But unlike her two younger sisters! She was not married in, Rockingham County, as they were. There are no marriage records, for her there. I relive, that her marriage toke place, in the home town of, her further husband. If this is so, it may be the reason, why there are no records, of there marriage. His home town was, Marksville, in Page County, Virginia. And his name was, David Isaac 'Marcellus' Grove! He was born on, the 1st of August in 1879. in Marksville. His mother was, Martha Gertrude Strickler, born about 1856, in that town. His father was, David Thomas Grove, also of Marksville. Once more, there are no records, showing either, a marriage or divorce, for them. I do have, cops of old photos, of each of them, as well as, photos of, William, and Sarah, Yager. Another reason, for the marriage taking place in Marksville. Is the fact, that his mother, die in 1901, of an long unknown illness. And there marriage, would have taking place, before her death!. I was able, to fine one family records, of Barbara 'Lizzie' and David marriage, in an old Strickler journal. There was only six words, " TODAY, DAVID GROVE, MARRY BARBARA YAGER", nothing more. I will go into more details, on both Marksville, and the Strickler family, in a later e-mail. After there marriage, Lizzie and David, left the Shenandoah Valley, not to return to it. But they did not go far, from the Valley, where they were born in! They move to the town of, Clifton Forge, just outside of, the Valley. 3. Besides missing the updated website link I must have missed information on how to get corrections or additions to George. I tried emailing to the address listed at the site but have had no answer so will try the list. I can add quite a bit of information to the Tanner family if it is wanted. Bonnie S. 1. [GERMANNA] Law of Primogeniture in Virginia
    2. Howard Miller
    3. Although the law of primogeniture may have been repealed in 1785, I found it still be practiced in Henry County, Virginia in the early 1800s. -----Original Message----- From: germanna_colonies-bounces@rootsweb.com [mailto:germanna_colonies-bounces@rootsweb.com] On Behalf Of Craig Kilby Sent: Sunday, August 10, 2008 3:52 AM To: germanna_colonies@rootsweb.com Subject: [GERMANNA] Law of Primogeniture in Virginia This topic deserves further treatment. The law of primogeniture in Virginia was repealed in 1785. That is hardly "well after the Revolution." The law of primogeniture applied under two conditions: 1) A person had land but did not mention it in his will. In such a case, if the person had a son or sons, the land would automatically become the property of the eldest son (or only son). In this scenario, one may SOMETIMES find that an eldest son (or only son) not being named in a will because it was understood he was getting the land. One needs to make a careful review of the land records to prove such a father/son relationship. It should never be assumed simply because it conveniently solves a genealogical problem. 2) A person died without a will, owned land and had a son or sons. In such a case, all of the real property (not the personal property) would become the property of the eldest son, subject to the widow's dower rights of 1/3 interest in it for her life. (It is often written and stated that if the widow remarried, she lost her dower rights. This is not true. One reads that sort of language when the ENTIRE estate has been left to her in a life estate. This is where is usually written as "during her life or widowhood" or "if she remarries." This was not to punish the wife for remarrying. That was expected. It was done to protect the childrens' interest in the property. Even though the widow retained her dower thirds for her life, upon her death that interest reverted to her children by the deceased husband, not to her current husband or any children she may have had by a later marriage.) That land was cheap and available in Kentucky is without question. It would be a mistake, however, to make a conclusion that some one moved toKentucky simply upon the basis of the law of primogeniture in Virginia which was repealed in 1785.
