Michelle, I had the same concerns and went to the State of Georgia. http://www.sos.state.ga.us/archives/rs/1832.htm The explanation: The Act of December 3, 1832 divided original Cherokee County into the following ten counties: Cass (Bartow), Cherokee, Cobb, Floyd, Forsyth, Gilmer, Lumpkin, Murrary, Paulding, and Union: (but) in the drawing of the Lottery and in the granting of the land and gold lots, they were treated only as in Cherokee.     3. I believe Olivia is correct. The time a person took possession of the land varied by lot...the key was that it was obligated in the lottery of a certain year. By the same token, you would need to know the exact year your ancestor made the deed when he sold it, and determine what county the property was in by that time, then go to that county for the grantor's deed.     3. The state lines were defined by treaties with other states and countries, southern boundary with Florida defined by 1763 treaty with Spain. At first western boundary was the Mississippi River, but the state relinquished its claim 1802. The largest portion of Georgia at that time was Creek and Cherokee lands, and by treaty with them more counties were added to the named county areas. So prior to the treaty with the Creek tribe that allowed the creation of Appling, it was considered to be part of Georgia but Indian land. I have a maper that goes year by year with the formation of the counties, it also includes other information. as you can fix a location on it and see where the location was relative to the county line changes. Another thing the Florida Georgia was not settled between the two states until in the 1860's, location of the head waters of the St Marys River was questioned. about a ten mile strip at the eastern end of the line. My ancestor drew in the 1832 Land Lottery and it says he drew land in Cherokee County, yet the land was in the Twenty-eight District of the Third Section--it says following that "in the County of Cherokee". Looking at the map of the land and how it was split in 1832, it appears that by the lot and district, it was actually in Murray County. I realize that initially it was all called Cherokee, but he didn't actually sign for the land until 1843--but still, even that paper says Cherokee County----so therefore it confuses me as to where the land actually was. If the land of Cherokee was split into the counties of Cass, Floyd, Murray etc. in 1832, then why doesn't it specify the correct county in 1843 instead of saying Cherokee? And, if I were trying to find who he might have sold the land to, where would I look for a deed (he never lived on it) (Sorry---I am sure this is clear as mud, but I would sure appreciate someone's thoughts) Michelle

He was from South Carolina, but I suspect he might have moved to the general area prior to 1814. Which counties "in the neighborhood" should I look in for records? I'm familiar with "this county was formed out of that county" but not too certain what it means when a county is formed from Indian Lands. Was the land not considered part of the state prior to that? If so, how far "south" did Georgia go before the Indian Land was annexed in 1814 - what were the adjoining counties? Thanks, Libby
