I personally know an Orphan Train Rider and neither he or his brother were legally adopted. They were taken away from negligent parents in NY State and put on a train to Nebraska. They each got a different family. Though their last names were changed to the family surname there was no adoption. I would imagine any records are in the state where they were born. I think these orphans were taken by the state because they were not being cared for properly rather than surrendered by parents.
