A person shall not, except in such cases as are hereinafter specified, at any time after the date of the confirmation of these Bye Laws, erect a gate across any highway, Provided that the foregoing prohibition shall not be deemed to apply in any case where a Gate may be erected in substitution for a gate which, prior to the date of the confirmation of these Bye Laws, may have been lawfully erected across such highway, and where the situation, mode of construction, and manner of use of such gate shall be the same as the situation, mode of construction, and manner of use of the gate, for which such first mentioned gate may be substituted, or shall be such as to lessen, as far as may be practicable, the obstruction of the free passage on such highway. 7. A person shall not at any time after the date of the confirmation of these Bye Laws erect anew a gate so as to open outwards on any highway, or suffer a gate to continue to open outwards on any highway, so that any part of such gate shall, when open, be within the distance of fifteen feet from the centre of such highway, except in any case where such highway has been dedicated, subject to the obstruction consequent upon the existence of a gate so opening outwards. -- Emily Smith
