TRIAL ON A CHARGE OF MURDER. Mr. Justice COLERIDGE took his seat this morning at the early hour of 8 o'clock, for the trial of the only remaining case at these assizes. John GRAHAM was put to the bar, charged with the wilful murder of his wife, Jane GRAHAM, at Ullermire, in the parish of Kirklinton, in this county, on the 24th of September last, by administering poison to her. Mr. KNOWLES, Mr. RAINSBURY, and Mr. BELL conducted the prosecution, and Mr. MATTHEWS, assisted by Mr. MONTEITH, the defence. The deceased was a young woman of very industrious habits, and had by hard work saved upwards of 100L. from the fruits of her labour while single in Carlisle. She was about 35 years of age, and had been married to the prisoner little better than 10 months. She went to reside with him at Ullermire, where he followed the business of a carter, and she established a school for small children. She was in the family way, and, according to the deposition made by the prisoner, being poorly, she requested him to get her some cream of tartar and magnesia from Carlisle. She attended to her school on Monday, the 23rd of September, but complained of a pain in the side. In the evening of that day she took some of the medicine supposed to have been brought by the prisoner, and to be cream of tartar and magnesia mixed in treacle. On the Tuesday morning she took more, but became worse, could not eat, and vomiting came on. The neighbours were sent for, and her illness was attributed to her expected confinement, though the peculiar symptoms of that event did not appear. Between 2 and 3 o'clock in the afternoon, a Mr. GRAHAM, surgeon, of Ullermire, was called in, and made inquiries into her state, but attributing her illness to the expected labour, and not seeing any immediate occasion for his services, he gave some direction as to what she might take, and left, saying he would call again in the evening. He did so between 7 and 8 o'clock, when she appeared to be sinking. In ten minutes after she died. The prisoner came in, and was questioned by the surgeon as to what had been given her. He said he gave her cream of tartar and magnesia in the morning, and had taken a little of it himself. The surgeon asked for what was left. He said he did not know if any remained, for he left his household affairs during his illness to his good neighbours, and they might have washed it away. The surgeon said it would clear the matter very much if some of it could be found, but none was found. The death being so unexpected and preceded by vomiting, excited suspicion, and it was resolved to hold a coroner's inquest on the body, and the jury assembled for that purpose on Thursday, the 24th, but adjourned to the following day in order that a post mortem examination might take place. The body was opened in the presence of Mr. W. GRAHAM, surgeon of Ullermire, Mr. ARMSTRONG, surgeon of Brampton, and Mr. OLIVER, of Carlisle. The two latter gentlemen delivered in a written report, stating that they had no doubt but that the death of the deceased was caused by some irritant poison - that they had examined the matter contained in the stomach with great care, by processes which had afforded the most conclusive proof that the poison was arsenic. The coroner's jury returned a verdict of wilful murder against the prisoner, and he was committed for trial. These facts were proved, and also that Mr. HARRISON, druggist, of Carlisle, of whom the prisoner said he purchased the cream of tartar and magnesia, had several times sold him articles, but never any arsenic. A great number of witnesses were called to prove the conduct of the prisoner, and a number of minute circumstances as to the contradictory accounts he gave of the deceased and himself, and also of his previous unkind conduct to her, but the procuring of the arsenic could not be brought distinctly home to him. Mr. MATTHEWS addressed the jury at some length on behalf of the prisoner, and contended that the evidence was by no means sufficient to warrant a conviction in any case, and especially not in one where all the feelings and sympathies of nature were enlisted on the side of the prisoner to deter him from the commission of such a crime against his wife, and that too at the moment when he was hourly expecting to become a parent. The learned JUDGE having summed up the case to the jury, they returned a verdict of Not Guilty. The Court was crowded to excess during the trial, and the most intense interest appeared to be excited amongst the assembled multitude. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Another one who got away with it! An inquiry of a very serious nature has occupied the attention of Mr. CARRICK, coroner, during the greater part of the week, at Ullermire, in the parish of Kirklinton, and which has terminated in the committal of John GRAHAM, carter, and dealer in meal, to the gaol at Carlisle, for the wilful murder of his wife, Jane GRAHAM. At this stage of the proceedings we do not feel ourselves at liberty, for many reasons, to publish the whole of the evidence; we shall, therefore, state shortly the facts as they have been communicated to us. GRAHAM and his wife had been married about ten months, during which time they resided at the small village of Ullermire, where he kept a shop for the sale of meal and flour, and deceased taught a school. She was pregnant and near her confinement. On Monday week she was slightly indisposed with symptoms of approaching labour. According to the husband's statement, she had on several occasions pressed him to bring her some medicine from Carlisle, and that he had always forgotten to do so until the last-named day, when he purchased one pennyworth of cream of tartar, and another one of magnesia, from Mr. HARRISON, druggist, in Scotch-street, which he brought home and gave to her; that she gave him some of it in warm milk, and mixed another part in treacle for herself. She took part of it, and they both partook of more next morning at breakfast time, immediately after which he left home. It appears that within an hour after breakfast deceased was seized with violent and frequent vomitings, purging, and pain in her chest, with other symptoms of having taken poison, which continued without intermission till about 8 o'clock the same evening, when she died, after 12 hours of most intense pain and suffering. Arrangements were made by GRAHAM to have her buried on Tuesday; but Mr. PATRICKSON, one of the magistrates for this county, having learned that rumours were afloat that she had died under very suspicious circumstances, caused the parish offices to give notice to the coroner, who attended on Tuesday, and, after examining a great many witnesses, adjourned the court to the following day, and directed a post mortem examination to be made. The inquiry was again resumed, and adjourned to Monday last, when amongst other evidence it was proved by Mr. OLIVER, of Carlisle, Mr. ARMSTRONG, of Brampton, and Mr. GRAHAM, of Ullermire, surgeons, that on a careful analysis of the contents of the stomach, they found a large quantity of arsenic, sufficient to cause the death of half-a-dozen persons, and which, without any doubt, had been the cause of the death of the deceased. A variety of circumstances going to establish the guilt of the husband were deposed to by several witnesses. After the case was closed, the coroner read over the whole of the evidence, and pointed out its bearings very carefully at great length; the room was then cleared, and after a quarter of an hour's consultation, a verdict of "Wilful murder" was returned against John GRAHAM, who was committed to Carlisle gaol to take his trial for the offence at the next spring assizes. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Report about the trial will follow later..... The Times, Tuesday, Oct 29, 1839; pg. 4; Issue 17185; col E LORD BROUGHAM. ----------------- After making some general remarks on the report that obtained currency in London last Monday reporting the death of Lord BROUGHAM, the Carlisle Journal proceeds as follows: - "An accident did befall Lord BROUGHAM and his party on Saturday last, which might have been attended by very serious consequences, and which we will here relate. On the morning in question, his Lordship proceeded in an open carriage and post horses, hired for the purpose from Mr. SHEFFIELD, of the George Inn, Penrith, from Brougham-hall, with the intention of visiting Highhead-castle, a ruin of which his Lordship is one of the co-proprietors, situated about 12 miles north-west of Penrith. His Lordship was accompanied by Mr. LEADER, M.P., and Mr. and Mrs. SHAFTO. When near Thomas Close, about three miles from Highhead, on decending a hill the axletree of the carriage broke, the horses began to plunge, and the post-boy was thrown from his seat. The affrighted animals then set off, dragging the broken carriage after them. Fortunately the accident was seen by some husbandmen near the place, who ran and got hold of the horses, and Lord BROUGHAM and his party got out of the carriage unhurt. The postboy, it was found, was very much injured, and Mr. SHAFTO's servant had received a bruise on one of his legs, but was not much worse. His Lordship appears to have been much vexed by the accident, and immediately sent off an express to Penrith, with the following letter to the George Inn: - " 'Thomas Close, Saturday. " 'Send immediately a postchaise to bring us back. Your carriage is broken to pieces, and your driver is very much hurt. I never saw so scandalous a thing done by an innkeeper. " 'BROUGHAM.' "The letter was marked 'immediate', but his Lordship does not appear to have waited for the chaise, for he and Mr. LEADER walked to Penrith, whence he despatched a surgeon to attend the postboy. We are sorry to say the boy is not yet out of danger. "On Sunday the noble and learned Lord and his party set off for Keswick, and thence, we understand, proceeded into Borrowdale, and amidst the wild and ragged mountains of that district his Lordship probably read the melancholy intelligence of his own death! He returned to Brougham-hall on Thursday, where he had a large party to dinner. "The affair naturally excited great interest throughout the country. The Times, Saturday, Nov 10, 1838; pg. 7; Issue 16883; col D HORRIBLE MURDER BY A MANIAC. - Thursday morning last one of the most horrible occurrences took place at the village of Ellenborough, near Maryport, which ever fell to our lot to record. The dreadful and appalling scene was the work of a maniac, named Isabella FALCON, aged 26, by whom a helpless and aged woman was cruelly deprived of life. FALCON, who is decidedly insane, was formerly an inmate of a lunatic asylum, but has latterly been a resident in the workhouse of Ellenborough, where on Thursday last she was set to work to peel some potatoes with another pauper, named Jane RAY, 95 years of age. The two women were alone, but they had not been long at work when a loud scream was heard in the room. The other inmates of the workhouse ran to the apartment, but, horrible to relate, before they reached it the wretched maniac had literally severed the head from the body of her venerable victim, and was even then in the act of violently cutting the old woman's neck. Mr. GREGG, surgeon, was immediately sent for, and on his arrival found the head attached to the body only by a little skin, and a small part of the windpipe, the bones of the neck having been completely severed. On the coroner's inquest being held these facts were clearly proved, and the culprit was committed to take her trial for wilful murder at the next assizes. The lamentable consequences of suffering insane paupers to mix unrestrained with other inmates of a workhouse have frequently been experienced, and the practice cannot be too soon put an end to, or be too universally condemned. - Cumberland paper. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Problems with "Care in the Community" even in those days...
